HomeMy WebLinkAbout504 ResolutionPlainview, Texas, April 16, 1945. The City Council met in regular meeting with the following mem- bers present. Mayor, J.N.JOrdan. Aldermen: E.M.Osborne, L.M.Frogge, Ben F.Smith, W.C.Nalone and C,H.Hancock. City tax Collector P.H.Bryan, City Health Officer Dr. E.C.Nicholl and City Attorney Frank R.Day, at- tended the meeting. Minutes of the last regular meeting also, minutes of the called meeting held on April, 9th, read and adopted. Notion by Alderman Osborne, seconded by Alderman Frogge, that the following ordinance be passed and adopted. The motion was car- ried and the ordinance follows. -:ELECTION RE TURNS:- There was presented to the Council in proper form and proper man~ er, the returns of the election held throughout the City of plainview, on the 3rd day of'April, 19~5, to elect the followi~ officers for the City of Plainview, Texas, and said returns having been'received, opened and canvassed, as provided by law, amd it appearing from said returns that the following candidates-received the number of votes herein stat- ed: For Aldermen: C,H.Hancock, 68 votes; W..C.Malone, 68 votes; Earl Alexander, 35 votes; Frank Caves, 36 'votes; J.B.Cardwell, i vote. The following candidates having received the largest number of votes were decl~ared duly elected by the City Council. C.H.Hancock and W.C.Malone. The total number of votes polled being 105, and the terms of office beige for the. ensuing two years. IT IS THEREFORE declared that the above named persons having re- ceiwsd the largest number of votes cast for any one for the above named offices are hereby declared elected for the ensuing two years. ATTEST (~ J. L. ~allawa¥ City secretary. J. N. Jordan City Attorney Frank R,Day, administered the oath of office to the newly elected officers, C.H.Hancock and W,C.Malone. Motion by' Alderman Frogge, Seconded by Alderman Malone, that the City pay one-third of the bill for uniforms for the High School Band. The ~aotion was carried and it was so ordered. Motion by' Alderman Osborne, seco]~ed by Alderman Smith,'that the &uditors report ~_~tth~ ~ity's books and accounts be accepted, and the bill for $225.00~$e ~ed and ordered paid. The motion was carried and the resolution follows. ~FtiEREAS, the Plainview !ndependent'School District brought a suit · M~n ze Reew.,s deceased, for taxes and a against t~e !ieirs of MRS,' · n' , f~oreclosure of a lien on-- Resolution No. 504 Lots NOs. 7 to l~, both inclusinve, in Block.No. 28, Highland ad- dition to the town of Plainview, Hale County, Texas; and ~JHEREAS, the City of PlainView was impleaded 'as a taxin~ unit, as well as the State of Texas and County of Hale; and thereaf.ter judge- 890 ment was rendere~ as against all of said defendendants and foreclosed the liens of each separate taxing unit, and said property was a~ver- tised and sold and bought in by the ~lainview ~ndependent School Dis- trict for itself and for the use and benefit of the City of Plainview and the State of Texas and County of Hale; and WHEREAS, the Plainview Independent School District has found a buyer for said lots, to wit: Lester W.~ames, for a total considera- tion of ONE THOUSAND, SIX ~UNDRED SEVENTY FIVE AND N0/100 ($1,675.00) DOLLARS, and the said Lester W.James has had the title examined and a question has heen raised to said title regarding the sufficiency of service upon said heirs, and he is unwilling to pay over said Consid- eration and acCeot a de&d unless he is assured.by the City of Plain- view'that it will refund to him its pro rata part out of said full consideration in the event that he is unsuccessful in a t~espass to try~title suit; and WHEREAS, the City of Plainview is willing for the Plainview In- dependent School District to make said agreemen% with the said Les- ter W.~ames. NOW, THEREFORE, BE IT RESOLVED BY TRE CITY COUNCIL OF THE CITY OF PLAINVIEW~, in-regular session, this 16th day of April, 19&5, with a quorum present, that the officers of the Plainview Independent SchoOl District~be authorized, in so far as the City of PlainvieW is concerned, to enter into an agreement with Lester W.James to sell him the above described lots fora total cash consideration of ONE THOUSAND SIXHUND~RED SEVENTY FIVE AND N0/100 ($1,675.0~ DOLLARS, and to deliver to him a deed, conditioned teat said SchoOl'District for itself and for said City will refund to him the 0NE THOUSAND, S~ HUNDRED SEVENTY FIVE AND N0/100 ($1,675.O0) DOLLARS, if hells not succesSfUl inca tresSpass to try title suit to clear up the title to said property, and should th~ said Lester W. James fail in such~suit, it will be agreed by him that said.property will be reconveyed to the Plainview Independent School DiStrict, and put the tiile back in stat- us quo. Motion by Councilman Osborne, seconded by COuncilman Malone, and unanimously carried that the above resolution be adopted. PASSED A~ ADOPTED this 16th day of April, 19~5. Notion by Alderman Hancock, seconded by Alderman 0sborSe, that Tom Cooper and W.L.Porter be appointed to places in the Police Depart- ment as night patrolmen~, the-places made vacant by the resignations of Berry Lynch and Harry McCain, and the salaries to be $150.00 per month each. The motion was carried and it was.so ordered. There being no further business, meeting adjourned.
