HomeMy WebLinkAbout78-2290 ordORDINANCE NO. 78-2290 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 77-2090 AND 7HE OFFICIAL ZONING MAP OF THE CITY OF PLAINVIEW SO AS TO MAKE THE FOLLOWING CHANGES AND CREATING AN EMERGENCY ZONE CASE NO. 406 : BEGINN/NG at the NW Corner of Section 26, Block JK-2, Hale County, Texas; 5~NCE N. 89°59'30"E., 1,826.8' along the North line of said Section to the Southwesterly BOWline of St~,te Highway No. 194; THENCE S.61°13'54"E., 390.8' along said ROW line to a 3/8" steel rod, on the East ROW line of Highland Road, as dedicated in Vol. 622, Page 399, of the Hale County Deed Records and the ~POINT OF BEGI~.~ING: 'THENCE S.28°46'06"W., 500' a- long the East 5DW line of Highland Road to the inters~tion of the North line of an alley as dedicated .ir~ Vol. 622, P~ge 399, of the Hale County Deed Records; THENCE S.61°13'54"E., 982.13' to an alley cut back corner; THENCE N.'73°46'06"E., 28.28' to an alley cut back corner in the West line of Rio Seco Dztdition Unit .No. 1, as recorded in Vol. 622, Page 397, of the Hale County Deed Records; THENCE N. 28°46'06?E., 480' along the West line to the NW Corner of said addition; THENCE N.61°13'54"W., 1,002.13' along the Southwesterly line of said highway to the POINT OF BEGINNING and contain~.~g 11.498 acres. CITY OF PLAINVIEW, HALE COUNTY, TEXAS, FROM R-1 TO A C~ ZONING DISTRICT. WHEREAS, the proposed change in Zoning Districts as hereinafter made has been duly present- ed to the Planning and Zoning Commission for its recommendation which was received by the City Council, and after due consideration, the City Council of the City of Plainview finds that for the orderly growth of the City making the proposed change as hereinafter set out will be in the public interest which creates an emergency; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map, have been fully complied with, as well as giving notices provided by Article 1011F Vernon's Annotated Civil Statutes-Amended, 1953, and notice was duly publish- ed in the Plainview Herald more than fifteen (15) days prior to the date of the Public Hearing according to said notice was duly held in the City Council Room of the City Hall, Plainview, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would by in the public interest due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW: SECTION 1. That Ordinance No. 77-2090 and the Official Zoning Map be and the same are hereby amended as follows, to-wit: ZONE CASE NO. 406 : BEGINNING at t~he NW Corner of Section 26, Block JK-2,~ Hale County, Texas; THENCE ~--~°59'30"E., 1,826.8' along the North line of said Section.to the South- westerly ROW line of State Highway No. 194; THENCE S.61o13'~54"E., 390.8' along said ROW line to a 3/8" steel rod, on the East ROW line of Highland Road, as dedicated in Vol. 622, Page 399, Of the Hale County Deed Records and the PO/N~ OF BEGINNING: THENCE S.28°46'06"W., 500' along the East ROW line of Highland Road to the intersection of the North line of an alley as dedicated in Vol. 622, Page 399, of the H~le (~unty Deed Records; THENCE S61°13'53"E., 982.13' to an alley cut back corner; THENCE N.73°46'06"E., 28.28' to an alley cut back corner in the West line.of Rio Seco Addition-Unit NO. 1, as recorded in Vol. 622, Page 397, of the Hale County Deed Records; THENCE N.28°46'06"E., 480' along the West line to the ~,[ Corner of said addition; THENCE N. 61o13'54"W., 1,002.13' along ~e Southwesterly line of said highway to the PO/NT OF BEGINNING and containing 11.498 acres. City of Plainview, Hale County, Texas, from an R-1 to a C(~ Zoning District. WHEREAS, an emergency exists as shown in t~e preamble to this Ordinance, the enactment of this Ordinance is dec']ared to be an emergency measure c?~ating a public necessity that the rule requiring proposed Ordinance to be presented at two (2) separate Council Meetings be dispensed with; and this Ordinance shall be effective 'From the date of its passage.
