ORDINANCE NO. 90- 2846
AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS
IMPLE~9~fING CHAPTER 143, LOCAL GO~
CODE FOR THE CITY OF PLAINVIEW FIRE
DEPART~RNT IN ACCORDANCE WITH STATE LAW.
WHEREAS, Resolution No. R90-139 ordering the canvass of the
election returns and declaring the results of the general and
special election held on May 5, 1990 recognized that the Civil
Service election for members of the fire department' was given in
accordance with the law .and that such proposition was duly
approved by the voters; and
WHEREAS, Resolution No.'R90-155 also recognized the approval
by general election, of the establishment of Civil Service for
the fire department of the City of Plainview; and
WHEREAS, Resolution No. R90-155 further recognized and
provided that the chief executive of the municipality shall
appoint the members of the commission within sixty (60) days
after the adoption by the voters and that the members of the
commission shall be confirmed by the governing body of the
municipality; and
W~F. REAS, Resolution No. R90-155 appointed Lee Soucy, Juan
Escamilla, and Gary Garrison as the initial members for the Civil
Service Commission; and
WHEREAS, Resolutions No. R90-I39 and R90-155 are attached to
this ordinance and incorporated herein; and
WHEREAS, ~143.006(b) Local Government Code, requires a
governing body to implement the provisions of state Civil Service
law within thirty (30) days after the date of the municipality's
first full fiscal year subsequent to the adoption of the election
approving the establishment of Civil Service.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of Plainview, Texas that:
Section 1. In accordance with §143.006 Local
Government Code, the provisions of Chapter 143, Local
Government Code are hereby adopted and implemented in
accordance with the law.

Section 3. Conflicts: Ail ordinances or portions of
any ordinance of the City of Plainview, Texas in
conflict herewith, are hereby amended to conform with
the provisions hereof.
Section 4. Severabilit¥: If any section, subsection,
sentence, clause, phrase, or portion of thiS ordinance
is for any reason held invalid or unconstitutional by
any court of competent jurisdiction, such portion shall
be deemed a separate, distinct and independent
provision and such holding shall not affect the
validity of the remaining portions hereof.
