AN ORDINANCE AMENDING ZONING ORDINANCE NO. 77-2090 AND THE OFFICIAL MAP OF THE CITY OF
PLAINVIEW SO AS TO MAKE THE FOLLOWING 'CHANGES AND CREATING AN EMERGENCY ZONE CASE #373:
BEGINNING at a nail in the center-line of Quincy Street and in the west line and
455.0' N.O°O2'40"E, of the SW corner of the N~74 of Section 38, Block JK-2, Hale Coun-
ty, Texas; ·
THENCE N.OOO2'40"E, 80.0' continuing along the center-line for Quincy Street and
the west line of said Section .38, to a nail;
THENCE East, at 37.5' pass a 3/8" iron rod in the east ~right-of-way line of a pub-
lic road as dedicated in Vol. 558, Page 479, of the Hale County Deed Records, in all
237.5' to a 3/8" iron rod;
THENCE S.OOO2'40"W, 80.0' to a 3/8" iron rod;
THENCE West, at 200.0' pass a 3/8" iron rod in the east right-of-way line of said
road, in all 237.5' to the PLACE OF BEGINNING and containing 0.436 acre of which the
west 0.069 acre is in said road;
CITY OF PLAINVIEW HALE COUNTY, TEXAS, FROM R~I TO A CRD ZONING DISTRICT.
WHEREAS, the proposed change in Zoning Districts as hereinafter made has been duly pre-
sented to 'the Planning & Zoni'ng Commission for its recommendation which was received by
the City Council, and after due consideration the City Council of the City of Plainvew
finds that for the orderly growth of the City making the proposed chanae as hereinafter
set out will be in the public interest which creates an emergency; and~
WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning
Ordinance and Map, have been fully complied with, as well as giving notices provided by
Article IOllF Vernon's Annotated Civil Statutes-Amended, 1953, and notice was duly pub-
lished in the Plainview Herald-more than fifteen (15) days prior to the date of the Pub-
lic Hearing before the City Council of such proposed amendment, and the Public Hearing
according to said notice was duly held 'in the City Council Room of the City Hall, Plain-
view, Texas, at which~ time persons appeared in support of the proposal; and after said
hearing, it was by the City Council determined that it would be in the public interest
due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in
the manner hereinafter set forth in the body of this Ordinance; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW:
SECTION l: That Ordinance No. 77-2090 and the Official Zoning Map be and the same are
hereby amended as follows, to-wit:
ZONE CASE NO. 373
Change:
BEGINNING at a nail in the center-line of Quincy Street and in the west line and
455.0' N.oOo2'40"E, of the SW corner of the N~/4 of Section 38, Block JK-2 Hale County
Texas; ' , ,
THENCE N.OoO2'40"E, 80.0' continuing along the center-line for Quincy Street and
the west line of said Section 38, to a nail;
THENCE East, at 37.5' pass a 3/8" iron rod in the east right-of-way line of a public
road as dedicated in Volume 558, Page 479, of the Hale County Deed Records, in all 237.5'
to a 3/8" iron rod;
THENCE S.0o02'40"W, 80.0' to a 3./8" iron rod;
THENC~ West, at 200.0' pass a 3/8" iron rod in the east right-of-way line of said
road, in all 237.5' to the PLACE OF BEGINNING and containing 0.436 acre of which the
west 0.069 acre is in said road; City of Plainview, Hale County, Texas, from an R-1 Zone
to a CRD Zoning District. From the date of this Ordinance said lot, tract, and parcel
of land described shall be and hereby be changed to the Zoning District indicated and
the Official Map ~s amended in accordance herewith.
~'HEREAS, an emergency exists as shown in the preamble to this Ordinance, the enactment
of this Ordinance is declar.ed to be an emergency measure creating a public necessity that
the rule requiring proposed Ordinance to be presented' at two (2) separate Council Meetings
be dispensed with; and this Ordinance shall be effective from the date of its passage.
