ELECTIVE OFFICES; PROVIDING THAT THE FIRST ELECTION OF THE COUNCIL UNDER SINGLE MEMBER DISTRICTS SI~HALL BE CONDUCTED ON APRIL 5, 1986 AND THAT PRECINCTS ONE' TWO, THREE, FOUR AND THE MAYOR ~nTILL BE ELECTED; PRO~TIDIN~G THAT 'THE SECOND ELECTION OF THE COUNCIL UNDER SINGLE M MBER DISTRICT SHALL BE ON APRIL 2, 1988 AND PRECINCTS FIE, SIX, AND SEVEN WILL BE ELECTED AND THAT REGULAR ELECTIONS THEREAFTER. WILL BE CONDUC'TEA ON EVEN-NUMBERED YEAS AS THE RESPECTIVE TERMS EXPIRE; THAT THE BOUNDARIES'' FOR PRECINCTS SHALL BE REVIEWED AT LEAST ONCE EVERY TF~IN YEARS UPON. COMPLETION OF THE FEDERAL CENSUS AND THAT THE PRECINCT BOUNDARIES AND POLLING PLACES SHALL BE ESTABLISHED BY ORDINANCE'; PRO- VIDING THAT SECTIONS 6 , 8 , 11 ,'~ 12 , 13 , 87 , 202 , AND 2.03 OF THE CHARTER OF THE CITY ''OF PLAINVIEW ARE .HEREBY REPEALED; PROVIDING THAT ALL PROVISIONS OF THE CHARTER OF THE CITY OF PLAINVIEW, OR PARTS THEREOF, IN CONFLICT WITH THESE AMENDMENTS ARE HEREBY REPEALED; AND PROVIDING FOR THE PASSAGE OF SUCH ORDINANCE AIS AN EMERGENCY. WHEREAS, the City Council desires to call for an election to determine if the citizens of Plainvjiew, Texas desire to .amend the City Charter to provide for the election of seven (7) Council Members from Single Member Districts and for the election of a Mayor-at-Large. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVLEW, TEXAS: Section l: That in accordance with the statutes provided in the Charter of the City of Plainview, Texas, an election shall be held in the City of Plainview on the 5th day of November, 1985, the same to be the first Tuesday in November, 1985, to determine if the City Charter of the City of Plainview, Texas shall be amended as provided herein.. Section 2: Said election shall be held in each of the des- ignated districts within the City and at the designated polling places within each district provided by ordinance of the City of Plainview, Texas. All territory located within the corporate limits of the City of Plainview, Texas is divided into three (3) election districts. District No. 1 will consist of the following territory, to-wit: All of that part of Hale County, Texas, Election Precinct No. 6 and 7 lying within the city limits of the City of Plainview, Texas. Said Hale County Election Precinct 6 and 7 are described as follows: Precinct 6 is bounded on its Northern most edge by 24th Street which runs East/West from the Western limit of the city approximately 1/2 mile East to Interstate Highway 27. A northeastern edge runs from 24th Street Southwest following Highway 27 until it is intersected by 16th Street. 16th Street- defines a Northern edge of the precinct running East from Highway 27 to Garland Street. Garland Street defines a 2 block long. Eastern boundary which runs South from 16th Street to 14th Street. 14th Street defines a short Northern edge which runs West from Garland to Holiday Street. Holiday Street forms an Eastern edge running South from 14th Street to 10th Street. 10th Street defines the primary Northern boundary running East/-West from Holiday on the West to Smythe Street on the East. Smythe Street forms the Eastern most boundary of the precinct running North/South from 10th Street on the North to the Southern limit of the city. The remaining Southern, Western boundaries (rotating clockwise) follow the city limit lines around and up -2- . ~ , '~. (North) the Western city line until intersected by 24th Street (the Northern most boundary of the precinct). The Northern boundary of precinct 7 runs Southeast (from the Northwest corner of the city limits) along a diagonal which follows the FW & D Railroad until it intersects 24th Street. Then the precinct line. follows 24th Street back West to Yonkers Street. Yonkers defines the Eastern boundary running South from 24th Street to 10th Street. 10th Street defines the Southern edge of the pre- cinct running West from Yonkers to Holiday. Holiday bounds the precinct on the West running North from 10th. Street to 14th Street. 14th. Street defines a Northern edge which runs East from Holiday to Garland Street. Garland Street defines a Western edge running North from 14th to 16th Street. 15th Street identifies a Northern edge which runs West to Interstate 27. Interstate 27 defines a Western edge of the precinct running North from 15th Street to 24th Street. 24th Street defines a Southern edge which runs West from I-27 to the city limits line, which in turn makes a right angle North, to point of beginning. District No. 2 will consist of the following territory, to-wit: All of that part of Hale County, Texas, Election Precinct No. 8, 13 and 16, lying within the city limits of the City of Plainview, Texas. Said Hale County Election Precinct 8, 13 and 16 are described as follows: Voter Precinct 8 is bounded on the North by 24th Street running East/West from Yonkers on the West to Oakland on the East. Oakland bounds the precinct on the East running South from 24th Street to 13th Street. 13th Street forms a Southern boundary running West from Oakland to Smythe Street. Smythe Street forms another Eastern edge running South from 13th Street to 10th Street. 