D. Cartwright for rezoning a tract of land, from an R-1 Zone to a "M-H" Mobile Home Park Zone, located on the West side of Quincy in the 3400 Block, property being described as follows: Being a 19.78 acre tract out of the South half of the Northeast Quarter of Survey No. 35, Block JK-2, Plainview, Hale County, Texas: BEGINNING at a point 37.5 feet S.89°55'20"W, and 300.0 feet S.O 02'40"W. of the N.E. corner of the South half of the Northeast Quarter of Survey No. 35, Block JK-2, Hale County, Texas; Thence S.89°55'20"W. 460,0 feet to the S~W. corner of a tract conveyed to the City of Plainview as recorded in Volume 490, Page 227 of the Hale County Deed Records; Thence N.O°O2'40"E. 300.0 feet to a 3/8 inch steel rod for the N.W. corner of said tract; Thence S.89°55'20"W. 365.0 feet along the north line of the South half of the Northeast Quarter of said Survey to a point; Thence South 64.64 feet to a point; Thence S.45°W. 972.0 feet, parallel and 220.0 feet south- easterly of the southeasterly right of way line of Interstate Highway No. 27 to a point; Thence S.45°E. 80.0 feet to a point; Thence South 105.32 feet to a point; Thence East 1455,03 feet to a point; Thence N.O°O2'40"E. 50.0 feet along a line parallel and 37.5 feet west of the east line of said Survey to a point; Thence West 180.0 feet to a point; Thence N.O°O2'40"E. 524.71 feet to a point; Thence N.89°55'20"E. 180.0 feet to a point; Thence N.O°O2'40"E. 40.0 feet to the POINT OF BEGINNING and containing 19.78 acres. CITY OF PLAINVIEW, HALE COUNTY, TEXAS, FROM R-1 "RESIDENTIAL" M-H "MOBILE HOME PARK"ZONING DISTRICT. TO A WHEREAS, the proposed change in Zoning Districts as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council, and after due consideration, the City Council of the City of Plainview finds that for the orderly growth of the City making the proposed change as hereinfaterset out will be in the public interest which creates an emergency; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map, have been fully complied with, as well as giving notices provided by Article IOI.IF Vernon's Annotated Civil Statu~es-Amended, 1953, and notice was duly published in the Pla~nview Daily Herald more than fifteen (15) days prior to the da%e of the Public Hearing according to said notice was duly held in the City COuncil Room of the City Hall, Plainview, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined Ghat it would be in the public interest due to.changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance; NON, THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW: SECTION 1. That Ordinance No. 77-2090 and the Official Zoning Map be and the same are hereby amended as follows, to-wit: ZONE CASE NO. 447 : Request of Lon D. Cartwright for rezoning a tract of land, from an .R,1 Zone to a '!M-H" Mobile. Home Park Zone, located on the West side of Quincy in the 3400 Block, property being.described as follows: Being a 19.78 acre tract out of the South half of the Northeast Quarter of Survey' No. 35, Block JK~2, Plainview, Hale County, Texas: BEGINNING at a point 37.5 feet S.89 55'20"W. and 300.0 feet S. 0°02'40"W. of the N.E. corner of the South half of the Northeast Quarter of Survey No. 35, BloCk JK-2, Hale County, Texas; Thence S.89°55'20"W. 460.0 feet to the $~W. corner of a tract conveyed to the City of Plainview as recorded in Volume 490, Page 227 of the Hale County Deed Records; Thence N.O°O2'40"E. 300.0 feet to a 3/8 inch steel rod for the N.W. corner of said tract; Thence S.89°55!20"W. 365.0 feet along the north line of the South half of the Northeast Quarter of said Survey to a point; Thence South 64.64 feet to a point; Thence S.4~5°W. 972.0 feet parallel and 220.0 feet south- easterly of the southeasterly right of way line of Interstate Highway No. 27 to a point; Thence S.45°E. 80.0 feet to a point; Thence South 105.32 feet to a point; Thence East 4155.03 feet to a point; Thence N.O°O2'40"E. 50.0 feet along a line parallel and 37.5 feet west of the east line of said Survey to a point; Thence West 180.0 feet to a point; Thence N.O°O2'40"E. 524.71 feet to a point; Thence N.89°55'20"E. 180.0 feet to a point; Thence N.O°O2'40"E, 40.0 feet to the POINT OF BEGINNING and containing 19.78 acres. City of Plainview, Hale County, Texas, from an R-1 to a M-H Zoning District. From th~date of th~s Ordi'h'~nce, said lot, tract, and parcel of land described shall be and hereby be changed to the Zoning District indicated and the official Map is amended in accordance herewith. SECTION 2. Upon passage of this Ordinance on first reading, the C~ty Secretary be and is hereby authorized and directed to cause to have published in the Plainview Daily Herald, a daily newspaper of general circulation in the City of Plainview, Texas, a notice that a public hearing shall be held in the Council Chamber of the City Hall in Plainview, Texas, at ?:30 o'clock p.. m. on 23rd day of June L,~1981 to permit the public to be heard prior to consideration Of' this-Ordinance for second and final read- ing, said publication to be made more than fifteen (15) days prior to the time designated for such public hearing. PASSED on first reading this, the 9th day of June , 1981. A notice of time and place where and when said Ordinance would be given a public hearing and considered for final passage was published in the Plainview Daily Herald, a daily newspaper of general circulation in the City of Plainview, Texas, said publication being on the 7th day of June , 1981, the same being more than fifteen (15') days prior to the time desi§nated for said hearing. After such opportunity for the public to be heard, said Ordinance was passed on second and final reading. 1981. PASSED on second and final reading this, the 23~d day of June ATTEST: W~l'ter S.
