WHEREAS, a public hearing before the City Council of the City of Ptainview, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of the following described territory: Being a 10.612 acre tract out of the S.W. part of survey No. 28, Block JK-2, Haile County, Texas: BEGINNING at a spike for the S.E. corner of West- ridge Park Addition, Unit Mo. 2, as recorded in Volume 592, Page 501 of the Hale County Deed Records, said spike being 1639.34 feet S. 89057' E. and 820 feet N. 10°10' E. of the S.W. corner of Survey No. 28, Block JK-2, Hale County, Texas, said spike also being 293.03 feet S. 89°55'30'' E. and 500 feet S. 0~10' W. of a 2 inch pipe in concrete for a control monument at the N.W. corner of Lot 39, of said Unit No. 2; ..... THENCE along the boundary of said Unit No. 2, as follows: N. 89o55'36'' W. 37.5 feet; N. 0°10' E. 91.55 feet; N. 89055'36'' W. 454.86 feet; N. 0°04'24" E. 140.0 feet to the S.E~ corner of Westridge Park No. 3, as recorded in Volume 610, page 691 of the Hale County Deed Records; THENCE N. 89o55'36'' W. 300.0 feet along the south line of said Unit No. 3 to a point; THENCE S. 0°04'24"~W. ].20~.0~feet~o,a point; THENCE N. 89o55'36'' W. 180.0 feet to a point; THENCE S. 0o04'24'' W. 340.0 feet to a point; THENCE S. 89°55'36'' E. 300.0 feet to a point; THENCE S. 0o04'24'' W. 320.0 feet to a point; THENCE S. 89o55'36'' E. 340.0 feet to a point; THENCE N. 0°04'24'' E. 300.0 feet to a point; THENCE N. 45o04'24'' E. 28.28 feet to a point; THENCE S. 89o55'36'' E. 311.84 feet to a point in the east line of a 21.323 acre tract as recorded in Volume 668, Page 445 of the Hale County Deed Records; THENCE N. 0°10' E. 228.45 feet along the east line of said tract to the POINT OF BEGINNING and containing 10.612 acres. trHEREAS, said hearing being held at the City Council Chambers of the City of Plainview on the 2~h day of March , 1981 A.D., which'~date~is not more than twenty days nor less than ten days ~ior to the institution of annexation proceedings; and WHEREAS, Notice of such Public Hearing was published in a newspaper having general circulation in the City of SECTION 1: Plainview, Texas, and in the above described territory on the 6th day of March , 1981 A.D., which date is not more than-twenty days 'nor less than ten days prior to the public hearing on the topic of annexation proceedings; and WHEREAS, the population of the Cit~y of Plainview, Texas is approximately 25,000 inhabitants; and WHEREAS, the above described territory lies within the extra- territorial jurisdiction of the City of Plainview, Texas; and WHEREAS, the territory above described lies adjacent to and adjoins the City of Plainview, Texas; and WHEREAS, the territory above described contains 10.612 acres; and WHEREAS, a petition has been signed and acknowledged by the owners of ali_ of the landdin the above described territory requesting the annexation of such territory by the City of Plainview, Texas~ and such petition has been filed with the City Council of the City of Plainview, Texas; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAIN-VIEW, TE>~.S: The following described land and territory lying adjacent to and adjoining with the City of Plainview, Texas, is hereby added and annexed to the City of Plainview, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Plainview, Texas, and the present boundary limits of such city, at the various points contiguous to the area hereinafter described, are hereby altered and amended so as to include said area within the corporate limits of the City of Plainview, Texas, to-wit: A~10.612 acre tract out. of the S.W. part of survey No. 28, Block JK-2, Hale County, Texas; BEGIk~ING at a spike for the S.E. corner of Westridge Park Addition, Unit No. 2, as recorded in Volume 592, Page 501 of the Hale County Deed Records, said spike being 1639.34 feet S. 89°57'E. and 820 feet N. 10°10'E of the S.W. corner of Survey No. 28, Block JK-2, Hale County, Texas, said spike also being 293.03 feet S. 89o55'30'' E. and 500 feet S. 0°10' W of a 2 inch pipe in concrete for a control monument at the N.W. corner of Lot SECTIONf 2: SECTION 3: No. 39, of said Unit No. 2; THENCE along the bounda~ry of said Unit No. 2, as follows: N. 89°55'36~' W. 37.5 feet; N. 0°10' E. 91.55 feet; N. 89055'36'' W. 454.86 feet; N. 0o04'24'' E. 140.0 feet to the S.E. corner of Westridge Park No. 3,as recorded in Volume 610, page 691 of the Hale County Deed Records; THENCE N. 89o55'36'' W. 300.0 feet along the south line of said Unit No. 3 to a point; THENCE S. 0o04'24'' W. 120.0 feet to a point; THENCE N. 89o55'36'' W. 180.0 feet to a point; THENCE S. 0o04'24'' W. 340.0 feet to a point; THENCE S. 89o55'36'' E. 300.0 feet to a point; THENCE S. 0o04'24'' W THENCE S. 89o55'36'' E THENCE N. 0o04'24'' E THENCE N. 45o04'24'' E THENCE S. 89o55'36'' E the east line of a 21 323 acre tract as recorded 320.0 feet to a point; 340.0 feet to a point; 300.0 feet to a point; 28.28 feet to a point; 311.84 feet to a point in in Volume 668, Page 445 of the Hale County Deed Records; THENCE N. 0°10' E. 228.45 feet along the east line of said tract to the POINT OF BEGINNING and containing 10.612 acres. The above described territory and the area so annexed shall be a part of the City of Plainview, Texas, .and the property so added shall bear its pro mata part of the taxes levied by the City of Plainview, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all of the citizens and shall be bound by the acts, ordinances, and regulations of the City of Plainview, Texas. This ordinance shall be published and passed in the manner provided by the Charter of the City of Plainview, Texas. PASSED AND APPROVED this the 10th day of March , 1981 A.D. Tihe herein described land is vacant property without residents, said territory being contiguous to and adjacent with the present boundary of the corporate city limits of the municipal corporation of Plainview, Hale County, Texas. Said land is less than one-half (1/2) !mile in width, and is physically located within the extra- territorial jurisdiction of the municipal corporation of Plainview, Texas, with no other incorporated city having any extra-territorial jurisdiction over the subject property, or any portion of the subject proper ty. II. The land subject to this-petition consists of 10.612 acres and is more fully described in "Exhibit A" attached. III. NOW WHEREFORE, PREMISES CONSIDERED, the below-named persons, being the owners of all such land described herein which lies adja- cent to and adjoins the city limits of Plainview, Texas, a munici- pal corporation duly organized under the Home Rule Amendment (Texas Constitution, Article XI, Section 5) and its enabling Act (Texas Revised Statutes, Article 1165) and located in the County of Hale, State of Texas, hereby request your Honorable body to extend the present city limits so as to include said herein described terri- tory as part of the City of Plainview, Texas. IV. We, each of us, and in our individual capacity and as owners of herein tract of property, pursuant to Texas Revised Statutes, Article 974g, hereby requests such annexation by fixing our signatures hereto and hereby acknowledge such request for annexaction.
