AN ORDINANCE OF THE CITY OF PLAINVIEW, TEXAS, RETAINING THE
TAXES IMPOSED BY THE LOCAL SALES AND USE TAX ACT (ARTICLE 1066c,
VERNON'S TEXAS CIVIL STATUTES) ON THE SALE AND DISTRIBUTION OF
GAS AND ELECTRICITY FOR RESIDENTIAL USE IN SAID CITY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS:
Section 1. The City Council of Plainview, Texas, by majority
vote of its governing body, hereby votes to retain the taxes
authorized by the LoCal Sales and Use 'Fax Act (Article 1066¢,
Vernon's Texas Civil Statutes) on the receipts from the sale,
production, distribution, lease, or rental of, and the use,
storage, or other consumption of gas and electricity for
residential use, as authorized by Section 6 of House Bill No. l,
Acts 1978, 65th Legislature, Second Called Session.
Section 2. SEVERANCE CLAUSE: That should any section, paragraph,
sentence, clause, phrase or work of this ordinance be declared un,
constitutional or invalid for any reason, the remainder of this
ordinance shall not be affected there~.
That the City Secretary is hereby authorized to cause publication of
this ordinance in the Plainview Daily Herald in accordance ~ith Article
13, Section lO1 of the City Charter of the City of Plainview.