10th Street defines the Southern edge of the pre- cinct running West from Smythe Street to Yonkers Street. Yonkers forms the Western boundary running North from 10th Street to 24th Street. Voter precinct 13 is bounded on the North by the city limits line running East from the point at which Interstate 27 and the FW & D Railroad intersect. From this point, the voting precinct boundary follows the city -3- limits boundaries generally Northeast and Easterly to a point of intersection with Business 87 - Columbia Street. Business 87 - Columbia Street defines the Eastern most edge of Voter Precinct 13, said line running from the Northern most point of -the city limits line to a point of intersection with 24th Street. 24th Street forms the Southern boundary of Voter Precinct 13, running West from its point of intersection with Columbia to a point of intersection with the Dimmitt Highway - Texas 194. The Dimmitt Highway - Texas 194 forms the remaining edge of Voter Precinct I3, said line running generally Northwest to its point of intersection with Interstate 27, the place of beginning. Voter Precinct 16 is bounded on its Northern most edge by 24th Street running East/West from Oakland Street in the. West to Houston in the East. .Houston Street forms an Eastern edge of the precinct running South from 24th Street to 16th Street. 16th Street defines a Northern edge which runs East from Houston to Columbia Street. An Eastern edge is formed by a diagonal which runs Southeast from 16th ,and Columbia to 12th and Baltimore. 12th Street then forms a Northern edge running East from Baltimore to Broadway. Broadway defines the Eastern most edge of the precinct (1 block long)- to 11th Street. 11th Street defines the primary Southern boundary running West from Broadway to Smythe. Smythe forms the Western most edge running North from 11th to 13th Street. 13th Street defines a Northern edge which runs East from Smythe to Oakland. Oakland forms the remaining Western boundary running North from 13th Street to 24th Street. District No. 3 will consist of the following territory, to-wit: All of that part of Hale County, Texas, Election Precinct No. 1, I9 and 10 lying within the city limits of the City of Plainview, Texas. Said Hale County Election Precinct 1, 19 and 10 are described as follows: Voter Precinct 1 is bounded on the Northern most edge by 24th Street running East/West .from Houston Street in the West to the city limits in the East. The remaining Eastern and Northern edges follow the city limits line until they intersect 5th Street. 5th Street defines a Southern edge that runs West from the city limits to Broadway Street. Broadway identifies a Western boundary which runs North from 5th Street to 12th Street. -4- I2th Street defines a Northern edge running West from Broadway to Baltimore Street. The boundary then runs diagonally from 12th and Baltimore to 16th and Columbia. 16th Street defines a Southern edge running West from Columbia to Houston Street. Houston Street defines the remaining Western edge of the precinct running North from 16th Street to 24th Street. Voter Precinct 19: The Northern most boundary of the precinct is defined by 11th Street running East/West from Denver Street in the West to Broadway Street in the East. An Eastern edge is identified by Broadway running South from 11th to 5th Street. 5th Street defines the remaining Northern edge running East from Broadway to the city limits. The remaining Eastern and Southern boundaries follow the city limits line until they are tangent to Columbia Street. Columbia Street definers a Western edge running North to East 2nd Street. East 2nd Street defines a one block long Northern edge which runs West from Columbia to Denver. Denver Street defines the remaining Western edge of the precinct running North from 2nd Street to 11th Street. Voter Precinct IO is bounded on the North by Ilth Street running East/West from Smythe on the West to Denver Street on the East. East Denver defines an Eastern edge of the precinct running South to 2nd Street. East Second Street defines a one block long Northern edge which runs to Columbia Street. Columbia Street forms the remaining Eastern boundary of the precinct running to the Southern most limit of the city. The remaining Southern boundary follows the city limits line West to Smythe Street. Smythe Street defines the West edge of the precinct running North from the Southern city limits to 11th Street. Section 3: The following places are hereby designated as the official polling places within each district: District No. 1 polling place shall be Chamber of Commerce, 7I0 West 5th Street, Plainview, Texas. District No. 2 polling place shall be First Presbyterian Church, 2101 Utica, Plainview, Texas. -5- District No. 3 polling place shall be Municipal Court, 90I Broadway, Plainview, Texas. All qualified electors shall vote in the election district in which they reside. Sectiom. 4: Said election shall be conducted by the following who are hereby appointed to hold said election. 