HomeMy WebLinkAbout04-3431 ord256 ORDINANCE AMENDMENT ORDINANCE NO. 04 -3431 AN ORDINANCE AMENDING THE TABLE OF CONTENTS AND CHAPTER 20, PLUMBING, OF THE CITY OF PLAINVIEW CODE OF ORDINANCES TO ADOPT THE UNIFORM PLUMBING CODE (2003 EDITION) AND THE UNIFORM MECHANICAL CODE (2003 EDITION) CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE, AND EFFECTIVE DATE. WHEREAS, Chapter 20, Sets forth the minimum standards for plumbing installations, and WHEREAS, from time to time it is advisable to review the ordinances that regulate installation of piping and plumbing components in all buildings within the City of Plainview; and WHEREAS, it is advisable to adopt additional codes to address regulation and installation of mechanical components, and WHEREAS, the Building Trades Fire Code Board of Appeals has reviewed staff recommendations on adoption of the Uniform Plumbing Code, 2003 Edition and the Uniform Mechanical Code, 2003 Edition; and WHEREAS, the Uniform Plumbing Code, 2003 Edition and the Uniform Mechanical Code, 2003 Edition, with proposed amendments as herein after made has been duly presented to the City Council; and WHEREAS, the City Council of the City of Plainview finds that it would not be detrimental or injurious to the public health, safety or general welfare of the citizens of the City of Plainview: NOW, THEREFORE, The City of Plainview Hereby Ordains That: SECTION I The City of Plainview, Code of Ordinances, Table of Contents is changed as follows: Is amended to read: Plumbing /Mechanical SECTION II Chapter 20, is amended as follows: Ordinance No. 04 -3431 Page 1 of 14 Art. Definitions Licensed Irrigator: A person licensed by the Texas Board of Irrigators under the Licensed Irrigators Act, Article 8751, Section 7, Vernon's Texas Civil Statutes who sells, designs, consults, installs, maintains, alters, repairs or services an irrigation system including the connection of such system in and to a private or public, raw or potable water system or any water supply. Room or Space Heater: A self contained' gas burning appliance installed in and for heating rooms. All persons who engage in or work at the actual installation, alteration, repair and renovating of plumbing shall posses either a master or journeyman plumber's liccn c or an apprentice registration card the appropriate license in accordance with the provisions of the Plumbing Law License. All installation hereafter installed within the corporate limits of the City of Plainview shall be done in a first class workmanlike manner in accordance with the 1997 2003 edition of the Uniform Plumbing Code as adopted at the sixty seventh annual conference of by the International Association of Plumbing and Mechanical Officials, and said Uniform Plumbing Code is made a part of this Ordinance, with the additions and deviations therefrom contained in this code. (Ord. No. 96 -3072, 5- 28 -96; Ord. No. 99- 3216, 5- 25 -99) Sec. 20 -131. Conformance with code. (a) All plumbing systems hereafter installed shall conform with the provisions of the 1997 2003 Uniform Plumbing Code, as amended: (Ord. No. 85 -2587, 2- 25 -85) (Amended Ord. No. 96 -3072, 5- 28 -96; Ord. No. 99 -3216, 5- 25 -99) Amendments to the 1997 2003 Uniform Plumbing Code: Section 102.3.2 is amended to read as follows: Any person, firm, or corporation violating any provision of this Code shall be deemed guilty of a Class C misdemeanor, and upon conviction thereof, shall be punishable of a fine not to exceed $2000.00 per offense. Each separate day or any portion thereof, during which any violation of this Code occurs or continues, shall be deemed to constitute a separate offense. Section 103.4.1 is amended to read as follows: The fee for each permit shall be set forth in Section 20 -99 of the Plainview Code of Ordinances. Section 103.1.2 is hereby dcletod Section 103.1.3 is hereby deleted Section 103.4.5.3 is hereby deleted Section 103.5.1.1 is amended to add the following requirements: The following inspections shall be required for all plumbing installations in any building or structure: (a) Rough -in and sewer: All water, waste, vent, gas, and drainage piping installed below grade. (b) Stackout: A visual inspection of all water, waste, vent, gas piping installed above the floor. (c) Final: To be made after all plumbing work is completed and the building or structure is ready for occupancy; and (d) Water Service Inspections: In accordance with State Laws requiring a water purveyor to perform certain inspections of its customers facilities, the property owner shall allow his property to be inspected for possible cross connections and other illegal plumbing practices. These inspections shall be conducted prior to initiating