RESOLUTION R15-333
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS, APPROVING THE REQUEST OF THE HALE-uva DUATHLON
COMMITTEE TO HOST THE HALE-uva DUATHLON EVENT;
AUTHORIZING THE FILING OF THE AGREEMENT FOR THE
TEMPORARY CLOSURE OF STATE RIGHT-OF-WAY WITH THE TEXAS
DEPARTMENT OF TRANSPORTATION FOR THIS EVENT; DECLARING
THAT THE EVENT SERVES A PUBLIC PURPOSE; AND AGREEING
TO COMPLY WITH REGULATIONS.
WHEREAS, the Texas Department of Transportation owns and operates FM Rd
3466 (S.W. 4th Street), South Columbia Street, and FM 400 (South Date Street) in the
corporate limits of the City of Plainview; and
WHEREAS, the City of Plainview received a request from the HALE-uva
DUATHLON Event Director on December 18, 2014 for police assistance in their event to
be scheduled on Saturday, April 251" 2015 ;and
WHEREAS, the HALE-uva DUATHLON will include three events: (i) 5K (3.1 miles)
run; (ii) 21 mile cycle; and (iii) another 5K(3.1 miles) run. This event will start and end at
the 011ie Liner Center; and
WHEREAS, this event will begin at 8:00 a.m. and will conclude by 12:00 p.m.; and
WHEREAS, the City Council of the City of Plainview finds that such event serves
a public purpose in that it increases the public awareness in the importance of physical
fitness, and this event brings awareness of the Crisis Center of the Plains; and
WHEREAS, the City Council of the City of Plainview, Texas finds it in the best
interest for the citizens of Plainview that HALE-uva DUATHLON be held on April 251h
2015 and use the attached referenced routes; and
WHEREAS, the Texas Department of Transportation requires the Local
Government to submit a completed Agreement for the TemporaryClosure of State Right -
of -Way for use of FM Rd 3466 (S.W. 4th Street), South Columbia Street, and FM 400
(South Date Street) in such public events as this HALE-uva DUATHLON; and
WHEREAS, the City Council designates Mayor Wendell Dunlap as the City's
authorized official. The authorized official is given the power to apply for or terminate such
Agreement on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Plainview that:

The request from the HALE-uva DUATHLON Committee to host their first ever
event on April 25th, 2015 is hereby approved.
The public purpose of this event is to increase the public awareness in the
importance of physical fitness and to benefit the Crisis Center of the Plains.
Submission of the completed AGREEMENT FOR THE TEMPORARY CLOSURE
OF STATE RIGHT-OF-WAY with the Texas Department of Transportation is hereby
approved.
IV.
The Mayor is hereby authorized and directed to execute, respectively, on behalf of
the City of Plainview, all necessary documents, including the AGREEMENT FOR THE
TEMPORARY CLOSURE OF STATE RIGHT-OF-WAY to complete the Plainview HALE-
uva DUATHLON preparation process,
