HomeMy WebLinkAbout78-2200 ordOrdinance No. 78-2200 .AN ORDINANCE AMENDING ORDINANCE NO. 55-655 AND PROVIDING iFOR PARTICIPATION IN THE TEXAS MUNICIPAL RETIREMENT SYSTEM BY PERMANENT EMPLOYEES OF THE CITY OF PLAIN-VIEW, EXCEPT EMPLOYEES THAT ARE ME_NiBERS OF THE TEXAS FIREMEN RELIEF .AND RETIREMENT FUND. WHEREAS, the Constitution of the State of Texas was amended on November 7, 1944, by the addition of Section 51-f, Article III, which authorized the Legislature to establish a statewide re- tirement and disability and pension system for city employees; and WHEREAS, Chapter 75, Acts 50th Legislature (1947), as amended by Chapter 24, Acts Regular Session 51st Legislature (Vernon's Annotated Civil Stats., Art. (6243H) established the Texas Municipal Retirement System, and authorizes the governing body of each city or town to elect, at its option, to have one or more of the city departments participate in such system; and WttEREAS, the City of Plainview, Texas, by Ordinance No. 643, passed the 4th day of April, 1955, elected to have and did have the Police Department employees, the Department of the City Treasurer employees, and the Department of the Building Inspector employees participate in the Texas Municipal Retirement System; and WHEREAS, the governing body of the City of Plainview, Texas, finds that it will be in the public interest for the City to have all of its permanent employees, except the employees that are members of the Texas Firemen Relief and Retirement Fund partici- pate in the Texas Municipal Retirement System and to include all of its employees in said system, except employees that are members of the Texas Firemen Relief and Retirement Fund as well as those already included in the Texas Municipal Retirement System as above stated, now, therefore; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS: Section 1. That on behalf of the City of Plainview, Texas, the City Council hereby exercises its option and elects to have the City and all of its permanent employees of all departments, excePt employees that are members of Texas Firemen Relief and Retirement Fund, participate in the Texas Municipal Retirement System as provided in Chapter 75, Acts of the 50th Legislature, as amended, being Article 6243H of Vernon's Annotated Civil Statutes; and all of the benefits and obligations of such system are hereby accepted. Section 2o That the City Manager is hereby directed to notify the Board of Trustees of the Texas Municipal Retirement System that the City of Plainview, Texas, has elected to participate and have all of its departments, including those which may be added in the future, to participate in the Texas Municipal Retirement System. Section 3. Each person who becomes an employee of any parti- cipating department on or after the effective date of participation of such department shall be included within and subject to the provisions of the Texas Municipal Retirement System beginning upon the date such person becomes an "employee" as defined in sub-section 14, Section II, of such system. Section 4. That the City of Plainview, Texas, may in the- future ref~use to add new departments or new employees to such system but shall n~ver discontinue as to any participants. Section 5. That the Director of Finance or City Clerk is hereby directed to remit to the~Board of Trustees of the Texas Municipal Retirement System, at its office in Austin, Texas, the city's proper contributions to the system and the amounts which shall be deducted from the compensation or payroll of the employees, all as required by said Board under the provisions of Chapter ~75f Acts of the 50th Legislature of the State of Texas, as amended, and the 'said Director of Finance or City Clerk is hereby authorized and directed to ascertain and certify officially on behalf of the City of Plainview, Texas, the prior service rendered to the said municipality by each of the employees of the participating ~depar%ments, and the average prior service co~penSa~!°n received by each, and to make and execute all other ~eports and certificates, which may be required by the City of Plainview, Texas, under the provisions of Chapter 24, Acts Regular Session of~ 51st Legislature or the rules and regu- lations of the Board of Trustees of the Texas Municipal Retirement Sy~tem.
