AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF PLAINVIEW, TEXAS, CLOSING AN
ALLEY WHICH RUNS NORTH AND SOUTH BETWEEN LOTS
3 THROUGH 14, AND 15 THROUGH 23, LYING EAST OF
THE RAILROAD RIGHT-OF-WAY, IN BLOCK 9, NOB
HILL ADDITION TO THE TOWN OF PLAINVIEW, HALE
COUNTY, TEXAS.
WHEREAS, application has been made to close the alley
described below, said alley having been created by Dedication
Deed executed by Hugh McClelland and wife, Prudie R. McClelland,
dated January 30, 1907, of record in Book 14, Page 368, Deed
Records of Hale County, Texas.
WHEREAS, the City Council finds that the alley is not
now being used, for any purpose and that it is not being used for
any utility purpose and has not been opened as an alley for many
years, and that it would be in the best interest for all the
citizens of Plainview to close said alley.
WHEREAS, all utility companies having any rights to said
alley have consented to the closing and abandonment of the alley.
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF PLAINVIEW, TEXAS:
SECTION 1: That the alley which runs North and South between
Lots 3 through 14, and 15 through 23~ lying East of the railroad
right-of-way, all in Block 9, Nob Hill Addition to the Town of
Plainview, Hale County, Texas, described by metes and bounds as
follows:
BEGINNING at the Southwest Corner of Lot
14, Block 9, Nob Hill Addition to the
Town of Plainview, Hale County, Texas;
THENCE North along the West boundary of
Lots 3 through 14, Block 9, Nob Hill
Addition to the Town of Plainview, Hale
CoUnty, Texas, to a point which inter-
sects with the East boundary line of the
Atchison, Topeka, and Santa Fe Railway
Co. right-of-way;
THENCE in a Southwesterly direction along
the East boundary of said Atchison,
Topeka, and Santa Fe Railway Co.. right-
of-way until said line intersects with
Lot 23, Block 9, Nob Hill Addition to the
Town of Plainview, Hale County, Texas;
THENCE South along the East boundary of
Lots 15 through 23, Block 9, Nob Hill
Addition to the Town of Plainview, Hale
County, Texas, to the Southeast corner of
Lot 15, Block 9, Nob Hill Addition to the
Town of Plainview, Hale County, Texas;
THENCE East 20 feet to the PLACE OF
BEGINNING.

SECTION 2: The City Council finds that it is in the best
interest of the public to close and abandon said alley.
SECTION 3: That said alley as described in Section 1 above
shall no longer be used as a public thorough fare or as an open
alley and shall no longer be designated as an alley, and the
owners of the property contiguous to the alley set out and
described in Section 1 hereof may take possession and make use
thereof in accordance with the laws of the State of Texas.
