AN ORDINANCE AMENDING SECTION FOUR (4), ORDINANCE NO.
73-1311 OF THE CITY OF PLAINVIEW, TEXAS, PROVIDING FOR
THE APPOINTMENT, TERM OF OFFICE, NOTICE OF MEETINGS AND
ATTENDANCE REQUIREMENTS OF ALL MEMBERS OF THE HIGHER
EDUCATION AUTHORITY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS:
That Section 4, Ordinance No. 73-1311 of the Higher Educa-
tion Authority for the City of Plainview, Texas, is hereby
amended to read as follows:
SECTION 4
(a) APPOINTMENT The member of the High Education
Authority for the City of Plainview, Texas, shall be
appointed by %he City Council. Four (4) members of the
Authority shall be appointed beginning January 1 in odd
numbered years and five (5) members of the Authority shall
be appointed beginning January 1 in even numbered years.
No person shall serve more than two (2) full successive
terms as a member of the Authority. Any term of office of
any member of the Authority expiring other than on December
31 in any year shall be filled[ by appointment by the City
Council until December 31 of that year. Each member of the
Authority shall serve for a term of two (2) years.
(b) TE~4 Ail members appointed shall not, at the
time of appointment or during their term of office, serve
on any other authority, board,, commission or committee of
the City of Plainview. All members appointed shall be
residents of the City of Plainview at the time of their
appointment and during their term of office.
(c) NOTICE OF MEETINGS Each meeting of the
Authority shall be legally posted as required by Article
6252-17 V.T.C.S. and the Mayor, Ex-Officio members and
members of the Board shall be notified in writing, not
less than five (5) days prior to the date of any meeting.
(d) MANDATORY ATTENDANCE REQUIREMENTS Each member
of the Authority shall attend no less than seventy-five
percent (75%) of the regular, special or emergency meetings
called by the officiers of the Authority. The secretary
of the Authority shall make a quarterly report to the Mayor
and City Council showing the attendance of each member of
the Board. Any representative failing to attend seventy-
five percent (75%) of the regular, special or emergency
meetings legally called during any calendar year shall be
automatically disqualified for service on the Authority
and shall be replaced by the City Council.
(E) VACATION OF OFFICE Should any member of the
Board move from the City or otherwise become disqualified
for any other reason, he shall vacate the office.
(F) FILLING VACANCIES Vacancies occurring in the
membership of the Board shall be filled by appointment for
unexpired term.
SEVERANCE CLAUSE: That should any section, paragraph,
sentence, clause, phrase or word of this Ordinance be declared
unconstitutional or invalid for any reason, the remainder of
this ordinance shall not be affected thereby.
~ND IT IS THEREFORE ORDAINED BY THE CITY COUNCIL OF THE
C][TY OF PLAINVIEW:
That on a motion by Alderman Woods, seconded by Alderman
SoRelle, Ordinance No. 78-2296 was read in full and adopted
this date and introduced on first ]reading this the 5th day of
December, 1978.
That on a motion by Alderman SoRelle, seconded by Alderman
Almon, Ordinance No. 78-2296 was read by caption and adopted by
the City Council on second and final reading this the 12th
day of December, 1978.
