Alderman Osborne introduced.and moved the adoption of the following o~d~ihan~e :~ Ordinance No. 480 AN 0RDINANGE CLOSING T~ ALLEY LYING ~DiATELY EAST OF LOT~'N0. BLOCK NO. 2, OF ~i~ A. Lo MAUPIN ADDITION TO TP~E TOV~ OF PLAINVIEW, HA~-~ COUNTY, TEXAS. Whereas, at the regular session of the City Council of the City of Plainview, Texas, a petition was presented to the Council by The Panhandle Compress & Warehouse ~ompany, ~or an order from this Coun~ cil closing the alley lying ~immediately east of Lot No. 8, in Block No. 2, of the A. L. ~aupin Addition to the town of Plainview, Hale County, Texas; said alley being 12 feet in width and 198 feet in length and lying between the a£oreaaid ~lock and the tract designated on the map of the tov~, as the ~.A.Bilb~y~tract; and it appearing to the Coun~ cil that the Petitioner is the owner of the property in said blocks, as well as the propeDy lying south tEer~of, and that there are no other parties interested in said alley or in the ~roperty adjacent thereto; that the said alley was dedicated by A. L. Maupin, et. al. in the dedi- cation of the said addition to the tov~ of Plainview, as shown by deed recorded in Volume 36, page 170 of the Deed Records of Hale County, TeEs; that the said alley has never been in use by the public and is not of any benefit or value to the public and has mot been acquitted or used by pre- scription and for such reason should be clOsed; T~REFOR~, BE IT 0RDAI~D BY THE CiTY CO%~C!L OF T~E CITY OF PLAINVIEW, TEXAS, That the aforesaid alley 12 feet in width and 198 feet in l~th ex~ tending hg~th ~d south along the east line of Lot No. 8 in Bloc~'2 of the A. L. ~ga'u~in Addition to the town of Flainview, Texas, and between said lot and the property knov~ as the W)mA.Bilbry tract and extending south to ~the right-of~way of the ~ort Worth and Denver City Railway Company, be and the same is hereby closed and that from henceforth the city and the public shall have no right of use or occupancy along, over and across the said alley way. The fact that the Petitioner is preparing to construct permanent and 279 valuable improvements on its said property and that the public ~ener- ally has no inter~st in suc~ a!l~ey~.aslde~gnated~.andtterm~dc:a ~dead- end'~ alley, creates an emergency and an imperative public necessity requi~ing the sespension of the rule that ordinances shall be read at ~hreie meetings of the City Council.
