HomeMy WebLinkAbout01-3278FIRE CODE ORDINANCE NO. 01-3278 AN ORDINANCE AMENDING THE CITY OF PLAINVIEW CODE OF ORDINANCES, CHAPTER 11, FIRE PROTECTION AND PREVENTION; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABLITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, the City Council of the City of Plainview has reviewed Chapter 11 of the City of Plainview Code of Ordinances, Fire Protection and Prevention; and WHEREAS, for the health, safety and welfare of the citizens of Plainview, the City Council desires to amend the provisions of Chapter 11, Sections 11-5, 11-6, 11-9, 11-10(e), 11- 21, 11-22, 11-26, 11-27, and 11-52, in the Fire Protection and Prevention Chapter of the City of Plainview Code of Ordinances; and WHEREAS, the City Council has deemed it would be in the best public interest to amend the Ordinance as described below in the manner hereinafter set forth in the body of this Ordinance; NOW, THEREFORE, THE CITY OF PLAINVIEW HEREBY ORDAINS, that the following section of the Plainview Code of Ordinances be amended as follows: Section I. Section 11-5. Uses of fire plugs. Shall be deleted in its entirety. Section 11-6. Fire Chief. Shall be amended to read as follows: The office of Fire Chief is hereby created and established for the City. The Fire Chief shall be the chief of the fire department of the City. The fire department of the City shall be under his/her supervision and all members of the department shall be subject to the orders and supervision of the Fire Chief. Section 11-9. Fire Chief. Shall be amended to read as follows: The City of Plainview Fire Chief is hereby designated, pursuant to State law, to be a non-civil service position. Section 11-10(e). Shall be amended to read as follows: The owner, manager or person in charge of any building to which fire lanes or turn-arounds have been designated by the fire marshal or his/her designated representative shall post and maintain Ordinance No. 01-3278 Fire Code, CNlpter 11 Page 1 of 3 Fire Protection & Prevention appropriate signs in conspicuous places along such fire lanes or turn-arounds stating "No Parking- Fire Lane" and one designating "Tow Away Zone." The fire marshal or his/her duly authorized representative or the chief of police or his/her authOrized representative is hereby authorized to cause such streets, fire lanes, and turn-arounds to be maintenance free and unobstructed at all times for fire department uses. "Appropriate signs" required in these sections shall consist of white letters painted on a red background located along one side of the fire lane easement at twenty-five (25) foot intervals or as the fire marshal or his/her designated representative may determine. Those letters shall not be less than three (3) inches in height as to "No Parking", not less than two (2) inches in height as to "Fire Lane," and not less than one (1) inch in height as to "Tow Away Zone." A solid red stripe shall be placed along one side of the fire lane easement. In certain cases, it may be deemed necessary by the authority having jurisdiction to have both the inside and outside perimeter of the fire lane marked. In such cases the inside and outside perimeter markings shall be separated by at least twenty (20) feet. The inside / outside perimeter marking shall be a six (6) inch wide solid red stripe with white lettering as to "No Parking- Fire Lane." This lettering shall be placed every twenty-five (25) feet. Ifa fire lane is to be marked on a curb, the entire curb is to be marked. Section 11-21. Duties assigned to assistant chief._ Shall be deleted in its entirety. Section 11-22. Chief of bureau of fire prevention. Shall be amended to read as follows: For the purposes of the Fire Code, the fire marshal shall be and is hereby made the chief in charge of the bureau of fire prevention. Wherever the fire code herein adopted refers to the chief in charge of the bureau of fire prevention, the same shall refer to and mean the fire marshal who shall be one and the same person as the chief in charge of the bureau of fire prevention, and he/she is hereby charged with the duties and responsibilities of the chief in charge of the bureau of fire prevention as prescribed by the fire code. Section 11-26. Inspectors. Shall be deleted in its entirety. Section 11-27. Annual report. Shall be amended to read as follows: A report representing the bureau of fire prevention, the fire department, and the emergency medical services, shall be made annually and transmitted to the mayor and city council. Such report shall contain all proceedings under this chapter. Section 11-52. Amendment. Shall be amended to read as follows: 2.303(b) Part I, Article 2, Division III, Section 2.303(b) of the Uniform Code, 1997 Edition, shall be and the same is hereby amended by addition to the list of recognized Standards as part of the list, of the 2000 Edition of the "Life Safety Code," N.F.P.A. 101, Copyrighted 2000 as amended. Section H. Should any section or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, sub-section, provision, clause, phase, or word severable therefrom, and the same shall be deemed severable for this purpose. Section IH. Provisions of this Ordinance are cumulative and nothing hereby shall prevent, alter, or diminish the applicability, or enforcement or other Ordinances restricting, regulating or governing the subject matter herein. Section IV. All Ordinances or portions of any Ordinance of the City of Plainview, Texas, in conflict herein, are hereby amended to conform with the provisions hereof. Section V. This Ordinance shall be of full force and effect upon its passage and publication as required by law. Passed and approved this the 27th day of February, 2001.
