HomeMy WebLinkAbout90-2842ELECTIONS.- WRITE-IN CANDIDATES ORDINANCE NO. 90- 2842 AN ORDINANCE REQUIRING A WRITE-IN CANDIDATE IN CITY ELECTIONS TO DECLARE CANDIDACY THIRTY (30) DAYS IN ADVANCE OF THE DATE OF ELECTION. WHEREAS, the passage, promulgation, and enforcement of the provisions herein contained are determined necessary and advisable for the promotion of the general welfare of the community to carry out the governmental powers delegated to and possessed by the City of Plainview; and WHEREAS, Article XI of the Charter of the City of Plainview provides that the City Council shall make rules and regulations governing the ordering, giving notice and manner of conducting elections; NOW, THEREFORE, be it ordained by the City Council of the City of Plainview, Texas: Section 1: Any qualified elector of the City, who is otherwise qualified, in order to be entitled to stand for election as a write-in candidate must file with the City Secretary a declaration of write~in candidacy not later than the 30th day prior to the election. The declaration of write-in candidacy must meet the same requirements as an application for a place on the ballot. Section 2: Severability. Should any section, paragraph, sentence, clause or word of this Ordinance or of the Code adopted hereby, be declared unconstitutional or invalid for any reason, the remainder of this Ordinance, and of the Code adopted hereby shall not be affected thereby. Section 3: Conflicts. Ail ordinances or parts of ordinances in conflict with this article are hereby repealed to the extent of such inconsistency. 1 of 2 Section 4: This ordinance shall take effect and be in force from and after the passage and approval by the City Council of the City of Plainview, Texas as required by law.
