HomeMy WebLinkAbout82-2505 ordORDINANCE 82-2505 AN ORDINANCE AMENDING ORDINANCE NO. 81-2459 SETTING THE- ~AR~ER :RATES, AND %lqE RATES TO BE CHARC~RD FOR .qEWER SERVICES AND SEWER DISPOSAL SERVICES: THE RATES .TO BE CHARGED FOR THE COLLECTION OF GARBAC~ AND FURNISHING V~.~OR CONTROL SERVICES, PROVIDING THE MANNER OF COLL~ITION OF THE SAID CHARGE, CLASSIFYING ONE-FAMILY RESIDEIqCES AND APARTMENT HOUSES WITH T~D OR MORE FblVIILY AP~~S, A~D CLASSIFYING C05~RRCIAL ESTABLISHMENTS IN ~ CITY OF PIAINVIEW, TEXAS; PROVIDING FOR AN ANNUAL RATE: PROVIDING FOR A UNIFO~ MO~i~ILY SERVICE ~; AND REPEALING ALL ORDI~CES IN CONFLICT BE IT ORDA/ATED BY THE CITY COUNCIL OF ~'.{E CITY OF PIAINVIEW: S~CTION 1: The City of Plainview shall charge and collect, and every consumer of water shall pay, for water furnished by the City to the consumer, the amounts calculated by application of the rates to roster readings as provided in this Ordinance. A. The following are established as the monthly rates to be charged for water furnished by the City of Plainview for all consumers: The City shall make a minimum~y charge of $7.00 for each consun~r using City water. For the minim~ncharge, the City shall furnish to the consun~r up to 3,000 gallons of water per month. For ali water used over and above 3,000 gallons per month, by the consumer, the City shall charge $.515 per 1,000 gallons. B. The charges provided for by this section shall be payable S~CTION 2: The City of Plainview shall have an annual rate which may be accepted, and used by each consummr of water furnished by the City, and shall include sanitation service~ sewer service, and vector control service~ which shall be as follows: A. Each consumer of water electing to take annual rates sb~l 1 pay to the City of Plainview in adw~ce the sum of $318.20 per year. Each consumer electing ~D take annu~l rates and making thepaymant in ad~zance, shall be allowed to use, at no extra cost to him other than the paymmnt of $318.20 the amount of 200,000 gallons of water ]~r year. If the said user of annual rates uses in excess of 200,000 gallons of water per year, he shall pay $.55 ibr each 1,000 gallons of water furnished him in excess of 200,000 gallons, The amount of water used under this rate shall be computed from the meter reading applicable to the month in which the said $318.20 is paid to the City, beginning October 1, 1981 to the meter reading applicable to the ~ month of the succeeding year. SECTION 5: For the furnishing of sew~ service and sewer connections by the City of Plainview, the said[ services shall be charged for by the City of Plainview in accordance with the rates hereinafter established and set out; and the fOllowing are! established as the monthly rates to be charged: A. P~sidential rates: 1. Single Family Dwellings, $7.25 (Mininman); 2. Duplexes, Apartment Houses and P~Doning Houses, First Dwelling Unit, $7.25 )Minimum); Each Additional Dwelling Unit, $7.25. B. For all other comnercial establishn~nts, including hotels, motels, and all other establishments, with the exception of residential dwellings, the rates to be charged for such sewer services shall be as follows: 1. The rates to be charged for such se~er service for c~-t~ercial establishments shall be based upon the '%~ater used per month by said establishment. The monthly rate for emch such establishment using 3,000 gallons of water or less per month sb~ll be 7.25 per month. An additional charge shall be made for sewer se~ice to each establi~t of $ .15 for each 1,000 gallons of water used by said establis~t over and above the first 3,000 gallons of water used by said establistm~nt. The monthly cf~rge for the use of sewer for such conm~rcial establishmsnt shall be calculated on the basis of the water meter readings for the montt~ for which the said charge is made. Should there be an establishment, business or cc~nercial, not using City %~ater, or using City water for only a portion of its total water use, then the sewer rates for each such establishment J~7 excess of the minimum rate of $7.25 per month shall be based upon the estimated gallons of watea: used by said establishment, the same to be arrived at on a basis %hat is reasoD~tble and fair to said business or con~nercial establishment and to the City. SECTION 6: The collection and removal of garbage and trash frcm houses, buildings and premises used for residential purposes shall be classified as Class 1. A. Under Class 1, collections of garbage & trash shall be made each week, provided that such collections are non prevented by weather conditions, or by the conditions of alleys and streets due to rain or weather conditions, and further provided that such collection not prevented by conditions beyond the control of the City Council or the Mayor of the City of Plainview. 1. R~sidential houses are further hereby classified as follows: a) Class 1-A One-family residences. b) Class 1-B Apartment houses with two or more dwelling units. B. The garbage collection provided for in this Section shall be made by the City of Plainview, and monthly charges for this residential service shall be made as follows: 1. For garbage collection for Class 1-A residences, there shall be made a ch~urge of $6.00 per mon'th. 2. For garbage collection for Class 1-B residences, there shall be made a charge of $6.00 per month for each apartment. C. The collection and re~Dval of garbage and trash from houses, buildings and premises, used for commercial and business purposes shall be classified as Class II. 1. Monthly charges for this commercial and business service for the collection of garbage and trash, shall ]~ an are established as follows: a) Mininum charge for shared container (3 cu.yd) $15.00 b) Requested individual 4 cubic yard container $28.50 c) Requested individual 8 cubic yard container $46.50 D. The charges shall be made monthly, and the charges and fees for the collection of garbage shall be added to and placed upon the water bill for each residence and apa~-~-~nt:. The person who is res]~nsible for the payment of the water bill shall also be res].~Dnsible for the payment of the garbage collection fee. E. If the garbage fee is not paid within thirty days after it becc~es due, then the City of Plainview shall refuse to furnish any water to the residences, apartments, or establishments for which such garbage collection fee has not been paid. F. Vector cont-rol involves the aerial and ground spraying of mosquitos. SECTION 8: The charges for the sewer services, garbage collection and vector control shall be made monthly and sl~ll be added to and placed upon the water bill for each residence, apartn~.~nt house and commercial establishment for whom there is a water and s~r connection with the City's water and sewer services. The person who is responsible for the payment of the water bill shall also be responsible for the payment of the charges for sewer services, garbage collection and vector control. SECTION 9: This Ordinance shall be ir~[orce from and after its passage aD~ the Water, Sewer ~ Garbage Collection and Vector Control rates herein established shall take effect and be ch~zrged in the c~mputation for water consumed or used on January 1, 1983 and t~aereafter. SECTION 10: Nothing herein shall be construed as repealing Ordinance No. 81-2459 as amended or any part thereof.
