RESOLUTION NO. RO0-106
A Resolution of the City of Plainview, ratifying a settlement
agreement between Energas Company and the sixty-seven
cities comprising the West Texas system;
And declaring an effective date.
WHEREAS, the City Council of the City of Plainview, Texas deems it to be in the best interest
of the health, safety, and welfare of the citizens of the City of Plainview, to ratify a Settlement
Agreement pertaining to Gas Utilities Docket No. 9002-9135, of the Texas Railroad Agreement
between Energas Company and the sixty-seven (67) cities comprising the West Texas System;
and
NOW, THEREFORE, the City Council of the City of Plainview, Texas hereby resolves:
Section 1.
The City Council of the City of Plainview, Texas hereby ratifies and approves the Settlement
Agreement subject to Section 2 of this Resolution, pertaining to Gas Utilities Docket No. 9002-
9135 of the Texas Railroad Commission between Energas Company and the 67 cities comprising
the West Texas system, a copy of said Settlement Agreement is attached hereto and shall be
incorporated into the minutes of the City Council and as incorporated into the minutes of the City
Council shall constitute and be a part of this Resolution as if fully copied herein in detail.
Section 2.
Under Section 1, rates shall become effective October 1, 2000; provided, however, the City is
entitled to select rates approved by Order of the Texas Railroad Commission applicable to any
burner tip customers located within any city which does not ratify the Settlement Agreement.
The City shall make such selection within fifteen (15) days of the effective date of the Railroad
Commission's Order. If the City chooses to select the rates approved by the Order of the
Railroad Commission, it shall be responsible for its proportionate share of rate case expenses
incurred in conjunction with any hearing before the Railroad Commission and the three year rate
case moratorium contained in the Settlement Agreement shall not be applicable to the City. In
event the City decides not to select rates contained in the Order of the Railroad Commission for
any City, which does not ratify the Settlement Agreement, the rates and terms contained in the
Settlement Agreement shall continue to be applicable in the City in all respects. The approval of
the Settlement Agreement is subject to this provision.

This resolution shall be effective at the time of its adoption.
