HomeMy WebLinkAbout05.24.2010 BA Variance Findings BOARD OF ADJUSTMENT VARIANCE FINDINGS APPELLANT: Martina Torres BA 1589 DATE OF HEARING: May 24, 2010 The undersigned, as a member of the Zoning Board of Adjustment has taken into account, among other things, the character and use of adjoining buildings and those in the vicinity, the number of persons residing or working In such buildings or upon such land and traffic conditions in the vicinity of such property, and makes the following findings: 1. There are special circumstances or conditions applying to the land or building for which the variance is sought, which circumstances or conditions are peculiar to such land or buildings and do not apply generally to lands or buildings in the same zone or neighborhood, and that said circumstances or conditions are such that the strict application of the provisions of this ordinance would deprive the applicant of the reasonable use of such land or buildings; and, 2. The granting of such variance will not be detrimental to the public welfare or substantially or permanently Injurious to the property or improvements in such zone or neighborhood in which the property is located; and, 3. The granting of the variance is necessary for the reasonable use of the land or building and that the variance as granted by the Board is the minimum variance that will accomplish this purpose; and, 4. The literal enforcement and strict application of the provisions of the Zoning Ordinance will result in unnecessary hardship inconsistent with the general provisions and intent of such ordinance and that in granting such variance the spirit of the ordinance will be preserved and substantial justice done. 5. The following conditions are necessary to secure substantially the purpose and intent of the Zoning Ordinance: a) BA Case # 1589 The request of Martina Torres for a variance of thirty (30) feet of the required thirty - five (35) foot front setback and twenty -five (25) feet of the required twenty -five (25) foot side setback to build an 18'X 21' carport as stated in Section 34 of the City of Plainview Zoning Ordinance in a Multi - Family (MF -1) Zoning District and being Highland Addition Block 1, W10' Lot 7, Lot 8, Plainview, Hale County, Texas, the same being 405 W. 1 lth b) All carports must have an impermeable surface (i.e. concrete, asphalt) applied to the driveway within 6 months of approval of the variance. The following conditions are necessary to secure substantially the purpose and intent of the Zoning Ordinance: a) BA Case 1596 The request of Graciano Saucedo for a variance of ten and one half (10 %2) feet of the required twenty -five (25) foot front setback to build a 6' X 8' porch as stated in Section 34 of the City of Plainview Zoning Ordinance in a Single Family Residential (R -2) Zoning District and being Houston Block 2 Lot 4, Plainview, Hale County, Texas, the same being 407 W. 20th. The following conditions are necessary to secure substantially the purpose and intent of the Zoning Ordinance: a) BA 1597 The request of Richard Adame for a variance of four (4) feet of the required thirty (30) foot front set back and eight feet (8) of the required eight (8) foot side setback to build an 11' X 33' oversized carport, and a variance of four (4) feet of the required thirty (30) foot front set back to build a 5'6" X 27'6" covered porch attached to the carport as stated in Section 34 of the City of Plainview Zoning Ordinance in a Single Family Residential (R -1) Zoning District and being Schoolview Block 2 Lot 2, Plainview, Hale County, Texas, the same being 1423 Smythe. b) All carports must have an impermeable surface (i.e. concrete, asphalt) applied to the driveway within 6 months of approval of the variance.
