STAFF MEMBERS PRESENT: Robert Zapata, City Inspector, Judy Rasher, Community Service Secretary. GUEST PRESENT: Patricia Alvarez, Peter Garcia Mark Hardin called the meeting to order at 6:00 P. M. FIRST ITEM ON THE AGENDA: Approval of August 22, 2016 minutes. Kevin Carter made a motion to approve minutes as presented. David Murphree seconded the motion. Motion carried unanimously. SECOND ITEM ON THE AGENDA: BA Case # 1683: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. Property Owner: Patricia Alvarez Address: 2613 W 20th Legal Description: Block 8 E 63' -13 W2 —14 of the Edgemere Addition Zoning: R1 Homeowner, Patricia Alvarez is wanting to install a 12 x 20 carport in front of her home, located at 2613 W 20th Street. In surveying the surrounding area, staff observed several carports on the same street. As per code Section 37.2.2(h), there is no other practical location on the property for him to install the carport. 19 Letters were sent out to the neighbors. Received 5 letters in favor of the carport and one letter opposed. Homeowner who opposed the carport stated that it would be too close to the street and would block his vision from the street. Homeowner also stated that it would decrease the property value of his home. Homeowner has complied with the set back from the front and side of her property lines. David Murphree made a motion to approve the variance based on the request. Kevin Carter seconded and the motion was carried unanimously. Property Owner: Robert Pequeno Address: 904 Nassau Legal Description: Block 12 Lot 9 S/2 —10 of the College Hill Addition Zoning: R2 Homeowner, Robert Pequeno is wanting to install a 12 x 20 carport in front of his home, located at 904 Nassau. The carport will be constructed on the right side of the home. Part of the carport will be on the side of the home, with 5 to 6 feet in front of the home. In surveying the surrounding area, staff observed 2 carports in the area. 15 Letters were sent out to the neighbors. Received 4 letters in favor of the carport. Mr. Pequeno has complied with the set back from the front and side of the property lines. Kevin Carter made a motion to approve the variance based on the request. Joe Frank Rodriguez seconded and the motion was carried unanimously. FOURTH ITEM ON THE AGENDA: BA Case # 1685: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. Property Owner: Artemia Garcia Address: 629 Cedar Legal Description: Block 12 Lot 1 of the OT Addition Zoning: R2 Homeowner, Artemia Garcia is wanting to install a 18 x 20 carport. Homeowner is wanting to construct a carport one foot from the property line, instead of the 3 feet requirement from the property line. In surveying the surrounding area, staff observed 2 carports in the area. As per code Section 37.2.2(h), there is no other practical location on the property to install the carport. 15 Letters were set out to the neighbors. Received 3 letters in favor of the carport. Code requirement for side setback is 3 feet minimum. The staff makes the recommendation that homeowner build the carport 3 feet from the property line and a concrete slab be installed prior to building the carport. Kevin Carter made a motion to approve the variance based on the request by staff member, Robert Zapata, that the homeowner build the carport 3 feet from the property line and a concrete slab be installed prior to building the carport. Property Owner: Ignacio Mijares Address: 312 S E 7th Legal Description: Block 2 Lot 1 of the Curtis Addition Zoning: R2 Homeowner, Ignacio Mijares is wanting to install a 20 x 24 carport. In surveying the surrounding area, staff observed 4 carports on the same street. As per code Section 37.2.2(h), there is no other practical location on the property to install the carport. 18 Letters were set out to the neighbors. Received 1 letter in favor of the carport. Mr. Mijars has complied with the set back from the front and side of the property lines. David Murphree made a motion to approve the variance based on the request.
