HomeMy WebLinkAbout17-3648 ord156 ORDINANCE NO. 17-3648 AN ORDINANCE OF THE CITY COUNCIL FOR THE CITY OF PLAINVIEW, TEXAS AMENDING CHAPTER 3, ARTICLE 3.03, DIVISION 4, ENERGY CONSERVATION CODE AND DIVISION 5, EXISTING BUILDING CODE, OF THE CITY OF PLAINVIEW CODE OF ORDINANCES; TO ADOPT THE INTERNATIONAL ENERGY CONSERVATION CODE (2015 EDITION) AND THE INTERNATIONAL EXISTING BUILDING CODE (2015 EDITION); REPEALER; CUMULATIVENESS CLAUSE; SEVERABILITY CLAUSE; CONFLICTS CLAUSE, AND EFFECTIVE DATE. WHEREAS, Chapter 3, Building Regulations, of the Plainview Code of Ordinances set forth the minimum standards for building construction; and WHEREAS, from time to time it is advisable to review the ordinances that regulate construction of all buildings within the City of Plainview; and WHEREAS, the City of Plainview's Building Trades and Fire Code Board of Appeals has reviewed staff recommendations on adoption of the 2015 Intemational Energy Conservation Code and the 2015 Existing Building Code, for updating building regulations within the City; and WHEREAS, the 2015 International Energy Conservation Code and the 2015 International Existing Building Code with proposed amendments as hereinafter made, have been duly presented to the City Council; and WHEREAS, the City Council finds that it would be in the best interest of their citizens to adopt such ordinances as hereinafter stated, and that not doing so could be detrimental or injurious to the public health, safety or general welfare of the citizens of the City of Plainview: NOW, THEREFORE, The City of Plainview hereby ordains that: SECTION I Article 3.03, Buildings, of the Plainview Code of Ordinances is hereby amended as follows: Division 4. International Energy Conservation Code Sec. 3.03.091 Adopted (a) The 2000 2015 Intemational Energy Conservation Code, as written by the International Code Council, Inc., as hereinafter amended, is specifically adopted as part Ord. 17-3648 2015 Energy Conservation and Existing Building Code Page 1 of 5 of the building code of the city. The same is incorporated herein by reference as if fully set forth at length. Sec. 3.03.092 Amendments The 2000 2015 Intemational Energy Conservation Code is hereby amended as follows: Section C101.1. Title. Insert "City of Plainview." Section C109.2 Delete in entirety. Section C109.3 Delete in entirety. Division 5. International Existing Building Code Sec. 3.03.121 Adopted (a) The 2009 2015 International Existing Building Code, as written by the International Code Council, Inc., as hereinafter amended, is specifically adopted as part of the building code of the city. The same is incorporated herein by reference as if fully set forth at length. Sec. 3.03.122 Amendments The 2404 2015 Intemational Existing Building Code is hereby amended as follows: Section 112.2 Delete in Entirety. Section 112.3 Delete in Entirety. Section 706.1 General. Amend to read: Materials and methods of application used for recovering or replacing an existing roof covering shall comply with the requirements of Chapter 15 of the 2015 International Building Code (IBC), including but not limited to decking, flashing, and ventilation. Exceptions: 1. Reroofing shall not be required to meet the minimum design slope requirement of one-quarter unit vertical in 12 units horizontal (2 -percent slope) in Section 1507 of the 2015 International Building Code for roofs that provide positive drainage. 2. Recovering or replacing an existing roof covering shall not be required to meet the requirement for secondary (emergency overflow) drains or scuppers in Section 1503.4 of the 2015 International Building Code (IBC) for roofs that provide for positive drainage. For the purposes of this exception, existing secondary drainage or scupper systems required in accordance with the IBC shall not be removed unless they are replaced by secondary drains or scupper designed and installed in accordance with Section 1503.4 of the IBC. Amend to read: New roof coverings shall not be installed without first removing all existing layers of roof coverings down to the roof deck where any of the following conditions occur: 1. Where the existing roof or roof covering is water -soaked or has deteriorated to the point that the existing roof or roof covering is not adequate as a base for additional roofing. 2. Where the existing roof covering is wood shake, slate, clay, cement or asbestos -cement tile. 3. Where the existing roof has two or more applications of any type of roof covering. 4. For asphalt shingles. Section 1401.2 Applicability. Insert: 1957. Appendix B — Supplementary Accessibility Requirements for Existing Buildings and Facilities. Appendix B was added to address accessibility in construction for items that are not typically enforceable through the traditional building code enforcement process. Chapter 11 of the International Building Code (IBC) contains provisions that set forth requirements for accessibility to buildings and their associated sites and facilities for people with physical disabilities. Sections 410, 605, 705, 806, 906, 1006, 1012.1.4, 1012.8, 1105, 1204.1, 1205.15, 1401.2.5, and 1508 in the code address accessibility provisions and alternatives permitted in existing buildings. Section B101.1 General. Modify as follows:: Exception: Buildings regulated under the Texas Department of Licensing and Regulation (TDLR) and built in accordance with TDLR approved plans, including any variances or waivers granted by the TDLR, shall be deemed to be in compliance with the requirements of this Chapter. Section B102.1 General. Modify as follows: Exception: Buildings regulated under the Texas Department of Licensing and Regulation (TDLR) and built in accordance with TDLR approved plans, including any variances or waivers granted by the TDLR shall be deemed to be in compliance with the requirements of this Chapter. SECTION II All ordinances or parts of ordinances inconsistent with any provisions of this ordinance are hereby repealed to the extent of such conflict, and the provisions of this ordinance shall be and remain controlling as to the matters regulated herein. Ord. 17-3648 ;t, 2015 Energy Conservation and Existing Building Code Page 3 of 5 SECTION III Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating, or governing the subject matter herein. SECTION IV Severability is intended throughout and within this Ordinance. If any provision, including any section, paragraph, sentence, clause, phrase or word or the application thereof to any person or circumstance is held invalid, unconstitutional, or unenforceable by a court of law or administrative agency with jurisdiction over the matter, such action shall not be construed to affect any other valid portion of this Ordinance. A constitutional construction hereof is intended and shall be given. There is not intent herein to violate either of the Texas Constitution or the Constitution of the United States. SECTION V All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. SECTION VI This Ordinance shall be of full force and effect upon its passage and publication as required by law. PASSED AND APPROVED on first reading this 14th day of February, 2017.
