Kirchoff for rezoning two (2) tracts of land from an R-1 (Single-Family Residential) Zoning District to a C.G.B. (Commercial General Business) Zoning District for commercial uses, and described as follows: Tract A: A 1.148 acre tract out of the N.W. part of Section 28, Block JK-2, Hale County, Texas. BEGINNING at a 3/8 inch iron rod at the S.E. intersection of U.W.. Highway No. 70 and Westridge Road, said rod being S.0407'48"W., 60..0 feet and N.89457'E., 37.5 feet from the N.W. corner of Section 28, Block JK-2, Hale County, Texas; Thence N.89457"E., 9.28 feet to a point the beginning of a curve; Thence 979.06 feet, Southeastward around a curve to the right having, a .radius of 2,804.8 feet'and a chord bearing S.80403'E., 974.10 feet to the end of curve;. Thence S.70403'E., 1,142.82 feet to the BEGINNING POINT of this tract; Thence S.70403'E., 100.0 feet to a point; Thence S.19457'W., 500.0 feet to a point; Thence N.70403'W., 100.0 feet to a point; Thence N.19457'E., 500.0 feet to the place of beginning and containing 1.148 acres, and located in the 4100 Block of Olton Road. Tract B: Being a 17.442 acre tract out of the N.W. part of Section 28, Block JK-2, Hale County, Texas; .and being bounded on .the north by U.S. Highway No. 70, on the west by the east right-of-way line of Westridge Road, and on the south and east by Running Water Draw Regional Park: BEGINNING at a 3/8 inch iron rod at the southeast intersection of U.S. Highway No. 70, and Westridge Road, said rod being 5.0407'48"W., 60.0 feet and N.89457'E., 37.5 feet from the PJ.W. corner of Section 28, Block JK-2, Hale County, Texas; Thence S.0407'48"W., 170.31 feet along the east right-of-way line of Westridge Road to a 5/8 inch iron rod for the N.W. corner of Running Water Draw Regional Park; Thence S.59439'23"E., 928.18 feet to a 5/8 inch iron rod for an interior corner of said Park; Thence S.70403'E., 840.14-feet to a 5/8 inch iron rod for an interior corner of sand Park; Thence N.19457'E., 500.0 feet to a 5/8 inch iron rod in the south right- of-way line of U.S. Highway No. 70 for a corner of said Park; Thence N.70403'W., 842.82 feet along said right-of-way line to a point of curvature;. Thence North~resterly, 979.06 feet continuing along said right-of-way line around a curve to the left having, a radius of angle of 204, a tangent of 494.56 feet, and a chord 974.10 feet to a point of tangency; Thence S.89457'W., 9.28 feet continuing along the POINT OF BEGINNING and containing 17.442 acres, 4500 Block of Olton Road. ZONE CASE N0. 505: 2,804.8 feet, a central bearing N.80403'W., paid right-of-way line to located in the 4300 to Being a 1.7.442 acre tract out of the N.W. part of Section 28, Block CITY OF PLAINVIEW, HALE COUNTY, TEXAS, FROM R-1 (Single Family Residential) to a CGB (Commercial General Business) ZONING DISTRICT. WHEREAS, the. proposed change in Zoning Districts as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council, and after due consideration, the City Council of the City of .Plainview. finds that for the orderly growth of the City making the proposed change as hereinafter set out will be in the public interest which creates an emergency; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map, have been fully complied with, as well as giving notices provided by Article 1011E Vernon's Annotated Civil Statutes- Amended, 1953, and notice was duly published in the Plainview Daily Herald more than fifteen (15} days prior to the date of the Public Hearing according to said notice was duly held in the City Council Room of the City Hall,- Plainview, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in-the body of this Ordinance; NOW, THEREFORE; BE IT ORDAINED BY THE CITY COUNCIL OF-THE .CITY OF PLAINVIEW: SECTION 1. That Ordinance No. 82-2478 and the Official Zoning Map be and the same are hereby amended as follows, to-wit: ZONE CASE N0. 506 City of Plainview, Hale County, Texas, from an R-l (Single Family Residential) to a CGB (Commercial General Business) Zoning District.. From the date of this -0rdinance, said lot, tract and parcel of land described shall be .and hereby be changed to the Zoning District indicated and the official Map is amended in accordance herewith. SECTION 2. Upon passage of this Ordinance on first. reading, the City Secretary be and is hereby authorized and directed to cause to have published in the Plainview Daily Herald, a daily newspaper of general circulation in the City of Plainview, Texas, a notice that a public hearing shall be held in the Council Chamber of the City Hall in Plainview, Texas, at 7:30 o'clock P. M., on the 23 day of April, 1985, to permit the public to be heard prior to consideration of this Ordinance for second and final reading, said publication to be made more than fifteen (15) days. prior to the time designated for such public hearing. PASSED on first reading this, the 9th day. of April 1985. A notice of time and place where and when said Ordinance would be given a public hearing and considered for final passage was published in the Plainview Daily Herald, a daily newspaper of general circulation in the City of Plainview, Texas, said publication being on the. day of , 1985, the same being more than fifteen (15) days prior to the time designated for said hearing. After such opportunity for the public to be heard, said Ordinance was .passed on second and final reading. PASSED on second and final reading this, the 23rd day of April, 7985. r E. V.
