HomeMy WebLinkAboutR00-107 (2)Resolution No. R00-107 A Resolution of the City of Plainview, Texas, canvassing the results and declaring the results of a Special Election held on August 12, 2000. WHEREAS, there comes to be considered the returns of a Special Election held on the 12th day of August, 2000, for the purpose of considering a proposed Charter Amendment, reading as follows: PROPOSITION No Person shall hold the office of member of council for a period longer than two (2) consecutive four (4) year terms of council ("Eligible Service Period"), unless a period of at least one (1) four (4) year term of the council has intervened following each such Eligible Service Period without such person serving on the council. This shall not prohibit a person who has served two four-year terms as a council member from serving as mayor nor shall it prohibit a person who has served two four-year terms as mayor from serving as a council member, nor shall service of any term or terms of less than four years by election or appointment prohibit a person from serving two four-year terms as mayor and two four-year terms as a councilmember. Any mayor or council member voluntarily vacating office in the second term of the eligible service period prior to the expiration of that term shall be deemed to have served the eligible service period. WHEREAS, it is determined from said returns, duly and legally made, that there were at said election 494 valid and legal votes; and WHEREAS, the votes "For" and "Against" were received as follows: "For" "Against" Early Voting 187 41 District 1 11 1 District 2 16 2 District 3 13 4 District 4 50 3 District 5 80 8 District 6 42 10 District 7 11 15 Total 410 84 WHEREAS, the City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, plce and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall for the time requires by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code, and that this meeting has been open to the public as required by law at all times during which this Resolution R00 107 Page 1 of 2 Resolution and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Plainview, Texas, that having canvassed the results of the Special Election on August 12, 2000 that the voters approved the proposition and the amendment to the Charter of the City of Plainview is hereby adopted. This Resolution shall be of full force and effect upon its passage. PASSED AND APPROVED this 17th day of August, 2000.