service and after any changes to the plumbing system which require a permit and inspection. The property owner and tenant shall be notified in writing of any cross connection or other illegal plumbing practice which has been identified during the inspection. The property owner shall immediately have any illegal plumbing installation on his /her premises corrected. The property owner shall cause all backflow prevention devices required by the code to be installed, tested and maintained in accordance with this code. Copies of all testing and maintenance records shall be provided to the City of Plainview Building Inspections Department. (e) Re- inspection: When additional inspections are necessary due to plumbing installations both being completed or meeting code requirements when requested for inspection. Section 103.5.6 Reinspections. Page 5 of 14 Combination waste and vent systems shall be permitted only where structural conditions preclude the installation of conventional systems as otherwise prescribed by this Chapter. All combination waste and vent systems must be approved by the Building Official or the Plumbing Inspector prior to installation. In no event shall a combination waste and vent system be used in a commercial kitchen installation. A commercial kitchen installation must comply with Section 1014.5 Section 1101.1 is amended by adding the following: Direct connection to the city storm sewer system shall not be made. Section 1101.5 the first sentence thereof is amended as follows: Where sub surface groundwater is present, subsoil drains may be required around the perimeter of buildings having basements, cellars, or crawl spaces, or floors below grade. Section 1204.5 is amended to add: (a) Unvented gas burning room heaters equipped with an Integral Oxygen Depletion Sensing System (ODS) may be installed in Group R 3 residential occupancies if the unit is certified by an approved scientific testing laboratory and it is installed in accordance with ANSI Z21.112 the N Fuel Gas Codc ac copyrighted in 1002 b the A Gac Ascociation, 1515 Wilcon Boulevard, Arlington VA -2220g. (b) Existing gas- burning unvented room heater(s) installed in R-3 residential occupancies which do not comply with code requirements shall be removed or replaced with vented or other approved heaters when alterations or remodeling of the structure occur which would require a building permit, or when a city ',pressure test is required on the gas line system. Additionally all gas outlets for room heaters in bathrooms and bedrooms shall be capped. EXEMPTION: Homeowners that are living in their homestead are exempted from the requirement of removing the non- approved heaters when a pressure test of the gas line is done. However, the requirements to replace unvented heaters shall be enforced when a building permit is required. Ordinance No. 04 3431 ARTICLE XIII. MATERIALS QUALITY AND WEIGHT ARTICLE XIV. Mechanical In General Sec. 20 -151. Mechanical license law adopted. Before any person shall do any work or make any connections to an air conditioning or refrigeration system in the city, or do any work connected or intended to be connected to an air conditioning or refrigeration system, she /he shall be licensed as provided in the "Texas Air Conditioning and Refrigeration Contract License Law as amended, the same being, Texas Civil Statutes Article 8861 and Administrative Rules and Texas Department of Licensing and Regulation, Texas Occupations Code, Chapter 51. Administration: The administration and enforcement of the provisions of this chapter shall be vested in the Building Official of the City of Plainview or his designee. Page 7 of 14 ARTICLE XV. It shall be unlawful for any person, association of persons, co- partnership or corporation to engage in the business of Air Conditioning and Refrigeration Contracting or perform any Air Conditioning or Refrigeration Contracting as defined in Sec 20 -192 of this ordinance, without first having procured the necessary licenses and permits as hereinafter provided for and ail mechanical, work and workmanship and materials shall meet the requirements of this ordinance and shall pass all inspections required in this ordinance in regard to the work done. For the protection and preservation of life and the public health, safety, property and the general welfare of the people, the following provisions are enacted relating to the installation, alteration, repair, design, construction, quality of materials, location, operation and maintenance or use of heating, ventilating, cooling, refrigeration systems, incinerators and other miscellaneous heat producing appliances in all buildings and structures and on all property now erected