HomeMy WebLinkAbout17-3646 ord140 ORDINANCE NO. 17-3646 AN ORDINANCE OF THE CITY COUNCIL FOR CITY OF PLAINVIEW AMENDING CHAPTER 3, ARTICLE 3.03, DIVISION 2, INTERNATIONAL BUILDING CODE, OF THE CITY OF PLAINVIEW CODE OF ORDINANCES; TO ADOPT THE INTERNATIONAL BUILDING CODE (2015 EDITION); REPEALER; CUMULATIVENESS CLAUSE; SEVERABILITY CLAUSE, CONFLICTS CLAUSE; AND EFFECTIVE DATE. WHEREAS, Chapter 3, Building Regulations, of the Plainview Code of Ordinances sets forth the minimum standards for building construction; and WHEREAS, from time to time it is advisable to review the ordinances that regulate construction of all buildings within the City of Plainview; and WHEREAS, the City of Plainview's Building Trades and Fire Code Board of Appeals has reviewed staff recommendations on adoption of the International Building Code, 2015 Edition, for updating building regulations within the City; and WHEREAS, the International Building Code, 2015 Edition, with proposed amendments as hereinafter made, has been duly presented to the City Council; and WHEREAS, the City Council of the City of Plainview finds that it would not be detrimental or injurious to the public health, safety or general welfare of the citizens of the City of Plainview. NOW, THEREFORE, The City of Plainview hereby ordains that: SECTION 1 Article 3.03, Buildings, of the Plainview Code of Ordinances is hereby amended as follows: Division 2. International Building Code Sec. 3.03.031 Adopted (a) The 200g 2015 International Building Code, written by the International Code Council, Inc., as hereinafter amended, is specifically adopted as part of the building code of the city. The same is incorporated herein by reference as if fully set forth at length. Ord. 17-3646 2015 International Building Code 141 Sec. 3.03.032 Amendments ( Amendments to the 2009 2015 International Building Code, which incorporates the Appendixes, are as follows: Section 101.4.1. Submittal documents consisting of construction documents, statement of special inspections, geotechnical report and other data shall be submitted in two or more sets with each permit application. The construction documents shall be prepared by a registered design professional and shall contain the seal of a Texas - licensed engineer or a Texas -licensed architect. The registered design professional who prepares construction documents shall have full responsibility for complying with Texas Occupations Code, Chapter 1001 (Engineers) or Chapter 1051 (Architects), as applicable, and shall affix design professional official seal to said drawings, specifications and accompanying data. Where special conditions exist, the building official is authorized to require additional construction documents to be prepared by a registered design professional. Exception: The building official is authorized to waive the submission of construction documents and other data net required to be prepared by a registered design professional if it is found that the nature of the work applied for is such that review of the construction documents, prepared by a registered design professional, is not necessary to obtain compliance with this code. Section 109.3 Building Permit Valuations. The applicant for a permit shall provide an estimated permit value at time of application. Permit valuations shall include total value of Ord. 17-3646 2015 International Building Code 142 work, including materials and labor, for which the permit is being issued, such as electrical, pas, mechanical, plumbing equipment and permanent systems. If, in the opinion of the building official, the valuation is underestimated on the application, the permit shall be denied, unless the applicant can show detailed estimates to meet the approval of the building official. If the applicant fails to present sufficient documentation to support the valuation on the application, final building permit valuation shall be set by the building official in accordance with the most current Building Valuation Data as published by the International Code Council or approved statements sufficient to clearly document all construction costs. of appeals. Amend T4e1421€1s and Fire Code Board of Appeals_ Ordinances. Section 113.1 General. In order to hear and decide appeals of orders, decisions or determinations made by the building official relative to the application and interpretation of this Code, there shall be and is hereby created a board of appeals: City of Plainview Building Trades and Fire Code Board of Appeals; see Article 3.02 of the City of Plainview Code of Ordinances. Section 113.2 Limitations on authority. Delete in entirety. Section 113.3 Qualifications. Delete in entirety. 