ORDINANCE NO. 90-2836
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXA~, A~R. NDING ORDINANCE 85-2600, SETTING
FORTH FEE REQUIREMENTS FOR BUILDING, ELECTRICAL AND
PLUMBING PERMITS; ESTABLISHING FEE REQUIREMENTS AS THEY
PERTAIN TO BUILDING, ELECTRICAL AND PLUMBING PERMITS
NECESSARY FOR THE ADDITION TO THE HALE COUNTY LAW
ENFORCEMENT CENTER (JAIL); PROVIDING FOR SEVERABILITY
CONFLICTS AND OT~R. R RELATEDMATTERS.
WHEREAS, Ordinance No. 85-2600 sets forth various fees to be
charged for every applicant of a building, electrical and
plumbing permit; and
WHEREAS, Ordinance No. 85-2600 also states that there shall
be no exemptions of fees permitted; and
WHEREAS, on June 13, 1989, Judge Bill Hollars, on behalf of
Hale County, received a Specific Use Permit for the purpose of
the construction of an addition to the Hale County Law
Enforcement Center (Jail), and which is located on Lot 1,
Pressler Addition, Unit No. 1, Plainview, Hale County, Texas, and
located at 1900 South Columbia; and
WHEREAS, the addition adds a needed 102-bed expansion to the
presently overcrowded Law Enforcement Center (Jail) which will be
of benefit to the citizens of Hale County and the residents of
the City of Plainview; and
WHEREAS, the City Council of the City of Plainview
recognizes and finds the need for the additional jail space to be
in the best interest of the City of Plainview.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PLAINVIEW, TEXAS:
SECTION 1: That it is in the best interest of the City of
Plainview that all fees for the construction of an
addition to the Hale County Law Enforcement Center
(Jail) in regard to building, electrical and plumbing
permits be waived and the Building Official instructed
to issue said permit.
SECTION 2: Severability.
If any provision of this ordinance hereby adopted or
the application thereof to any person or circumstances
is held invalid, the remainder of the ordinance and the
application of such provisions to other persons or
circumstances, shall not be affected thereby.

SECTION 3:
Conflicts
If any of the provisions of this ordinance hereby
adopted or the application thereof to any person or
circumstance is in conflict with another provision or
ordinance, the provisions set forth in this ordinance
shall prevail.
SECTION 4: Publication.
The City Secretary is hereby authorized, pursuant to
Local Government Code §52.913 (Vernon 1990) to publish
only the caption and penalty provisions of the
Ordinance.
SECTION 5: Effective Date.
This Ordinance shall be of full force and effect upon
its passage and publication as required by law.
