AN ORDINANCE OF THE CITY COUNCIL FOR THE CITY OF PLAINVIEW
AMENDING CHAPTER 3, ARTICLE 3.04, DIVISION 6, NATIONAL
ELECTRICAL CODE AND ARTICLE 3.05, DIVISIONS 5 AND 6,
INTERNATIONAL PLUMBING CODE, OF THE CITY OF PLAINVIEW
CODE OF ORDINANCES; TO ADOPT THE NATIONAL ELECTRICAL
CODE (2014 EDITION) AND THE INTERNATIONAL PLUMBING CODE
(2015 EDITION); REPEALER; CUMULATIVENESS CLAUSE;
SEVERABILITY CLAUSE; CONFLICTS CLAUSE, AND EFFECTIVE
DATE.
WHEREAS, Chapter 3, Building Regulations, of the Plainview Code of Ordinances
set forth the minimum standards for building construction; and
WHEREAS, from time to time it is advisable to review the ordinances that regulate
construction of all buildings within the City of Plainview; and
WHEREAS, the City of Plainview's Building Trades and Fire Code Board of
Appeals has reviewed staff recommendations on adoption of the National Electrical Code
(2014 Edition) and the International Plumbing Code (2015 Edition), for updating building
regulations within the City; and
WHEREAS, the 2014 National Electrical Code and the 2015 International
Plumbing Code, with proposed amendments as hereinafter made, have been duly
presented to the City Council; and
WHEREAS, the City Council finds that it would be in the best interest of their
citizens to adopt such ordinance as hereinafter stated, and that not doing so could be
detrimental or injurious to the public health, safety or general welfare of the citizens of the
City of Plainview:
NOW, THEREFORE, The City of Plainview hereby ordains that:
SECTION I
ARTICLE 3.04, Electricity, of the Plainview Code of Ordinances is hereby amended as
follows:
Division 6. Electrical Code and Installation Regulations
Sec. 3.04.161 Electrical code adopted
Ail installation hereafter installed within the corporate limits of the city shall be done
in first class workmanlike manner in accordance with the 2008 2014 edition of the
National Electrical Code, as adopted by the National Fire Protection Association,

and said National Electrical Code is made a part of this article, with the additions
and deviations therefrom contained in this code.
SECTION 11
ARTICLE 3.05, Plumbing, of the Plainview Code of Ordinances is hereby amended
as follows:
Division 5. Plumbing Code and General Regulations
Sec. 3.05.121 Plumbing code adopted
All installation hereinafter installed within the corporate limits of the city shall
be done in a first class workmanlike manner in accordance with the 2000 2015
edition of the International Plumbing Code as adopted by the International
Code Council, and said lntemational Plumbing Code and incorporated
references and appendixes is made of part of this article, with the additions
and deviations therefrom contained in this code.
Sec. 3.05.122 Conformance with plumbing code
All plumbing systems hereafter installed shall conform with the provisions of the 2009
2015 edition of the International Plumbing Code, as amended.
Sec. 3.05.123 Amendments
Amendments to the 2009 2015 International Plumbing Code shall be as follows:
Section 106.6.3 Fee refunds. Insert "zero (0)" percent at Section 106.6.3.2 and "fifty (50)"
percent at Section 106.6.3.3.
Section 108.4 (d). Enforcement. Delete "the electrical inspector."
Section 108.5. Stop work orders. Upon notice from the code official, work on any
plumbing system that is being done contrary to the provisions of this code or in a
dangerous or unsafe manner shall immediately cease. Such notice shall be in writing
and shall be given to the owner of the property, or to the owner's agent, or to the person
doing the work. The notice shall state the conditions under which work is authorized to
resume. Where an emergency exists, the code official shall not be required to give a
written notice prior to stopping the work. Any person who shall continue any work in or
about the structure after having been served with a stop work order, except such work as
that person is directed to perform to remove a violation or unsafe condition, shall be liable
for a fine as specified in Section 1.01.009 of the City of Plainview Code of Ordinances.

