BUILDINGS AND/OR STRUCTURES IN THE CITY OF PLAINVIEW. TEXAS: PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES. THEREFOR; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; DECLARING AND ESTABLISHING FIRE ZONES: REPEALING ORDINANCE NO. 77-2169 OF THE CITY OF PLAINVIEW, AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. PROVIDING FOR THE ADOPTION'OF THE t979 EDITION OF TltE UNIFORM BUILDING CODE, VOLUME l, AS. COPYRIGHTED in 1979.BY THE- INTERNATIONAL CONFERENCE OF BUILDING OFF. ICIALS, WHITTIER,.-CALIFORNtA~ WITH CERTAIN AMENDMENTS THERETO: DIRECTING PUBLICATION OF THE DESCRIP- TIVE CAPTION OF THIS ORDINANCE, WITH THE PENALTY PROVISIONS OF THE UNIFORM BUILDING CODE 1979 EDITION AND PROVIDING AN-EFFECTIVE DATE OF THIS ORDINANCE. ~ WHEREAS, the City Council of the City of Plainview has'found'tha~ the present Building Code of the City of Plainview Nas become obsolete; and, ' - WHEREAS, the City Council appointed the Building Code Board of=, Appeals to prepare recommendations for the City Council in regard to a new Building Code; and, .. WHEREAS, the Building Code Board of Appeals recommends-the Uniform Building Code, 1979 Edition, with certain amendments thereto; be adopted as the Building Code of the City of Plainvie~;. NOW THEREFORE: ' BE IT ORDAINED BY THE CITY COUNCIL.OF 'THE CITY OF'PLAINVIEW,. TEXAS: SECTION 1. That the Uniform Building Code,' 1976 Edition '(being Ordinance No. 77-2169 of the City.of Plaitaview) be, and the same is hereby repealed... SECI'ION 2- That the 1979 Edition of the Uniform Building Code, Volume l, as copyrighted in 1979, by the International Conference of Building Officials, Whittier, California, as hereinafter amended is specifically adopted as the Building Code of the City of Plainview, Texas, and a copy is attached hereto and incorporated herein by reference as though set out completely in detail. A copy of said Uniform Building Code. shall be filed with 'the City Secretary and a copy maintained in the office of the Building Official of the City of Plainview, Texas, all such copies to be open to public inspection during business hours of the offices where they-are maimtained, with the following amendments thereto; SECTION 3: That-Chapter'2, Section 205, of the" ' , Uniform Building Code" 1979 Edition, shall be and the. same is hereby amended ky the addition thereto of a new paragraph which shall read as fol 1 ows: "Any person, firm, or corporation violating any of the pro- visions of this Code shall be deemed guilty of a ~isdem~.aoor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof' during which any violation of any of the provisions of this Code is committed, continued, or permitted,-and upon convictio~ of any' such violation such person shall be punishable by, a fine of not more than $200.00". SECTION 4: That Section 302 (B), Chapten 3 of the "Uniform Buildi~§ (]ode", 1979 Edition, shall be and the same is hereby amended. to read:. Plans and Specifications. With'each application for a build- in§ permit, and when required by the Building Official for enforcement of any provisions of this Code, ~o-sets of plans and specifications shall be submitted. The' Building Official shat. 1 require plans and specifications to be prepared and designed 6y an engineer or architect licensed by ~he State to practice as such. EXCEPTION: The building official.may waive the submission of plans, calculations, etc., if he fin~s.the ~ature o~ the work applied for is such that reviewing of plans is not necessary to obtain compliance, with th~s code. -2- SECTION '5: That Section 303, Chapter'3, Table 3-A, of the "Uniform Building Code", 1979 Edition, shall read as follo~vs- (A) Any person desiring a building permit shall at the time of filing an application therefore, as provided in Section 301 of this Code, pay' to the Building Official a fee as required in this Section- Building permit fees shall be as set.out by separate ordinance. There shall be no charge for first re-inspection of new buildings and additions or alterations of old buildings., and when more than one re-inspection per permit is're- quired, a re-inspection fee of $5.00 for each additional re-inspection shall be charged. The re-inspection fee must be paid at the City Hall before a further inspection will be made. (B) Plan checking fees. Whenever a plan is requi~ed to' be submitted by sub-section (c), of Section 301, of the Uniform Building Code, adopted in Section 2 of this ordinance, a plan checking fee shall be paid to the Build- ing Official at the time of submitting the plans and speci- fications for checking. Said plan checking fee shall 'be equal to one-half of the building permit fee as 'set forth in Table 3-A. ' - ~ SECTION 6: That Chapter 3 of the Uniform Building Code, '1979 Edition is he,reby amended by deleting Section 307 and adding there- to a section to be known as Section 307.to read as follows: SECTION 307: (A) No person or persons shall hereafter move any building, house or structure.within the limits of the City of Plainview, Texas, where the same shall be moved in, through or upon the streets, alleYs, avenues, or public grounds unless said person 'shall, before moving said build- ing, house or structure secure a permit to do so from Building Official of the City of Plainview, Texas. (B) No person or persons shall hereafter move any be-ild- ing or structure from 'within or from outside the city limits of the City of