AN ORDINANCE AMENDING SECTION 3.2, SECTION 3.3 AND SECTION
3.4, ORDINANCE NO. 75-1835 OF THE CITY OF PLAINVIEW, TEXAS,
PROVIDING FOR THE APPOINTmeNT, TE~ OF OFFICE, REMOVAL FROM
OFFICE~ NOTICE OF MEETINGS AND ATTENDANCE REQUIREMENTS OF
ALL MEMBERS OF THE BOARD OF ELECTRICAL EXAMINERS OF THE CITY
OF PLAINVIEW, TEXAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS:
THAT Section 3.2 APPOINTMENT; TERM., Section 3.3 REMOVAL,
and Section 3.4 OFFICERS; MEETINGS, Board of Electrical Examiners
of the Electrical Code for the City of Plainview, Texas, are hereby
amended to read as follows:
Section 3.2 APPOINTMENT; TERM
(a) FIRST BOARD. For the first board appointed after the
enactment of this code, four of the sew~n members, comprised of
one master electrician, one journeyman electrician, on member
who is an employee of the local electrical utility company and
one of the other two outside members shall be appointed for a
term of two years, the three other members, comprising the other
master and journeyman electrician and the remaining outside
member,, shall be appointed for a term of one year.
(b) REGULAR ~ERM. Thereafter, each member shall be appointed
for a term of two years. Three (3) members of the board shall be
appointed beginning January 1 in odd num~bered years and four (4)
members of the board shall be appointed beginning January 1 in
even numbered years. No person shall serve more than two (2) full
successive terms a~ a member of the board. Any term of office
of any member of the board expiring other than on December 31 in
any year shall be [illed by appointment of the City Council until
December 31 of that year.
Ail members appointed shall not, at the time of appointment
or during their te~m of office, serve on any other authority,
board, commission ~r committee of the City of Plainview. All
members appointed shall be residents of the City of Plainview
at the time of their appointment and during their term of office.
(c) VACANCIES. Should a member of the board move from
the City or otherwSse become disqualified for any other reason,
he shall vacate th~ office.
(d) FILLING OF VACANCIES. Vacancies occurring in the
membership of the board shall be filled by appointment for
the unexpired term by the City Council.
Section 3.3 REMOVAL
(a) CAUSE. When good cause exists, a member may be removed
from office by the Mayor and the City Council.
(b) MANDATORY ATTENDANCE REQUIREMENTS. Each member of the
board shall attend no less than seventy-five percent (75%) of the
regular, special or emergency meetings called by the officers of
the board. The secretary of the board shall make a quarterly
report to the Mayor and the City Council showing the attendance
of each member of the board. Any representative failing to attend
seventy-five percent (75%) of the regular, special, or emergency
meetings legally called during any time of the year, shall be
automatically disqualified for service on the board and shall be
replaced by the City Council.
Section 3.4 OFFICERS; MEETINGS
(a) OFFICERS. The board shall meet as soon after appointment
as possible and select a Chairman and a vice-chairman from within
its number.
(b) MEETINGS. The board shall meet at least once each month.
The meeting night will be on the third 'Tuesday of each month;
however, this may be changed to meet the convenience of the
majority of the Board.
(c) NOTICE OF MEETINGS. Each meeting of the board shall be
legally posted as required by Article 6252-17 V.T.C.S. and the
Mayor, ex-officio members and members o.f the board shall be notified
in writing not less than five days prior to the date of any meeting.
(d) ELECTRICAL INSPECTOR AS SECRETARY. The electrical
inspector shall serve as secretary to t]he board without compensation
and shall keep a complete written record of all proceedings of
the board. He shall not have any voting power within the board.
SEVERANCE CLAUSE: That should any section, paragraph,
sentence, clause, phrase or word~ of this ordinance be declared
unconstitutional or invalid for any reason, the remainder of
this ordinance shall not be affected thereby.
AND IT IS THEREFORE ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PLAINVIEW:
That on a motion by Alderman Almon, seconded by Alderman SoRelle,
Ordinance No. 78-2293 was read in full and adopted this date and
introduced on first reading this the 5th day of December, 1978.
That on a motion by Alderman Woods, seconded by Alderman
SoRelle, Ordinance No. 78-2293 was read by caption and adopted
by the City Council on second ~and final reading this the 12th
day of December, 1978.
