AT~tENDMENT
MINIMUM HOUSING STANDARDS CODE
AN ORDINANCE AMENDING ORDINANCE NU. 83-2511; INCREASING THE PEN-
ALTIES FOR VIOLATION OF THE MINIMUM HOUSING STANDARDS CODE FROM A
MAXIMUM FINE OF $200.00 TO A MAXIMUI~i FINE OF .$1,000.00; DELETING
FROM .THE MIPdIMUM HOUSING STANDARDS CODE THE PROVISION RELATING TO
THE ESTABLISHMENT OF A SPECIAL PROJECT DEMOLITION FUND FOR PAYMENT
OF THE COST OF REPAIR AND DEMOLITION OF SUBSTANDARD HOUSING;
PROVIDING THAT ALL DELINQUENT ASSESSriENTS SHALL BEAR INTEREST AT THE
HIGHEST RATE ALLOWED BY LAW; PROVIDING FOR A SEVERABILITY CLAUSE AND
AN EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City Council of the City of Plainview, Texas, has
determined that Ordinance No. 83-2511 should be amended.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City
of Plainview, Texas, that the following sections of Ordinance No.
83-2511 shall be and the same is hereby amended as provided herein:
Sec. H-205, shall be and the same is hereby. amended as follows:
Sec. H-205. Any person violating this section shall be guilty
of a misdemeanor and upon conviction thereof shall be punished by a
fine not to exceed $1,000.00.
Sec. H-1103 (b), shall be and the same is hereby amended as
follows:
Sec. H-1.103 (b) Com licence, Whenever such notice is posted,
the Code En orcement 0 icer shall include a notification thereof in
the notice and order issued by him under Subsection (b) of Section
H-1101, reciting the emergency and specifying the conditions which
necessitate the posting. No person shall remove or deface any such
notice after it is posted until the required repairs, demolition or
removal have been completed pursuant to the provisions of this Code.
Any person violating tr~is Subsection shall be guilty of a misdemean-

more than $1,000.00.
Sec. H-1401 (a), shall be and the same is hereby amended as
follows:
Sec. H-1401 (a) General, After any order of the Code Enforce-
ment 0 icer or t e Boar o .Minimum Housing Standards made pursuant
to this Cade shall become final, no person to whom any such order is
directed shall fail, neglect, or refuse to obey any such order. Any
such person who fails to comply with any such order if guilty of a
misdemeanor and upon conviction thereof such person shall be pun-
ished by a fine of not more that $1,000.00.

Sec. H-1501 (b), shall- be and the same is' hereby amended as
follows:

Sec, H-1502.- Demolition Fund (a) General, (b) Maintenance of
Fund is hereby repealed.
Sec. H-1603 (b), shall be and the same is hereby amended as
follows:
Sec. H-1603 (b) Interest. All such assessments remaining
unpaidafter t arty ( ) ays from the date of recordation shall
become delinquent and shall bear interest at the highest legal rate
authorized bylaw.
Sec.. H-1702, shall be and the same is hereby amended as fol-
lows:
Sec. H-1702. Any person interfering .with the execution of a
lawfu~sea;r~ warrant issued pursuant to this chapter shall be
guilty of a misdemeanor and upon conviction .thereof shall be fined
in any sum not to exceed One Thousand Dollars ($1,000.00}. Each day
such violation is committed or permitted to .continue shall consti-
tute a separate offense, and shall be punishable as such hereunder.
Sec. H-1901. Should any section, paragraph, sentence or clause
or any wor i~of this ordinance or of the Housing Code as amended
hereby, be declared-unc®nstitutional or invalid for any reason, the
remainder of this ordinance and of the~Housing Code as amended
hereby shall not be affected.