903.2.8 Group R. An automatic sprinkler system installed in accordance with section 903.3 shall be provided throughout all buildings with a group R fire area. Detached one - and two-family dwellings not more than three stories above grade plane in height with a separate means of egress, and their accessory structures not more than three stories in above grade plane in height, shall be exempt from this requirement. (b) Nothing in this article or the adopted fire code shall prohibit the installation of a fire suppression system if the owner of a detached one -or two-family dwelling not more than three stories above grade plane in height with a separate means of egress, and their accessory structures not more than three stories in above grade plane in height desires to have one installed, so long as the system is installed according to applicable NFPA standards Section 1101.2 Design. Buildings and facilities shall be designed and constructed to be accessible in accordance with this code and ICC A117.1. Exception: Elements regulated under the Texas Department of Licensing and Regulation (TDLR) and built in accordance with TDLR approved plans, including any variances or waivers granted by the TDLR, shall be deemed to be in compliance with the requirements of this Chapter. Ord. 17-3646 2015 International Building Code 143 Section 1101.3 Permits and inspections. Plans of the proposed installations and alterations shall be submitted, permits shall be obtained for the proposed work, the work shall be inspected. and the work shall be completed in accordance with the International Building Code as adopted. Section 1101.4 Responsibility to comply with federal and state laws. Compliance with federal and state laws addressing accessibility for persons with disabilities shall be the responsibility of the building designer. builder, and owner. The city's approval of either plans or installations will not relieve a person from the obligation to comply with either federal or state laws. Section 1507.8.1 Deck requirements. Wood shingles shall be used only on solid sheathing. Section 1507.9.1 Deck requirements. Wood shakes shall be used only on solid sheathing. Section 1507.9.6 Material standards. Wood shakes shall comply with the requirements of Table 1507.9.6. Materials and methods of application used for recovering or replacing an existing roof covering shall comply with the requirements of Chapter 15, Roof Assemblies and Rooftop Structures, including but not limited to decking, flashing, and ventilations. Section 1511.3.1.1 Exceptions. A roof recover shall not be permitted where any of the following conditions occur: Ord. 17-3646 2015 International Building Code 144 1. Where the existing roof or roof covering is water -soaked or has deteriorated to the point that the existing roof or roof covering is not adequate as a base for additional roofing. 2. Where the existing roof covering is wood shake, slate, clay, cement or asbestos -cement tile. 3. Where the existing roof has two or more applications of anv type of roof covering. 4. For asphalt shingles. Flood Prevention. Section 1612.3 Establishment of Flood Hazard Areas. To establish flood hazard areas, the applicable governing authority shall adopt a flood hazard map and supporting data. The flood hazard map shall include, at a minimum, areas of special flood hazard as identified by the Federal Emergency Management Agency in an engineering report entitled "The Flood Insurance Study for the City of Plainview" (Flood Prevention in City of Plainview Code of Ordinances at Article 3.13), dated February 18, 2011, as amended or revised, with the accompanying Flood Insurance Rate Map (FIRM) and Flood Boundary and Floodwav Map (FBFM) and related supporting data along with anv revisions thereto. The adopted flood hazard map and supporting data are hereby adopted by reference and declared to be part of this section. Section 1612.5. Flood hazard documentation. The following documentation shall be prepared and sealed by a registered design professional and submitted to the building official. 1. For construction in flood hazard areas other than high hazard areas or coastal A zones: '1.1. The elevation of the lowest floor, including the basement, as required by the lowest floor elevation inspection in Section 110.3.3. Ord. 17-3646 2015 International Building Code 145 1.2. For fully enclosed areas below the design flood elevation where provisions to allow for the automatic entry and exit of floodwaters do not meet the minimum requirements in Section 2.6.2.1 of ASCE 24, construction documents shall include a statement that the design will provide for equalization of hydrostatic flood forces in accordance with Section 2.6.2.2 of ASCE 24. 1.3. For dry floodproofed nonresidential buildings, construction documents shall include a statement that the dry floodproofinq is designed in accordance with ASCE 24. 