or to be erected, changed, constructed, reconstructed, repaired or altered within the City of Plainview. The intent and purpose of this ordinance is to regulate the construction, erections, enlargement, alteration, maintenance or repair of all mechanical systems used for the purpose of environmental air conditioning, commercial refrigeration or process heating and cooling systems in or on and about any and all premises in the City of Plainview. An air conditioning and refrigeration contracting company must employ full time in each permanent office a license holder whose license is assigned to that company. Unless a person is exempted under the exemptions listed in Sec. 20 -193, a person may not perform air conditioning and refrigeration contracting without a license. Sec. 20 -192. Definition of Air Conditioning and Refrigeration Contracting "Air Conditioning and Refrigeration Contracting" shall mean, to perform or offer to perform the design, installation, construction, maintenance, service, repair, alteration, or modification of a product or of equipment in environmental air conditioning, commercial refrigeration, or process cooling or heating systems. Sec. 20 -193. Exemptions from licensing requirement. 1) A person who performs air conditioning and refrigeration contracting in a building owned solely by the person as the person's home; 2) A person who performs air conditioning or refrigeration maintenance work if (i) the person is a maintenance person or maintenance engineer who is a regular bona fide employee of the property owner, the property lessee, or the management company managing the property where the maintenance work is being performed, (ii) the work is performed in connection with the business in which the person is employed, and (iii) the person and the person's employer referred to in (i) above do not engage in the occupation of air conditioning and refrigeration contracting for the general public; (3) A person who performs air conditioning and refrigeration contracting and is regularly employed by a regulated electric or gas utility; (4) A person who is licensed as a professional engineer under The Texas Engineering Practice Act (Article 3271a, Vernon's Civil Statutes), performs work in connection with the business in which the person is employed, and does not engage in the practice of air conditioning and refrigeration contracting for the general public; (5) A person who performs process cooling or heating work for an industrial operation such as a chemical plant, petrochemical plant, refinery, natural gas plant, or natural gas treating plant when employed by that operation; (6) A person who performs air conditioning and refrigeration contracting on: (a) A portable or self contained ductless air conditioning product that has a cooling capacity of three (3) tons or less; (b) A portable or self contained heating product that does not require the forced movement of air outside the heating unit; (c) Environmental air conditioning equipment that is intended for temporary use and is not fixed in place; or (d) Residential refrigerators, freezers, and ice machines; or (7) A person who performs air conditioning services only on a motor vehicle or MVAC -like appliance air conditioner or who employs a person who performs air conditioning services only on a motor vehicle or MVAC -like appliance air conditioner. For the purposes of this article, "MVAC -like appliance" has the meaning as that term is defined in 40 C.F.R. Section 82.152. (8) A person who assists in the performance of air conditioning and refrigeration contracting work under the supervision of a licensee is not required to be licensed. Ordinance No. 04 -3431 Page 9 of 14 (9) A person who installs, repairs, or removes a vent hood of the type commonly used in residential and commercial kitchens. The above exempted requirements for licensing shall not mean that a person performing the above work does not fall under requirements to pull permits. Sec. 20 -212. Conformance with code. Ail mechanical systems hereafter installed shall conform with the provisions of the 2003 Uniform Mechanical Code and the amendments to that code as follows: Amendments to the 2003 Uniform Mechanical Code 110.0 Board of Appeals is hereby deleted in its entirety. See Sec. 6 -41, City of Plainview Code of Ordinances for means of Appeal. 111.0 Violations. Is hereby amended by adding the following: Any person, firm, or corporation violating any provision of this Code shall be deemed guilty of a Class C misdemeanor, and upon conviction thereof, shall be punishable of a fine not to exceed $200.00 per offense. Each separate day or any portion thereof, during which any violation of this Code occurs or continues, shall be deemed to constitute a separate offense. 