HomeMy WebLinkAbout85-2581 ord ORDINAPJCE NO. 85-2587 An Ordinance amending Ordinance ~~o. 84-244 1 Adopted May 22, 1984, approving Zone Case N©. 491, and the attached Site Plan, amending Ordinance Plo. 84-2573 adopted December ll, 1984, revising the Site Plan approved as a part of Zone Case No. 491, and approving certain revisions to .the Site Plan, and amending Zoning Ordinance No. 82-2478 and the Official Zoning ~~1ap of the City of Plainview, Texas, and providing for the passing of such Ordinance as an emergency. WHEREAS, D4+IC, Inc, has requested a change in Permissable Building Area as shown. on the Site Plan approved December 11, 1984 in order to accomodate changes in prospective tenants construction .plans, and WHEREAS, the City Council has determined that it vaould be in the best interest of the citizens of the City of Plainview to approve said change in the Permissable Building Area, NO~l, THEREFORE, be it ordained by the City Council of the City of Plainview, Texas: SECTION 1: Section 1 of Ordinance No. 84-2551, passed and approved May 22, 1984 and Section 1, Ordinance fJo. 84-2573, passed and approved December ll, 1984 shall be and the same are. amended as follows to wit: A~ The Permissable-Building Area shall conform to Exhibit Plo. 1-A as submitted and as herein described by metes and bounds description: a Ordinance No. 85-258.1 Page 2 BEING_a 15.2445 acre parcel of land out 'of the following tracts of land out of Surveys 27 and-28, Block JK-2,`Hale County, Texas: (1) V~ots 7, 8, 9, 10 and 11, Duncan Addition , lln:i t Ho . 2, P1 ai nvi ew, 1-1a1e County-, Texas, as recorded i n- .Volume 719 Page 437 of the Hale County Deed Records, (final plat of said addition being `recorded i n Volume 633, `_Page 677 of the Hale County Deed Records) , {2) (Lots -12, Y3 and 14 of said Duncan Addition, Unit No. 2, as recorded n Volume 7l9 Page 497 of the Hale County Deed Records, (3) ~ 11.753 .acre tract out of the .South part of said Survey No. 27, as recorded in Volume , `Page of the Hale County Deed Records, (4) The reversionary interest of the abave tracts out of streets and alleys in and adjoining said Duncan Addition, as closed by City of ' Plainview Ordinance No, 84-2557 and- recorded in Volume Page of the Nale County; Deed Records, COMMENCING at a 3[8 inch steel rod found at the intersection of the Northerly line of Olton Road (U.S. Highway Pao. 70, a 120 food wide.R.O,W.) and the Easterly line of'Mesa Drive {a 75 foot R.O.W.) for the Southwest corner of Lat 14, Duncan Addition Unit No, 2, as shown by final-plat recorded in Volume 623, Page '677 of the Nate County Deed Records; ,. From the date of this Ordinance, said Permssable-Building Area described herein shall be and is hereby changed and the official Zoning Map is amended in accordance herewith. B) Land ~~ses construction and operation of permitted uses shall conform to Deed Restrictions placed on the property by owner as approved in Ordinance No, 84-2573. In addition, a new Deed Restriction shall be added to the Site Plan "EXHIBIT l-A" requiring Parking Spaces to be provided on Lot'1 at the rate of_5.6 spaces per 1,000 square feetof gross floor area: of buildings.' From the date of this Ordinance, said Tot, ract and parcel of land described shall be and hereby be changed to the Zoning District indicated and the official Map i amended in accordance herewi h:: °~ Ordinance No. 85-2581 Page 4 SECTION 2: A necessity to give immediate consideration of the herein stated revisions in order to facilitate beginning of construction and in order to eliminate untimely :and costly delays detrimental to the welfare and interests of the Citizens of Plainview., Texas, creates an emergency requiring that any rule necessitating more than one reading thereof be, and the same is hereby suspended:, this Ordinance shall be passed and .take effect as an emergency measure and shall be in full force and effective after its passage as provided by law and it is so. ordained.
