AN ORDINANCE PRESCRIBING THE SPEED LIMIT ON PORTIONS OF
F. M. 400 (SOUTH DATE STREET) WITHIN THE CITY LIMITS OF
THE CITY OF PLAINVIEW, HALE COUNTY; REPEALING ALL ORDI-
NANCES IN CONFLICT HEREWITH AND PRESCRIBING A PENALTY
FOR THE VIOLATION OF THIS ORDINANCE.
WHEREAS, after an engineering and traffic investigation, the City
Council of the City of Plainview finds that circumstances are such that
the maximum reasonable and safe speed for the operation of vehicles under
conditions found to exist on South Date Street in the City of Plainview,
is as prescribed by the Ordinance hereinafter enacted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PLAINVIEW:
SECTION 1: The speed limit on South Date Street in the City of
Plainview, Texas, at locations hereinafter designated shall be as follows:
(a.) The maximum legal speed limit on South Date Street (F.M. 400)
for southbound traffic only shall be 40 MPH 'From the point of intersection
with the centerline of E.. 5th Street (U.S. 70) to the point of intersection
with the centerline of E. 2nd Street, a distance of 0.272 mile; thence
45 MPH for a distance of 0.844 mile to a point 0.055 mile south of the
point of intersection with the centerline of Oak Street to the West;
thence 50 MPH 'for a distance of 0.200 mile; thence 55 MPH for a distance
of 0.250 mile 'to the point

SECTION 2. It shall be unlawful for any person to operate a motor
vehicle which is self-propelled, or automobile or motor cycle on the
above designated portion of South Date Street in the City of Plainview,
at a speed greater than that which is hereinabove designated in Section 1
of this Ordinance as the maximum speed limit..
SECTION 3. All Ordinances and Parts of Ordinances in conflict with
the provisions of this Ordinance shall be hereby repealed.
SECTION 4. Any person who shall violate or fail to comply with the
provisions of this Ordinance shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be punished by a fine of not less than $1.00
and not more than $200.00