Pla. inview, Texas, to any place within the city limits of the City of Plainview, Texas, or cause the same to be done, without first obtaining a separate build- ing permit for each building or structure from the Building Official of the City of Plainview, Texas. -3- SECTION 7: SECTION 8: (C) Whenever any person or persons shal. t file an application for a building permit for a building or structu're which is to be moved frot~ outside the city limits of the City of Plainview to a place inside the city limits, the said person shall deposit with the Building Official a sum of money equal to Twenty Cents (20¢) per mile for each mile necessary to travel from the city limits of Plainview to the building and return to the city limits of the City of Ptainview, plus a sum of money equal to the sum of Eight and -- No/lO0 Dollars ($8.00) per hour based upon the Build- ing Official's estimated time required to ma~: the inspection and in traveling to said building and return- ing to the city limits of the City of Plainview. Said deposit shall become the property of the City. of Pla.inview and is to pay for the extra expense in inspecting said building and shall not be returned to the person making application regardless of whether or not the building permit is issued. Such payment shall be in addition to_ the regular fees required for 'issuing a builcting permit as set out, and prescribed in Table No; 3-A of Section 3 of' the "Uniform Building Code", 1979 Edition as amended. (D) The Building Official may designate a-competent deputy to make such inspection for h. im, who shatt~ in such event, be paid the sum-of Twenty Cent_s (20¢) per mile for travel outside the city limits of t~ City of. That Chapter 5, Section 503(D) of t~e "Uniform Building Code", 1979 Edition, shall be and the same is '-hereby amended by the addition thereto of a new paragraph which shall read as follows: Ex~p~, , Occupancy Group R bu$1dlings with an attached garage and in Fire Zone No. 3 shall not be required to have one hour fire resistive separaition between the garage, an~ living quarters". - That Chapter 16, Section-160t(A) ~ha. ll i~c!ude the follow- ing paragraph to read as follows: -. That the entire incorporated area-of the City of Plainv~ew is herebY declared to be and is. hereby established as a fire district, and said fire distri.ct shall be known and designated as Fire Zone l, 2, and 3, and each such zone shall include such territory and portions of the City of Plainview as follows: ZONE I shall include the territory as set out. and described 'by metes and bounds as Zone 1 under-Chapter 9, Article 1, Section 9.1(a) of the Municipal Code of the City of Plain- view, as adopted 1978. ZONE 2 shall include the territory as set out and described ~y metes and bounds as Zone 2 under Chapter 9, Article l, Section 9.1(b) of Municipal Code, City of Plain¥iew,~as adopted 1978. It shall also include all commercial property and buildings now existin9, and all property that may be zoned for commercial use. ZONE 3 shall include all of the-territory within, the c~ty limits of-the City of Plainview, not included, in ZOne and 2. SECTION Said Zone l, 2, and 3 of the City-of.' ?~la~nview are. hereby adopted as the fire zones of "the city of Plainview, for the publication of the regulations included in the sa.id- "Uniform Building Code", 1979 Edition. SECTION ll: Section 2903(A) of Chapter 29 of the "Uniform Bu~ilding Code", 1979 Edition shall be amdended to include a new ~able to be designated as Table 29A-t, and to read hereafter' as follows: SECTION 2903(A) General. The classification of the soil under all portions of every building shall be ba~sed upon the examination of ade§uate test borings or excavati-~g made at the site when required by the Building Offi. cial. The location of the test borings or excavations and ~the nature o~ the sub-surface materials shall be indicated on the glans. EXCEPTION: Design criteria for foundation 'and ~ootings'~n one and two story building housing groups R-3 and M-.~ Occupancies, Type V Construction, where en§ineering design is'. nmt rprov~ded shall be set for in Tables 29-A and 29A-1. Section 2903(A) of Chapter 29 of the "Uniform Building Code", 1979 Edition shall be amdended to include a new Table to be designated as Table 29A-l, and to read hereafter as follows: SECTION 2903(A) General. I - - ' I ~ CON~ STEM FO~ 'SLAB SECTION 12- SECTION 13: SECTION 14' That Section 2907(A) of Chapter 29 of the "Uniform Building Code", 1979 Edition shall be amended to read hereafter as follows: (A) General. Footings and Foundations, unless other- wise specificially provided, shal'l be constructed of solid masonry or concrete and shall be in all cases extend below the front line..Foun~dation walls support- ing wood shall extend at least eig~qt inches (8") above the finish grade adjacent to the v~ll at all points. Mortar used in foundation walls amd footings, shall be as specified in Section 2403(T). Severability Clause. If any provisions of tNis Ordinance or of the Code hereby adopted or t~e application thereof to any person or circumstance, is held invalic~, the re- mainder of the Code, and t'he application of such pro-.-- visions to other persons or circum,~tances,, sNall not b.e affected thereby. The City Secretary is hereby authoriz6d and ~irected to cause the publication of the descriptive Cap~fcion of this Ordinance together with the penalty provisioms as provided herein.
