AN ORDINANCE AMENDING ZONING ORDINANCE NO. 77-2090 AND THE OFFICIAL ZONING MAP OF THE
CITY OF PLAINVIEW SO AS TO MAKE THE FOLLOWING CHANGES AND CREATING AN EMERGENCY ZONE
CASE NO. 391: A 2.798 acre tract out of the SW part of Section 26, Block JK-2, Hale
County, Texas, described by metes and bounds as follows:
BEGINNING at a point N..89°56'18"E., 1,320~ and N.O°OS'30"W., 408' from the SW
corner of Section 26~, Block JK-2, Hale County, Texas; THENCE N.OoO5~30"W., 342' to a point;
THENCE N.89°56'18"E., 130.29' to a point in a west line of Villa West Addition
Unit No. 2;
THENCE Southwesterly, 10' along said Villa West Addition line around a curve to the
left having a radius of 380', a central angle of 1°30'29'', a tangent of 5', and a chord
bearing S,0°41'32"W., 10' to a point of tangency;
THENCE S.0°03'42"E., 10' to the most southerly SW corner of said Villa West Addi-
tion, said point also being the NW corner of a 0.630 acre street dedicated as recorded
in Volume 628, Page 469, of the Hale County Deed Records;
THENCE N.89°56'18"E., at 60' pass the most northerly NE corner of ~said street dedi'
cation, in all 169.11' along the south line of said Villa West Addition to a point;
THENCE N.28°46'O6"E., 5.91' along a southeasterly line of said Villa West Addition
to a point in the most southerly line of Town West Addition Unit No. 1, said point being
the SW corner of Lot 24 of said Town West Addition;
THENCE S.61°13'54"E., at 120' pass the SE corner of said Lot 24 and a corner of
said street dedication, in alt 180' to a corner of said street dedication and the most
southerly SE corner of said Town West Addition;
THENCE Southwesterly along an easterly line of said street dedication around a curve
to the right having a radius of 195.36', a central angle of 18029'06'', and a chord bearing
S.38o00'3§''W, 62.75' to a potent;
THENCE S.O°O3'42"E., 190.98' to a point;
THENCE S.89°56'18"W., at 12.95' pass the NE corner of a 408' x 408' tract, in ail

EXCEPT 0.630 acres in a street as dedicated in Volume 628, Page 469 of the Hale County
Deed Records; CITY OF PLAINVIEW, HALE COUNTY, TEXAS, FROM R-2 TO TH ZONING DISTRICT.
WHEREAS, the proposed change in Zoning Districts as hereinafter made has been duly pre-
sented to the Planning and Zoning Commission for its recommendation which was received
by the City Council, and after due consideration, the City Council of the City of Plainview
finds that for the orderly growth of the City making the proposed change as hereinafter
set out will be in the public interest which creates an emergency; and,
WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning
Ordinance and Map, have been fully complied with, as well as giving notices provided by
Article IOi1F Vernon's Annotated Civil Statutes-2~ended, 1953, and notice was duly pub-
lished in the Plainview Herald more than fifteen (15) days prior to ~he date of the
Public Hearing before the City Council of such proposed amendment, and the Public Hearing
according to said notice was duly held in the City Council Room of the City Hall, Plain-
view, Texas, at which time persons appeared in support of the proposal; and after said
hearipg, it was by the City Council determined that it would be in the public interest
due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in
the manner hereinafter set forth in the body of this Ordinance; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW;
SECTION 1. That Ordinance No. 77-2090 and the Offical Zoning Map be and the same are
hereby amended as follows, to-wit:

From the date of this Ordinance, said lot, tract., and parcel of land described shall be
and hereby be changed to the Zoning District indicated and the Official Map is amended
in accordance herewith.
WHEREAS, an emergency exists as shown in the preamble to the Ordinance, the enactment
of this Ordinance is declared to be an emergency measure~creating a public necessity
that the rule requiring proposed Ordinance to be presented at two (2) separate Council
Meetings be dispensed with; and this Ordinance shall be effective from the date of its
passage.
Unanimously passed by the City Council this 22nd day of August, 1978.

clause, phrase or work of this ordinance be declared unconstitutional
or invalid for any reason, the remainder of this ordinance shall not
be affected thereby.

tion of the descriptive caption of this ordinance as an alternative
method provided by law.
