HomeMy WebLinkAboutR15-343271 RESOLUTION R15-343 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, APPROVING THE REQUEST OF THE PLAINVIEW CHAMBER OF COMMERCE TO HOST THE COWBOY DAYS "HALE ON WHEELS" BICYCLE RIDE AND CRIMESTOPPERS' "FUN COLOR RUN"; AUTHORIZING THE FILING OF THE AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT-OF-WAY WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR THIS EVENT; DECLARING THAT THE EVENT SERVES A PUBLIC PURPOSE; AND AGREEING TO COMPLY WITH REGULATIONS. WHEREAS, the Texas Department of Transportation owns and operates Southwest 4th Street (also known as FM 3466) in the corporate limits of the City of Plainview; and WHEREAS, the City of Plainview received a request from the Plainview Chamber of Commerce on August 3, 2015 for police assistance in its Cowboy Days "Hale on Wheels" Bicycle Ride and Crimestoppers' "Fun Color Run" ; and WHEREAS, both events will begin at Southwest 4th (FM 3466) and Broadway; and WHEREAS, the City Council of the City of Plainview finds that such events serve a public purpose in that they are in conjunction with the annual Cowboy Days' event which increases the public awareness in the importance of our history; and WHEREAS, the City Council of the City of Plainview, Texas finds it in the best interest for the citizens of Plainview that the two events be held this year on Saturday, September 19, 2015 beginning at 7:30 a.m. and use the above referenced location as part of the event; and WHEREAS, the Texas Department of Transportation requires the Local Government to submit a completed Agreement for the Temporary Closure of State Right - of -Way for use of FM 3466 at Broadway Street in such public events as this Hale on Wheels Bicycle Ride and Fun Color Run; and WHEREAS, the City Council designates Mayor Wendell Dunlap as the City's authorized official. The authorized official is given the power to apply for or terminate such Agreement on behalf of the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Plainview that: Res. R15-343 Hale on Wheels Bicycle Ride and Run 2015 Page 1 272 The request from the Plainview Chamber of Commerce for the Hale on Wheels Bicycle Ride and Fun Color Run to be held on Saturday, September 19, 2015 for police assistance is hereby approved. The public purpose of these events is to increase the public awareness in the importance of our cultural heritage. Submission of the completed AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT-OF-WAY with the Texas Department of Transportation is hereby approved. IV. The Mayor is hereby authorized and directed to execute, respectively, on behalf of the City of Plainview, all necessary documents, including the AGREEMENT FOR THE TEMPORARY CLOSURE OF STATE RIGHT-OF-WAY to complete the Hale on Wheels Bicycle Ride preparation process.
