VARIANCE FINDINGS
APPELLANT: Paulin Pizana CASE NO: BA 1551
DATE OF HEARING: June 23, 2008
The undersigned, as a member of the Zoning Board of Adjustment has taken into account, among other things, the character
and use of adjoining buildings and those in the vicinity, the number of persons residing or working In such buildings or upon
such land and traffic conditions in the vicinity of such property, and makes the following findings:
1. There are special circumstances or conditions applying to the land or building for which the variance is sought, which
circumstances or conditions are peculiar to such land or buildings and do not apply generally to lands or buildings in the same
zone or neighborhood, and that said circumstances or conditions are such that the strict application of the provisions of this
ordinance would deprive the applicant of the reasonable use of such land or buildings; and,
2. The granting of such variance will not be detrimental to the public welfare or substantially or permanently Injurious to the
property or improvements in such zone or neighborhood in which the property Is located; and,
3. The granting of the variance is necessary for the reasonable use of the land or building and that the variance as granted
by the Board Is the minimum variance that will accomplish this purpose; and,
4. The literal enforcement and strict application of the provisions of the zoning ordinance will result in unnecessary hardship
inconsistent with the general provisions and intent of such ordinance and that in granting such variance the spirit of the
ordinance will be preserved and substantial justice done.
5. The following conditions are necessary to secure substantially the purpose and intent of the Zoning Ordinance.
BA Case # 1551 The request of Paulin Pizana for a variance of twenty -two (22) feet of the required twenty-five (25) foot front
setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 24'X24' carport in a Single Family
Residential (R -2) Zoning District, and being Block 7, Lot 15, Unit 1, Thunderbird Addition, Plainview, Hale County, Texas the
same being 2606 Lexington Street.
If the Board of Adjustment approves the request, a building permit must be obtained from the Building Inspections Department in City
Hall prior to construction. Minimum building permit fees are $45. All carports must have an impermeable surface (i.e. concrete,
asphalt) applied to the driveway within 6 months of approval of the variance.

and use of adjoining buildings and those in the vicinity, the number of persons residing or working In such buildings or upon
such land and traffic conditions in the vicinity of such property, and makes the following findings:

BA Case # 1552 The request of Jose Murgia for a variance of three (3) feet of the required five (5) foot side setback stated in
Section 34 of the City of Plainview Zoning Ordinance to construct a 20'X28' carport in a Single Family Residential (R -2) Zoning
District, and being Block 73, South 10' of Lot 3 and all of Lot 4, Highland Addition, Plainview, Hale County, Texas the same
being 1501 Nassau Street.
If the Board of Adjustment approves the request, a building permit must be obtained from the Building Inspections Department in City
Hall prior to construction. Minimum building permit fees are $45. All carports must have an impermeable surface (i.e. concrete,
asphalt) applied to the driveway within 6 months of approval of the variance.

such land and traffic conditions in the vicinity of such property, and makes the following findings:

Family Residential (R -2) Zoning District, and being Block 6, Lot 4, Unit 2, Thunderbird Addition, Plainview, Hale County,
Texas the same being 1406 W. 26 Street.
If the Board of Adjustment approves the request, a building permit must be obtained from the Building Inspections Department in City
Hall prior to construction. Minimum building permit fees are $45. All carports must have an impermeable surface (i.e. concrete,
asphalt) applied to the driveway within 6 months of approval of the variance.

such land and traffic conditions in the vicinity of such property, and makes the following findings:

setback as stated in Section 34 of the City of Plainview Zoning Ordinance to construct a 12'3"X20' carport in a Single Family
Residential (R -1) Zoning District, and being Block 1, Lot 14, Harris — Malone Addition, Plainview, Hale County, Texas the same
being 1008 Travis Street.

and use of adjoining buildings and those in the vicinity, the number of persons residing or working In such buildings or upon
such land and traffic conditions in the vicinity of such property, and makes the following findings:

BA Case # 1555 The request of James Doyle Sams for a variance of eight (8) feet of the required eight (8) foot side setback stated
in Section 34 of the City of Plainview Zoning Ordinance to construct a 12'X21' carport in a Single Family Residential (R -1)
Zoning District, and being Block 4, Lot 19, Brandes Addition, Plainview, Hale County, Texas the same being 804 Canyon Street.
If the Board of Adjustment approves the request, a building permit must be obtained from the Building Inspections Department in City
Hall prior to construction. Minimum building permit fees are $45. All carports must have an impermeable surface (i.e. concrete,
asphalt) applied to the driveway within 6 months of approval of the variance.
