AN ORDINANCE FIXING THE MAXIMUM R~TE OF SPEED OF MOTOR
VEHICLES; ALLOWING FOR SPEED ZONES; PROVIDING FOR PENALTY;
AND DECLARING AN EMERGENCY.
WHEP~]AS, the City Council of the City of Plainview, Texas, upon the basis of
engineering and traffic investigation, find it necessary to establish maximum
speed limits, and create speed zones on S.H. 194, within the Corporate Limits
of the City of Plainview, Texas.
WHEREAS, the City Council of the City of Plainview, Texas, also finds it is
necessary to immediate preservation of the public health and safety to provide for
the immediate enactment of such measures, constituting an emergency;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS;
SECTION 1. Subsection (A). Speed restrictions. It shall hereafter be unlawful
for any person to drive or operate a motor vehicle upon any street, roadway or
highwaywithin the City Limits of the City of Plainview, Texas, at a speed greater
than is reasonable and prudent under the conditions then existing, having regard
to the actual and potential hazards when approaching and crossing an intersection
or a railway grade crossing, when approaching and going around a curve, when approach-
ing a hill crest, when travelling upon any narrow or winding roadway, or when special
hazard exists with respect to pedestrians or other traffic or by reason of weather
or highway conditions; and in every event, speed shall be so controlled as m~y be
necessary to avoid colliding with any person, vehicle, or other conveyance on or
entering the highway in compliance with legal requirements and the duty of all
persons to use due care.

Subsection (B). Where no special hazard exists that requires lower speed for
compliance with Subsection 1 (A) of this Section, the speed of any vehicle not in
excess of the limits specified in this subsection or established as hereinafter
authorized shall be lawful, but any speed in excess of the limits specified in this
subsection or established as hereinafter authorized shall be prima facie evidence
that the speed is not reasonable or prudent and t]~at it is unlawful.
The speed zones established by this Ordinance shall include all of S,H~ 194~
Quincy Street, within the Corporate Limits of the City of Plainview, Texas;
the maximum legal speed shall be as follows:
(a) Beginning at the point of intersection with the Northwest City Limit,
a point 0~'005 mile northwest of Cgmyon Street, the maximum legal speed
for southbound traffic only shall ]be 55 mph for a distance of 0~437
mile; thence 50 mph for a distance of 0.250 mile to a point 0.006
mile northwest of the centerline of West 24th Street; thence 45 mph
for a distance of 0~220 mile; thence 40 mph for a distance of 0~765
mile to the point of intersection with the centerline of West llth
Street; thence 35 mph for a distance of 0.527 mile to the point of
intersection with the centerline of U~S~ 70, West 5th Street.
(b) Beginning at the point of intersection with the centerline of U.S. 70,
West 5th Street, the maximum legal speed for northbound traffic only
shall be 35 mph for a distance of 0.527 mile to the pqint of inter-
section with West llth Street; th~ce 40 mph for a distance of 0~785
mile; thence 45 mph for a distance of 0~250 mile; thence 50 mph for
a distance of 0~200 mile; thence 55 mph for a distance of 0.437 mile
to the point of intersection with the Northwest City Limit.

And all Ordinances and parts of Ordinances in conflict herewith are hereby
repealed.
SECTION 2. Jay person violating any of the provisions of this Ordinance
shall, upon conviction thereof, be fined in any sum not less than Ten ($10,00)
nor more than Two Hundred ($200~00) Dollars.
SECTION 3. That the hazards and dangers to ]public health and safety create
a necessity requiring all rules providing that no ordinance shall be finally passed
on the day of its introduction be suspended; and this Ordinance is declared to be
an emergency measure, to take effect from and after the date of its first
publication.
