AN ORDINANCE OF THE CITY COUNCIL FOR THE CITY OF
PLAINVIEW, TEXAS AMENDING THE CITY CODE OF ORDINANCES BY
ADDING THE NAME "JIMMY DEAN BOULEVARD" TO A PORTION OF
8TH STREET FROM THE WEST SIDE OF QUINCY STREET TO SMYTH
STREET; PROVIDING A REPEALER; SEVERABILITY CLAUSE;
CUMULATIVE CLAUSE; CONFLICTS CLAUSE; AND EFFECTIVE DATE.
WHEREAS, Jimmy Dean and Donna Dean Stevens ("the Deans") have been
major benefactors to Wayland Baptist University and the community; and
WHEREAS, the City Council desires to recognize the Deans' major contributions
to both Wayland Baptist University and the community by renaming a portion of 8th Street
by adding the name "Jimmy Dean Boulevard"; and
WHEREAS, the subject area of this name change request encompasses
approximately 707 feet of City right-of-way along 8th Street extending for an estimated
two blocks as shown on the attached and incorporated map, Exhibit "A"; and
WHEREAS, several of Plainview's streets have had name change designations
applied to entire and specific portions of streets in order to honor individuals or families;
and
WHEREAS, the City Council deems it to be in the public's interest to grant the
request and rename approximately two blocks from the West side of Quincy Street to
Smyth Street by adding the name "Jimmy Dean Boulevard."
NOW, THEREFORE, the City of Plainview hereby ordains that:
SECTION 1. The findings and recitations set out in the preamble to this Ordinance
are found to be true and correct, and the City Council hereby adopts them incorporating
them as a part hereof for all purposes.
SECTION 2. The City Council hereby determines that a specific portion of 8th Street
from the West right-of-way line of Quincy Street to the West right-of-way line of Smyth Street,
which lies in the College Hill Addition and located South of blocks 38 and 35 of said addition,
Plainview, Hale County, Texas, is changed to add the name of "Jimmy Dean Boulevard."
SECTION 3. All ordinances or parts of ordinances inconsistent with any provisions
of this Ordinance are hereby repealed to the extent of such conflict, and the provisions of
this Ordinance shall be and remain controlling as to the matters regulated herein.
SECTION 4. Severability is intended throughout and within this Article. If any
provision, including any section, paragraph, sentence, clause, phrase or word or the
application thereof to any person or circumstance is held invalid, unconstitutional, or
unenforceable by a court of law or administrative agency with jurisdiction over the matter,
such action shall not be construed to affect any other valid portion of this Ordinance. A

constitutional construction hereof is intended and shall be given. There is not intent herein
to violate either of the Texas Constitution or the Constitution of the United States.
SECTION 5. Provisions of this Ordinance are cumulative and nothing herein shall
prevent, alter, or diminish the applicability or enforcement of other ordinances restricting,
regulating, or goveming the subject matter herein.
SECTION 6. All ordinances or portions of any ordinance of the City of Plainview,
Texas in conflict herewith, are hereby amended to conform with the provisions hereof.
SECTION 7. This Ordinance shall be of full force and effect upon its passage and
publication as required by law.
