AN ORDINANCE AN1E~]DING THE BUDGET OF THE CITY OF PLAINVIEW FOR
THE FISCAL YEAR OCTOBER I, 1984, THROUGH SEP'i~ER 30, 1985,
BY MAKING CERTAIN CHANGES IN FUNDS IN SPECIFIED ANlOUNI'S AS
MORE FULLY DESCRIBED HEREIN, AND PROVIDING FOR AN EFFEC.'TIVE
DATE.
WiIF12EAS, the Budget adopted by the City Council establishes a pay
plan and appropriates funds to pay the pay plan for the members of the
Plainview Fire Department; and
WHEREAS, the United States Supreme Court has issued an opinion
which requires that certain members of the Plainview Fire Department be
paid time and one-half for certain hours worked; and
W~IEREAS, in order to avoid reducing the hours of work for those
members of the Plainview Fire Department and thereby reduce the pay of
such members, it is necessary to adjust the pay plan established in the
1984-85 Budget to recognize the compensation for titre worked at time and
one-half under the fluctuating work week plan in order to keep the pay
plan within the appropriation for the 1984-85 Budget: -
NOW,. Tf3ER~'ORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PLAINVIEGV, TExAS:
SECTION 1. That the Budget for the City of Plainview adopted on
the 6th day of September, 1984, for the fiscal year October 1, 1984,
through September 30, 1985, be and is hereby amended by changing the
Fire Pay Plan within the limits authorized by Section 7k of the Fair
Labor Standards Act of 1938, as amended, to the amounts specified on the
schedule appended hereto and made a part hereof for all purposes.
SECTION 2. This ordinance shall becotre and be effective upon acid
after its date of final passage.