1.4. All structures constructed within a Special Flood Hazard area as designated by the City of Plainview Code of Ordinances at Article 3.13 shall be provided with a foundation system designed by a registered professional engineer or registered architect. Section J103. Permits Required. Delete this section in its entirety. Section J104. Permit Application and Submittals. Delete this section in its entirety. Section J107.5. Compaction. All fill material shall be compacted to GO a minimum 95 percent of maximum density and shall be within 2% of optimum moisture content as determined by ASTM D 698,Standard Proctor, in lifts not exceeding 12 inches (305 mm) in depth. Section K101.0 Title. These regulations shall be known as the Electrical Code - Administrative Provisions of City of Plainview and shall be cited as such and will be referred to herein as "this code." Section K103.2 Work Exempt from permit. The following work shall be exempt from the requirement for a permit: 1. Listed cord and plug -connected temporary decorative lighting. 2. Reinstallation of attachment plug receptacles, but not the outlets therefore. 3. Replacement of branch circuit overcurrent devices of the required capacity in the same location. 4. Temporary wiring for experimental purposes in suitable experimental laboratories. 5. Electrical wiring, devices, appliances, apparatus or equipment operating at Tess than 25 volts and not capable of supplying more than 50 watts of energy. 6. Minor repair work, including the replacement of lamps or the connection of approved portable electrical equipment to approved permanently installed receptacles. Portable heating, cooking or clothes drying appliances. Replacement of any minor part that does not alter approval of equipment or make such equipment unsafe. Ord. 17-3646 2015 International Building Code 146 Exemptions from the permit requirements of this Code shall not be deemed to grant authorization for work to be done in violation of the provisions of this Code or other laws or ordinances of the City of Plainview. Section K111.1 Adoption. Electrical systems and equipment shall be designed, constructed and installed in accordance with the NFPA 70 as applicable, except as otherwise provided in this Code. No person shall erect, construct, enlarge, alter, repair. remove, improve, convert or demolish any roof or roof structure for which a permit is required within the corporate limits of the City of Plainview until such person has registered with the City and has made, executed and delivered to the Building Official a Permit Surety Bond and a Certificate of Insurance in accordance with the following: (a) Permit Surety Bond: 1. Contractors are required to obtain a good and sufficient corporate surety bond or Permit Surety Bond, in the amount shown in Table 3.03.033 payable to the City for the use and benefit of either the City or the property owner for damages as a result of any act or neglect of the principal or his agents or employees; or by reasons of failure to repair any defective work, material or installation; or for failure to pay any fees or other charges due the City; or for failure to remedy any defects or faulty workmanship or material within the time prescribed by the Building Official for the completion of such remedial work, without Ord. 17-3646 2015 International Building Code 147 additional cost to the person for whom the work was done; and guaranteeinq compliance with the requirements of the applicable construction codes of all work installed by the principal, his agents or employees. 2. Claim upon such bond may be filed by either any person damaged by reason of the principal's failure to perform his obligations under the bond, or the City for violation of applicable construction codes. 3. Suspension or revocation of the registration of the principal shall not by itself affect the liability of either the principal or the surety on such bond. (b) Certificate of Insurance: 1. Contractors are required to maintain liability insurance and shall provide a Certificate of Insurance showing the levels of liability insurance coverage in accordance with Table 3.03.033. A homeowner for which a homestead exemption has been given for his/her property intended for the permit and said homeowner is acting as his/her own roofing contractor. SECTION II All ordinances or parts of ordinances inconsistent with any provisions of this ordinance are hereby repealed to the extent of such conflict, and the provisions of this ordinance shall be and remain controlling as to the matters regulated herein. SECTION III Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating, or governing the subject matter herein. Ord. 17-3646 2015 International Building Code 148 SECTION IV Severability is intended throughout and within this Ordinance. If any provision, including any section, paragraph, sentence, clause, phrase or word or the application thereof to any person or circumstance is held invalid, unconstitutional, or unenforceable by a court of law or administrative agency with jurisdiction over the matter, such action shall not be construed to affect any other valid portion of this Ordinance. A constitutional construction hereof is intended and shall be given. There is not intent herein to violate either of the Texas Constitution or the Constitution of the United States. SECTION V All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION VI This Ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED on first reading this 10th day of January, 2017.
