BOARD OF ADJUSTMENT
VARIANCE FINDINGS
APPELLANT: Plainview ISD BA 1606 DATE OF HEARING: November 22, 2010
The undersigned, as a member of the Zoning Board of Adjustment has taken into account, among other things,
the character and use of adjoining buildings and those in the vicinity, the number of persons residing or working
In such buildings or upon such land and traffic conditions in the vicinity of such property, and makes the
following findings:
1. There are special circumstances or conditions applying to the land or building for which the variance is
sought, which circumstances or conditions are peculiar to such land or buildings and do not apply generally to
lands or buildings in the same zone or neighborhood, and that said circumstances or conditions are such that the
strict application of the provisions of this ordinance would deprive the applicant of the reasonable use of such
land or buildings; and,
2. The granting of such variance will not be detrimental to the public welfare or substantially or permanently
Injurious to the property or improvements in such zone or neighborhood in which the property is located; and,
3. The granting of the variance is necessary for the reasonable use of the land or building and that the variance
as granted by the Board is the minimum variance that will accomplish this purpose; and,
4. The literal enforcement and strict application of the provisions of the Zoning Ordinance will result in
unnecessary hardship inconsistent with the general provisions and intent of such ordinance and that in granting
such variance the spirit of the ordinance will be preserved and substantial justice done.
5. The following conditions are necessary to secure substantially the purpose and intent of the Zoning
Ordinance:
a) BA Case # 1606 The request of Plainview Independent School Disrict for a variance of two hundred
(200) feet of the required two hundred (200) foot setback to build a communication tower adjacent to a
Residential Zoned District (MF -2) as stated in Section 8 of the City of Plainview Zoning Ordinance in a
C -3 Zoning District and being Edgemere Heights Block 1 Less 275X220 out of SW /C & Lake Less
26,525 Sq Ft and .577 acre parcel out of SE /C, Plainview, Hale County, Texas, the same being 2400-
2600 Yonkers.

The undersigned, as a member of the Zoning Board of Adjustment has taken into account, among other things,
the character and use of adjoining buildings and those in the vicinity, the number of persons residing or working
In such buildings or upon such land and traffic conditions in the vicinity of such property, and makes the
following findings:

a) BA Case # 1607 The request of Josefina Hernandez for a variance of six (6) feet of the required
twenty -five (25) foot front setback to build a 7'X 32' porch as stated in Section 34 of the City of
Plainview Zoning Ordinance in an (R -2) Zoning District and being Original Town Block 58 Lot 2,
Plainview, Hale County, Texas, the same being 313 Elm.