114.1 Issuance. Is amended by adding the following sections: 114.1.1 Authorized Persons. A mechanical permit shall be issued only to a person who meets the following qualifications: 1.) A person who is licensed under the "Texas Air Conditioning and Refrigeration Contract License Law Texas Civil Statues Article 8861. Ordinance No. 04 -3431 Page 10 of 14 265 2 2.) Any property owner for mechanical work to be done by him in a building owned and occupied by him as his homestead. 3.) A person who installs, repairs or removes a vent hood of the type commonly used in commercial kitchens. 4.) A maintenance person who meets the qualifications listed in Sec. 20- 193 (2) of the City of Plainview Code of Ordinances. 114.1.2 Permits Not Transferable. Each permit issued under this code shall be personal to the permittee. No such permit shall be assigned or transferred to another person and no persons shall permit another person to obtain a permit in his name, or permit any mechanical work to be performed under his permit by any person other than, the person authorized to do the same 114.5 Suspension or Revocation is amended by adding the following paragraph to the end of the section: Any person who shall willfully make any false statement in order to obtain a permit shall be guilty of a misdemeanor and subject to the penalty provided herein. Venting systems and exhaust ducts shall not extend into or through ducts or plenums. Environmental air ducts as defined in Section 502 may extend through a free air return plenum provided the environmental air duct is air tight and sealed with approval of the Building Official or his designee. Unsleeved gas piping shall not extend into or through any air duct or plenum nor shall unsleeved gas piping be installed in any wall cavity that is part of any return air plenum. Sleeved piping shall be of a material approved by the Building Official. 504.3.1 Moisture Exhaust Ducts is amended by adding the following sentence to the end of the paragraph. Add the following to the end of Section 507.1 Alternative Means of Compliance for Type 1 Hoods. Type I hoods may be constructed and installed in compliance with the currently adopted edition of the National Fire Code Standard NFPA -96, Standard for the Installation of Equipment for the Removal of Smoke and Grease -Laden Vapors from Commercial Cooking Equipment, as published by the National Fire Protection Association, Inc., in addition to the requirements of this chapter. The provisions of this chapter may be applied to the design of Type I Hoods on requirements not covered by the NFPA 96; provided, however, the requirements of NFPA 96 shall govern should there be different or conflicting requirements. All other types of hoods regulated by this chapter shall comply with this chapter. 608.0 Use of Under -Floor Space as a Supply Air Plenum is amended by adding the following section: 608.14 On existing structures the use of under -floor space as a supply plenum will be, subject to the Approval of the Building Official or his designee, on a case by case basis. If the space is allowed to be used and has sewer or gas piping located in the space, a pressure test of the gas system and a check of the sewer system will be required. 802.3.3 Design and Construction is hereby amended to add the following sentence at the end of the section. Vents shall be secured to a metal angle brace, or to a metal plate installed at the roof decking to prevent movement of the vent during installation or removal of the roof covering. 924.1 Unvented is amended by adding the following exceptions: Exceptions: 1) Unvented gas burning room heaters equipped with an Integral Oxygen Depletion Sensing System (ODS) may be installed in a Residential Occupancy if the unit is Certified by an approved scientific testing laboratory and is installed in accordance with ANSI Z21.11 2. 2) Existing gas burning unvented room heater(s) installed in Residential Occupancies which do not comply with code requirements shall be removed or replaced with vented or other approved heaters when alterations or remodeling of the structure occur which would require a building permit, or when a city pressure test is required on the fuel piping system. Additionally all gas outlets for room heaters in bathrooms and bedrooms shall be capped. 3) Homeowners that are living in their homestead are exempted from the requirement of removing the non- approved heaters when a city pressure test of the fuel gas piping system is performed. However, the requirements to replace unvented heaters shall be enforced when a building permit is required. Chapter 13, Fuel Gas Piping is hereby deleted.
