HomeMy WebLinkAbout78-2295 ordORDINANCE NO. 78-2295 AN ORDINANCE CREATING THE HOUSING AUTHORITY OF THE CITY OF PLAINVIEW, TEXAS, AND PROVIDING FOR THE COMPOSITION, APPOINTMENT, TERM OF OFFICE, ELECTION OF OFFICERS, NOTICE OF MEETINGS AND ATTENDANCE REQUIREMENTS OF ALL COMMISSIONERS APPOINTED TO THE HOUSING AUTHORITY. BE IT ORDAINED BY THE CITY COUNCIL, CITY OF PLAINVIEW, TEXAS: Section I. Creation. There is hereby created by the City of Plainview the HOUSING AUTHORITY OF THE CITY OF PLAINVIEW, TEXAS. Section II. Purpose. The purpose of the Housing Authority shall be to determine the needs of the City concerning housing and entering into solutions with the City Council to alleviate any housing deficiencies. Upon concurrence with the City Council, the Housing Authority shall submit to the Department of Housing and Urban Development and/or the Federal Housing Administration and/or Farm Home Administration necessary requisites for acquiring land, existing houses, and/or new houses in order to concur with standard living practices. Section III. Seal of Authority. The Seal of the Housing Authority shall be that Seal of the City of Plainview and shall bear the name Housing Authority of the City of Plainview, Texas. Section IV. Office of AuthorJ. ty. The Offices of the Authority shall be at such place or places in the City of Plainview, Texas, as the Housing Authority may from time to time designate by resolution. Section V. Composition. The Housing Authroity shall consist of five (5) commissioners appointed by the City Council. Ali. commissioners shall not, at the time of appointment or during the term of their office, serve on any other authority, board, coma~ission or committee of the City of ?lainview. (Except those appointed to serve on the Sect~on~8 Housing and Rehabilitation Committee as required.by ~ the U.S. Department of Housing and Urban D~velopment.) All members appointed shall be residents of the City of Plainview at the time of their appointment and during their term of office. Section VI. APPOINTS~NT. Each Commissioner of the Housing Authority shall serve for a term of two (2) years. Two (2) Commissioners shall be appointed beginning January 1 in odd-numbered years, and three (3) Commissioners shall be appointed beginning January 1 in even-numbered years. No person shall serve more than two (2) full successive terms as a member of the Housing Authority. Any term of office of any member of the Housing Authority expiring other than on December 31 in any year shall be filled by appointment by the City Council until December 31 of that year. Section VII. Mandatory Attendance Requirements. Each Commissioner of the Authority shall attend no less than seventy-five (75%) percent of the regular, special or emergency meetings called by the officers of the Housing Authority of the City of Plainview, Texas. The Secretary of the Authority shall make a quarterly report to the Mayor and City Council showing the attendance of each member of the Authority. Any Commissioner failing to attend seventy-five (75%) percent of the regular, special or emergency meetings legally called during any calendar year shall be automatically disqualified from service on the ~thority, and shall be replaced by the City Council. Section VIII. Vacation of Office. Should a member of the Authority move from the City or otherwise become disqualified for any reason, he shall vacate the office. Section IX. Filling Vacancies. Vacancies occuring in the Co~nissioners of the Housing ~lthority of the City of Plainview~ Texas, shall be filled by appointment for the unexpired term. Section X. Officers. The Officers of the Housing ~thority shall be a Chairman, Vice-Chairman and Secretary (who shall be Executive Director). Chairman. The Chairman shall preside at all meetings of the Housing Authority. Except as otherwise authorized.by Resolution of the Housing Authority, the Chairman shall sign all Contracts, Deeds and other instruments made by the authority. At each meeting, the Chairman shall submit such recommendations and information as he may consider proper concerning the business, affairs, and policies of the Authority. Bo Ee Vice-Chairman. The W[ce-Chairman shall perform the duties of the Chairman in the absence or incapacity of the Chairman and in case of the resignation or death of the Chairman, the Vice- Chairman shall perform such duties as are imposed on the Chairman until such time as the Committee shall appoint a new Chairman. Secretary. The Secretary shall keep the record of the Committee, shall act as Secretary of the meetings of the Committee and record all votes, and shall keep a record of the proceedings of the Committee in a journal of proceedings to be kept for such purpose, and shall perform all duties incident to his office. He shall have, the care and custody of all funds of the Committee and shall deposit the same in the name of the Committee in such bank or banks as the Committee may select. The Secretary shall sign all orders and checks for the payment of money and shall pay out and disburse such moneys under the direction of the Committee. Except as otherwise authorized by resolution of the Committee, all