HomeMy WebLinkAbout11.10.2016 MINUTES Minimum Housing Standards Board Minutes November 10, 2016 Board Members Present: Mark Hardin, Larry Dickerson, Gerardo Rodriguez, Kevin Whisenant and Diane Bailey Board Members Absent: None Staff Members Present: Jesse Lopez — Code Enforcement Officer, Judy Rasher - Secretary First item on the agenda - Approval of April 14, 2016 Minutes. Kevin Whisenant made a motion to approve minutes as presented. Gerardo Rodriguez seconded the motion. Motion carried unanimously. Second item on the agenda — Oath of Office, C Diane Bailey. Third item on the agenda - MH 16 -03 - 807 E 10 (RAILROAD PLV BLK 12 S/2 -7 LOTS 8 -12) — review and take action. Jesse Lopez presented the case. The said premises were struck off to the City of Plainview in trust for the use and benefit of itself and Plainview Independence School District, Hale County, Hale County Farm to Market and High Plains Water District taxing units in said cause adjudged to have a lien against said property, and their successors and assigns. Additionally, David B Mull, Sheriff of Hale County, Texas aforesaid, have granted, sold and conveyed and by these presents do grant, sell and convey, unto the said City of Plainview, in trust for the use and benefit of itself and Plainview Independent School District, ale County, Hale County Farm to Market and High Plains Water District all the right, title interest and claim which the said defendants had on the 19 day of September, 2014, or at any time after wards, in and to the premises described in said Order of Sale. Mr. Lopez stated that the structure of this building located at 807 E 10 is considered to be an unsafe structure and a dangerous building under Chapter 3 of the City of Plainview Code of Ordinances and Section 108 of the 2009 International Property Maintenance Code. Staff recommends to the Board of Minimum Housing that the structure is dilapidated, have become so out of repair as to be dangerous, unsafe, insanitary, and unfit for human habitation or occupancy, and that such an attempt to repair the structure to meet all building codes would be costly beyond reason. Staff makes the recommendation that the structure be demolished and all debris moved to the landfill. Motion was made by Gerardo Rodriguez for the City to take necessary action to remove the unsafe house and personal property. Diane Bailey seconded the motion. Motion carried unanimously. Fourth item on the agenda - MH 16 -04 - 204 E 2nd (GOODMAN PLV BLK 2 E 25' -2 W22' -3) — review and take action. Jesse Lopez presented the case. The said premises were struck off to the CITY OF PLAINVIEW in trust for the use and benefit of itself and PLAINVIEW INDEPENDENCE SCHOOL DISTRICT, HALE COUNTY, HALE COUNTY FARM TO MARKET AND HIGH PLAINS WATER DISTRICT taxing units in said cause adjudged to have a lien against said property, and their successors and assigns. Mr. Lopez stated the property is considered to be an attractive nuisance according to IPC Sec 108.1.5 7, property is an unsafe structure considered to IPC Sec 108.1.1 and structure is unfit for human occupancy according to IPC Sec 108.1.3. Staff recommends to the Board of Minimum Housing that the structure is old, dilapidated, have become so out of repair as to be dangerous, unsafe, insanitary, and unfit for human habitation or occupancy, and that such an attempt to repair the structure to meet all building codes would be costly beyond reason. Fifth item on the agenda — MH 16 -05 — 1010 Smythe (ROWE -GOODE PLV BLK 4 E64' OF N37.5' OF W76' -14 S12.5' OF W70' -15) — review and take action. Jesse Lopez presented the case. The owner of the property located at 1010Smythe is Johnny & Roseanna Salazar. In 2010, homeowners attempted to remodel the inside of the home and removed a low bearing wall. It became apparent that the home became inhabitable and the owners moved out in 2011. Received a call from Fire Marshal, Philip Mize on 9/15/16 expressing his concerns regarding the structure of the home and the home being an immediate danger to the public and children in the area. The home have become so out of repair as to be dangerous, unsafe and unfit for human habitation or occupancy, and that such an attempt to repair the structure to meet all building codes would be costly beyond reason. Mr. Lopez stated the property is considered to be an attractive nuisance according to IPC Sec 108.1.5 7, the property is an unsafe structure considered to IPC Sec 108.1.1 and the structure is unfit for human occupancy according to IPC Sec 108.1.3. Staff made the recommendation to the Board that the structure of the home is a danger to the public and should be demolished immediately. Motion was made by Gerardo Rodriguez for the City to take necessary action to remove the unsafe house and personal property. Larry Dickerson seconded the motion. Motion carried unanimously.
