AN ORDINANCE AMENDING ZONING ORDINANCE NO. 77-2090 AND THE OFFICIAL ZONING MAP OF
THE CITY OF PLAINVIEW SO AS TO MAKE THE FOLLOWING CHANGES AND CREATING AN EMERGENCY
ZONE CASE NO. 388
BEGINNING at ~ntersection of S ROW line U.S. Hwy 70 and W ROW LiMe of Grandview
~r. in revised Grandview Addition to Plainview, Hale County, Texas, said point being
939.1' N and 383~58' W of SE corn.er'Qf.~E/4 of Sec. 28, Blk JK-2, Hale Co., TX; THENCE
~.70°09'W, along_S ROW line of US Hwy 70, 26].46' tO a point; THENCE S. 441.~4' to a-
point in N line 6f allby'in said revised Grandview Addn.; THENCE S.82°53"E., 223.94'
to W RONline of Grandview Dr.; THENCE NortheastWard 80~56' around curve to left having
radius of 200' a-nd chord bearing N.11°32'21"E'~, 80.02' to end of curve; THENCE N. 257.83'
to beginning of a curve; THENCE' Northeastward 45.04' around curve to right,' having a
radius of 130' and chord bearing N.9°55'30"E., 44.81'-to PLACE OF BEGINNING and contain-
ing 2.253 acres;
CITY OF PLAINVIEW, HALE COUNTY, TEXAS, FROM R-1 TO A
CRD ZONING DISTRICT.
WHEREAS, the proposed change in Zoning Districts as hereinafter made has been duly
presen%ed to the Planning and Zoning Commission for its recommendation which was
received by the City Council, and after due consideration, the City Council of the
City o~ Plainview finds that for the orderly growth of the City making the proposed
change as hereinafter set out will be in the public interest which creates an emer-
gency; and,
WHEREAS, all conditions precedent required by law for a valid amendment to the Zo-
ning O~dinance and Map, have been fully complied with, as well as giving notices
prOvided by Article IO]IF Vernon's Annotated Civil Statutes-Amended, 1953, and
notice was duly published in the Plainview Herald more than fifteen (15) days prior
to the date of the Public Hearing before the City Council of such proposed amend-
ment, and the Public Hearing according to said notice was duly held in the City '
Council Room of the City Hall, Plainview, Texas, at which time persons appeared in
support of the proposal; and after said hearing, it was by the City Council deter-
mined that it would by in the public ~nterest due to changed conditions, that the
Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth
in the body of this-Ordinance; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THL CITY OF PLAINVIEW;
SECTION 1. That Ordinance No. 77-2090 and the Official Zoning Map be and the same
are hereby amended as follows, to-wit:
ZONE CASE NO. 388
Change Tract BEGINNING at intersection of S ROW line of. US Hwy 70 and W ROW line of
Grandview Dr. in revised Grandview Ad'dn.~toPlainview, Hale County, TX, said point
being 939.1' N and 383.58' Wof SE corner of NE/4 of Sec. 28, Blk JK-.2, Hale Co., TX;

tO a. point in N line of alley in said revised Grandv]ew Addn.; THENCE S.82053'E,

City of Plainv:iew, Hale County, Texas, from an R-1 to a CRD Zoning District.
From the date of this Ordinance. said lot, tract, and parcel of land described shall
be and hereby be changed to the Zoning District indicated and the Official Map ~
amended in accordance herewith. ' '~
WHEREAS, an emergency exists as shown in the preamble to this Ordinance, the enact-
ment of this Ordinance is declared to be an emergency measure creating a public
necessity that the rule requiring proposed Ordinance to be presented at two (2)
separate Council Meetings be dispensed with; and this Ordinance shall be effective
from t~e date of its passage.