such orders and checks shall be countersigned by the Chairman. He shall keep regular books of accounts showing receipts and expenditures and shall render to the Committee at each regular meeting (or more often if requested), an account of his transaction and also of the financial conditions of the Committee. He shall give such bond for the faithful performance of his duties as the Committee may determine. Executive Director. The Secretary shall be the Executive Director of the Housing Authority and shall have general supervision over the Administra- tion of the business and affairs of the Housing Authority, subject to the direction of the Housing Authority. He shall be charged with the management of the housing projects of the Housing Authority. Additional Duties. The officers of the Committee shall perform such other duties and functions as may from time to time be required by the Committee or the Bylaws or rules and regulations of the Committee. Election or Appointment. The Chairman and Vice- Chairman shall be elected at the annual meeting of the Committee from among members of the Committee, and shall hold office for one year or until their successors, are elected and qualified. In case of the absence or incapacity of both the Chairman and Vice-Chairman, the other members of the Committee may elect an ACting Chairman to serve during the period of absence or incapacity of the Chairman and W[ce-Chairman. The Secretary shall be appointed by the Committee. Any person appointed ~o fill the office of Secretary, or any vacancy therein, shall have such term as the Committee fixes, but no member of the Committee shall be eligible to this office. Ge Vacancies. Should the offices of Chairman or Vice Chairman become vacant, the Committee shall elect a successor from its membership at the next regular meeting, and such election shall be for the unexpired term of said office. When the office of Secretary becomes vacant, the Committee shall appoint a successor, as aforesaid. Additional Personnel. The Committee may from time to time employ such personnel as it deems necessary to exercise its powers, duties and functions as prescribed by the laws of the State of Texas applicable thereto. The selection of such personnel (including the Secretary), shall be determined by the Committee subject to the laws of the State of Texas. Section XI. Annual Meeting. The annual meeting of the Housing Authority shall be held on the first Tuesday of May, at 4:(]0 p.m. at the regular meeting place of 'the authority. In the ew~nt such date should fall on a legal holiday, the annual meeting shall be held on the next succeeding year secular day. Section XII. Regular Meetinqs. Regular meetings may be held at such times and places as may from time to time be determined by resolution of the Housing Authority. Section XIII. Special Meetings The Chairman of the Housing Authority may, when he deems it expedient, and shall, upon the written request of two members of the Authority, call a special meeting of the Authority for the purpose of transacting any business designated in the call. The call for a special meeting may be delivered to each member of the Authority, or may be mailed to the business or home address of each member of the Authority. Section XIV. Notice of Meetings. Each meeting of the Housing Authority shall be legally posted as required by Article 6252--17 V.T.C.S., and the Mayor, ex-officio members and commissioners of the committee shall be notified in writing not less than five (5) days prior to the date of any meeting. Section XV. Quorum.. At all meetings of the Committee, a majority of the members of the Committee shall constitute a quorum for the purpose of transacting business; provided that a smaller number may meet and adjourn to some other time or until a quorum is obtained. Section XVI. Order of Business. At the regular meetings of the Committee, the following shall be the order of business: (1) Roll Call (2) Reading and Approval of the Minutes of the Previous Meeting (3) Bills and Communications (4) Report of the Secretary (5) Reports of Committee (6) Unfinished Business (7) New Business (8) Adjournment All resolutions shall be in writing and shall be copied in a journal of the proceedings of the Committee. Section XVII. Manner of voting. The voting on all questions coming before the Committee shall be by roll call, and the "yeas" and "nays~' shall be entered upon the minutes of such meeting. Section XVIII. Severance Clause. Should any section, paragraph~, sentence, clause, phrase Or word of this ordinance be declared unconstitutional or invali~ for any reason, the remainder of this ordinance shall not be affected thereby. AND~IT IS THEREFORE ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW: That on a motion by Alderman Browning, seconded by Alderman Woods, Ordinance No. 78-2295 was read in full and adopted this date and introduced on first reading this the 5th day of December, 1978. That on a motion by Alderman Woods, seconded by Alderman SoRelle, Ordinance No. 78-2295 was read by caption and adopted by th~ City Council on second and final reading this the 12th ~day of December, 1978.