Ordinances.
SECTION 109. MEANS OF APPEAL. Delete this section in its entirety and replace with
the following wording: In order to hear and decide appeals of orders, decisions or
determinations made by the Buildinc_Official relative to the application and interpretation
of this code, an appeal must be filed with the Building Trades and Fire Code Board of
Appeals in accordance with Article 3.02 in the City of Plainview Code of Ordinances.
Section 305.4.1 Sewer depth. Building sewers shall be a minimum of 12 inches (305
mm) below grade.
Section 312.2. Drainage and vent water test. A water test shall be applied to the drainage
system either in its entirety or in sections. If applied to the entire system, all openings in
the piping shall be tightly closed, except the highest opening, and the system shall be
filled with water to the point of overflow. If the system is tested in sections, each opening
shall be tightly plugged except the highest openings of the section under test, and each
section shall be filled with water, but no section shall be tested with less than a 5 foot
(1524 mm) head of water. In testing successive sections, a lowest opening head test at
each floor level if multiple floors shall be tested at the plumbing rough -in inspection . This
test shall be held for not less than 15 minutes.
Section 312.10.1 Inspections. Annual inspections shall be made of all backflow
prevention assemblies and air gaps to determine whether they are operable. In the
absence of local provisions, the owner is responsible to ensure that testing is performed.
Section 312.10.2 Testing. Reduced pressure principle backflow preventer assemblies,
double check -valve assemblies, pressure vacuum breaker assemblies, reduced pressure
detector fire protection backflow prevention assemblies, double check detector fire
protection backflow prevention assemblies, hose connection backflow preventers, and
spill -proof vacuum breakers shall be tested at the time of installation, immediately after
repairs or relocation and at least annually. The testing procedure shall be performed in
accordance with applicable local provisions. In the absence of local provisions, the owner
is responsible to ensure that testing is done in accordance with one of the following
standards: ASSE 5013, ASSE 5015, ASSE 5020, ASSE 5047, ASSE 5048, ASSE 5052,
ASSE 5056, CSA B64.10 or CSA B64.10.1 or CSA B64.10.1.

Section 702.1 Above- ground sanitary drainage and vent pipe. Above -ground soil, waste
and vent pipe shall conform to one of the standards listed in Table 702.1.

Section 903.1 Roof extension. All open vent pipes that extend through a roof shall
be terminated at least 12 inches (305 mm) above the roof, except that where a roof
is to be used for any purpose other than weather protection, the vent extensions
shall be run at least 7 feet (2134 mm) above the roof.
Division 6. Materials
Sec.3.05.141 Minimum standards
The materials used shall conform with the standards set forth in the 2003 2015 edition
of the Uniform International Plumbing Code, unless amended in this article.
Sec. 3.05.142 Materials not listed
Materials other than those listed in the 2003 2015 Uniform International Plumbing Code
may be permitted upon approval of the building trades and fire code board of appeals.

SECTION III
All ordinances or parts of ordinances inconsistent with any provisions of this
ordinance are hereby repealed to the extent of such conflict, and the provisions of this
ordinance shall be and remain controlling as to the matters regulated herein.
SECTION IV
Provisions of this Ordinance are cumulative and nothing herein shall prevent, alter,
or diminish the applicability or enforcement of other ordinances restricting, regulating, or
governing the subject matter herein.
SECTION V
Severability is intended throughout and within this Ordinance. If any provision,
including any section, paragraph, sentence, clause, phrase or word or the application
thereof to any person or circumstance is held invalid, unconstitutional, or unenforceable by
a court of law or administrative agency with jurisdiction over the matter, such action shall not
be construed to affect any other valid portion of this Ordinance. A constitutional construction
hereof is intended and shall be given. There is not intent herein to violate either of the Texas
Constitution or the Constitution of the United States.
SECTION VI
All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict
herewith, are hereby amended to conform with the provisions hereof.
SECTION VII
This ordinance shall be of full force and effect upon its passage and publication as
required by law.
