HomeMy WebLinkAbout90-2847PUBLIC SAFETY -'CONSOLIDATION ORDINANCE NO. 90-2847 AN ORDINANCE AMENDING CHAPTER 10, OF THE PLAINVIEW CITY CODE, ENTITLED, "FIRE PROTECTION AND PREVENTION"; PROVIDING FORT HE DESIGNATION OF A DEPARTMENT~ AND CHIEFOF THE FIP~ DEPARTMENT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Mayor, City Council and City Administration have conducted extensive studies addressing the feasibility for public safety consolidation; and WHEREAS, it is hereby found by Mayor and City Council that consolidated public safety for the City of Plainview will improve service delivery for Police, Fire and EMS Services and be in the best interest of the City of Plainview; and WHEREAS, the first step towards the creation of a consolidated public 'safety unit for the City of Plainview is the creation of an Office of Public Safety. WHEREAS, Ordinance No. 89-2802 established the Director of Public Safety as the Fire Chief; and WHEREAS, the adoption and implementation of state civil service law requires an amendment to our local code in order to conform local law to state civil service law. NOW, THEREFORE, BE IT ORDAINED that Section 10-6 of the Plainview City Code is hereby amended to read as follows: Section 1. Section 10-6. Office of Director of Public Safety The office of Director of Public Safety is hereby created and establiShed for the City. The Director of Public Safety shall be responsible for the public safety services of the City, including the police and fire departments. The Director will establish an appropriate hierarchy of supervision to operate these departments, including the selection of the appropriate department heads. The department head for the Fire Department shall be the Fire Chief. The Director of Public Safety shall be appointed by the City Manager. Section 2. Should any section, paragraph, sentence, clause, phrase, or word of this ordinance be declared unconstitutional or invalid for any purpose, the remainder of this ordinance shall not be effected. Section 3. This ordinance shall become effective upon its lawful passage. PASSED AND APPROVED this 23rdday of October , 1990. E.V.
