STAFF MEMBERS PRESENT: Larry Gould, City Inspector and Judy Rasher, Community Service Secretary. GUESTS PRESENT: Darron DeBerry, Cesar Arroyo, Frances Loredo and Aclase Martinez, Mark Hardin called the meeting to order at 6:02 P. M. FIRST ITEM ON THE AGENDA: Oath of office - NA SECOND ITEM ON THE AGENDA: Approval of February 24, 2014 minutes. Kevin Carter made a motion to approve minutes as presented. Joe Frank Rodriguez seconded the motion. Motion carried unanimously. THIRD ITEM ON THE AGENDA: BA Case # 1630: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. Property Owner : Cesar Arroyo Address: 1132 W 31 Legal Description: Block 15 Lot 17 Unit 13 of the Thunderbird Addition Zoning: R2 Larry Gould presented the case before the board. A real estate assessment of the area was performed by a local real estate agent and it was determined that the construction of a carport at 1132 w 31 Street will not have a negative effect on other nearby properties in the neighborhood. Joe Frank Rodriguez made a motion to approve the variance based on the request. Kevin Carter seconded and the motion carried unanimously. FOURTH ITEM ON THE AGENDA: BA Case #1631: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. Property Owner: Jose E & Maria C Ramos Address: 315 Cedar Legal Description: Block 9 Lot 4 of the OT Addition Zoning: R2 Board of Adjustment May 5, 2014 Minutes Page 1 of 3 Larry Gould presented the case before the board. A real estate assessment of the area was performed by a local real estate agent and it was determined that the construction of a carport at 315 Cedar St will not have a negative effect on other nearby properties in the neighborhood. Kevin Carter made a motion to approve the variance based on the request. Joe Frank Rodriguez seconded and the motion carried unanimously. FIFTH ITEM ON THE AGENDA: BA Case #1632: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. Property Owner: Darron A DeBerry Address: 101 Juanita St Legal Description: Block 6 Lot 19 of the Country Club Addition Zoning: R1 Larry Gould presented the case before the board. A real estate assessment of the area was performed by a local real estate agent and it was determined that the construction of a carport at 101 Juanita St will not have a negative effect on other nearby properties in the neighborhood. Joe Frank Rodriguez made a motion to approve the variance based on the request. Kevin Carter seconded and the motion carried unanimously. SIXTH ITEM ON THE AGENDA: BA Case #1633: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. Property Owner: Arthur & Frances Loredo Address: 1110 W 28 St Legal Description: Block 8 Lot 6 Unit lof the Thunderbird Addition Zoning: R2 Larry Gould presented the case before the board. A real estate assessment of the area was performed by a local real estate agent and it was determined that the construction of a carport at 1110 W 28th St will not have a negative effect on other nearby properties in the neighborhood. Kevin Carter made a motion to approve the variance based on the request. Board of Adjustment May 5, 2014 Minutes Page 2 of 3 Property Owner: Severo Tafolla Address: 709 Nassau Legal Description: Block 15 S14' — 13 Lot 14 of the College Hill Addition Zoning: R2 Larry Gould presented the case before the board. A real estate assessment of the area was performed by a local real estate agent and it was determined that the construction of a carport at 709 Nassau St will not have a negative effect on other nearby properties in the neighborhood. Guest, Aclase Martinez expressed his concerns regarding the approval for a carport at 709 Nassau St. Mr. Martinez states his neighbor, Mr. Tafolla has family and friends over and they play loud music, drink and work on their cars in the front yard. He feels that when the carport is installed, the loud music and drinking will become a daily event. Mr. Martinez opposes the approval for a carport at 709 Nassau St. Kevin Carter made a motion to approve the variance based on the request.
