HomeMy WebLinkAbout80-2419 ordORDINANCE NO. 80-2419 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 77-2090 AND THE OFFICIAL ZONING MAP OF THE CITY OF PLAINVIEW SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 437: Request of Higginbotham Bartlett Co., by E. M. Osborne, for rezoning a 44.134 acre tract of land out of the South Central part of Survey No. 27, Block JK-2, Hale County, Texas, same being located in 1000-1100-1200 blocks of 1-27 North, CITY OF PLAINVIEW, HALE COUNTY, TEXAS, FROM (PLANNED DEVELOPMENT) ZONING DISTRICT. R-l, R-.3, and C-1 ZONE TO A P. D. WHEREAS, the prooosed change in Zoning Districts as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council, and after due consideration, the City Council of the City of Plainview finds that for the orderly growth of the City making the proposed change as hereinafter set out will be in the public interest which creates an emer- gency; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zon- ing Ordinance and Map, have been fully complied with, as well as giving notices pro- vided by Article lOllF Vernon's Annotated Civil Statutes-Amended, 1953, and notice was duly published in the Plainview Daily Herald more than fifteen (15) days prior to the date of the Public Hearing according to said notice was duly held in the City Council Room of the City Hall, Plainview, Texas, at which time persons appeared in support of the proposal; and. after said hearing, it was by the City Council deter- mined that it would be in the public interest due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance; NOW, THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW: SECTION 1. That Ordinance No. 77-2090 and the Official Zoning Map be and the same are hereby amended as follows, to wit: ZONE CASE NO. 437: Change a 44.134 tract of land out of the South Central part of Survey No. 27, Block JK-2, Hale County, Texas, same being located in 1000-1100-1200 Blocks of 1-27 North, as described below: BEGINNING at a point in the east line of the West one-half of Survey No. 27, Block JK-2, Hale County, Texas, said point being N.O°OO'30,E. 30.0 feet from a 1 inch pipe found for the S. E. corner of the West one-half of said survey; THENCE S.89°58'09"W. 566.32 feet along the north right of way line of West 10th Street as dedicated in Vol. 474, page 279 of the Hale County Deed Records, to a steel rod for its N.W. corner; THENCE S.O°O9'O9"W. 30.0 feet along the west line of said street to a steel rod in the s'outh line of said survey, and the north line of Duncan Addition, Unit No. 2 as recorded in Vol. 633, page 671 of the Hale County Deed Records; THENCE S.89°58'O9"W. 468.81 feet along the south line of said survey, and the north line of said addition ~o a 3/8 inch steel' rod; THENCE N.63°O4'39"W. 154.53 feet continuing along the north line of said addition to a 3/8 inch steel rod; THENCE N.70°O9'W. 47.38 feet continuing along the north line of said addition to a 3/8 inch steel rod set in the centerline of Mesa Drive for the S. W. corner of a 16.397 acre tract as recorded in Vol. 655, page 389 of the Hale County Deed Records; THENCE N.O°OO'30"E. 1,439.57 feet along the west line of said 16.397 acre tract to a 5/8 inch steel rod; THENCE N.89°58'O9"E. 881.26 feet to a 5/8 inch steel rod set for the S.W. corner of 6.47 acre tract as recorded'in Vol. 476, page 207 of the Hale County.Deed Records; THENCE S.89°51'E. along the south line of said 6.47 acre tract, at 336.29 feet passing the S.E~ corner of said tract and the east line of the West~one-half of said survey, in all 400.~0 feet to a 5/8 inch steel rod at'a point of curvature in the west right of way line of Interstate Highway--No. 27, as recorded in Vol. 361, page 3 of the Hale County Deed Records; THENCE S.O°O9'OO"W. 1,222.23 feet along said right of way line to a 5/8 inch steel rod set for a point of intersection; THENCE S.3°35'W. 272.82 feet continuing along said right of way line to a 5/8 inch steel rod set at' the intersection of the north right of way line of West 10th Street; THENCE S.89°58'O9"W 43.68 feet along the north line of West 10th Street to the POINT OF BEGINNING and containing 44.134 acres, City of Plainview, Hale County, Texas, from a R-l, R-3, and C-1 ZONE to a P.D. (PLANNED DEVELOPMENT)ZONING DISTRICT. From date of this Ordinance, said lot, tract, and parcel of land described shall be~and hereby be changed to the Zoning District indicated and the Official Map is amended in accordance herewith. SECTION 2. Upon passage of this Ordinance on first reading, the City Secretary be and is hereby authorized and directed to cause to have published in the Plainview Daily Herald, a daily newspaper of general circulation in the City of Plainview, Texas, a notice that a public hearing wil be held in the Council Chamber of the City Hall in Plainview, Texas, at 7:30 O'clock P.M., on the 28th day of OCTOBER , 19 80 , to permit the public to be heard prior to consideration of this Ordinance for second and final reading, said publication to be made more than fifteen (15) days prior to the time designated for such public hearing. PASSED ~ON first reading this, the l!~th 19 80 . day of OCTOBER , A notice of time and place where and when said Ordinance would be given a public hearing and considered for final passage was published in the Plainview Daily Herald, a daily newspaper of general circulation in the~City of Plainview, said publication being on the 6th day of OCTOBER , 19 80 , the same being more than fifteen (15) days prior to the time designated for said hearing After such opportunity for the public to be heard, said Ordinance was passed on the second and final reading.