1. Betty Royal_ 2. Nell Ford 3. Mrs. S. M. True, Jr. Betty. Royal, Jerry Evans and Anita Maldonado are hereby appointed as election officials of District No. 1. Betty Royal shall act as the Presiding Judge of District No. 1. Jerry Evans is appointed First Alternate Judge to act as Presiding Judge of District No. 1 in the event that Betty Royal is for any reason unable to serve as such Presiding Judge, and Anita Maldonado is hereby appointed Second Alternate Judge to serve as Presiding Judge of District No. 1 in the event that both Betty Royal and Jerry Evans are for any reason unable to serve as Presiding Judge. The Presiding Judge of said District 1 shall appoint not Less than two (2) clerks and as many additional clerks within the authorized limit as he deems necessary for proper conduct of the election. Nell Ford, Jack Ford and Dorothy McInnish are hereby appointed as election officials of District No. 2. Nell Ford shall act as the Presiding Judge of District No. 2. Jack Ford is appointed First Alternate Judge to act as Presiding Judge of District No. 2 in the event that Nell Ford is for any reason unable to serve as such Presiding Judge, and .Dorothy Mclnnish is hereby appointed Second Alternate Judge to serve as Presiding Judge of District No. 2 in the event that both Nell Ford and Jack Ford are for any reason unable to serve as Presiding Judge. The Presiding Judge of said District 2 shall appoint not less than two (2) clerks and as many additional clerks within the authorized limit. as he deems necessary for proper conduct of the election. Mrs. S. M. True, Jr., Sallie Damron and Maude Brown are hereby appointed as election officials of District No. 3. Mrs. S. M. True, Jr. shall act as the .Presiding Judge of District No. 3. Sallie Damron is appointed First Alternate Judge to act as Presiding Judge of District No. 3 in the event that Mrs. S. M. True, Jr, is for any reason unable to serve as such Presiding Judge, and Maude Brown is hereby appointed Second Alternate Judge to serve as Presiding Judge of District No. 3 in the event that -6- both Mrs. S, M. True and Sallie Damron are for any reason unable to serve as Presiding Judge. The Presiding Judge of said District 3 shall appoint not Less than two (2) clerks and as many additional clerks within the authorized Limit as he deems necessary for proper conduct of the election, Section 5: It is further provided that the maximum number of clerks~ich shall be appointed to serve in said election shall not be in excess of seven (7) persons for eaeh district. Section 6: The following proposal shall be submitted to the citizens o Plainview, Texas: That the Charter of the City of Plainview, Texas be amended to provide as follows: The elected officers of the City of Plainview, Texas shall consist of a Mayor and seven (7) Council Members. The Council Members shall be elected from Single Member Districts and the Mayor shall be elected at-large. The Mayor and Council Members shall serve four (4) year terms, and until the election and qualification of their successors. Four (4) Council Members shall constitute a quorum for the transaction of business. An affirmative majority of all Council Members present and voting shall be necessary to pass any ordinance or resolution. In order to file for election as a Council Member an individu- al must be a registered voter of the City of Plainview; have resided within the City for one year; reside within the district frown. which said individual is to be elected for at least six months; and shall have paid all taxes due, and be otherwise free from debt to said City. Each candidate for Council shall designate in the announcement of his candidacy, and in the request to have his name placed on the official ballot, the precinct for which he desires to become a candidate, and such request to be placed on the official ballot to be filed in writing with the person exercising the duties of City Cldrk of the City of Plainview at least thirty (30) days before such election shall be held. Any elective offi- cer, who, during his term of office ceases to be a qualified voter of said City. or ceases to be a resident of the precinct from which they were elected, shall thereby at once vacate his office. The Council shall, on the next regular meeting date of said Council, and in any event within five (5) days after each regular and special election, canvass the returns and prepare the results of such election, -7- At every regular election and every special election called to fill one or more vacant elective offices , election to each office shall be by a majority of the votes cast for such office at such election. Where in any election for elective office, no candidate receives a majority of-..all the votes cast for such office at such election, the City Council shall immediately upon declaring the official results of the election, issue a call for a run-off election for every place to which no one was elected. Such run-off election shall be held on the sixth (6th) Tuesday following the preceding election, a.nd in such run-off election, the two candi- dates who received in the preceding election the highest number of votes for each candidate who receives the majority of the votes cast for such place in the run-off election shall be declared elected to such office. The Council shall at the next regular meeting date of said Council and in any event within five (5) days after said run-off election, canvass the returns and declare the res~,ults of such election. If adopted by the voters of the City of Plainview, this amendment to the Charter of the city of Plainview shall not effect Council Members whose terms expire in 1988. All elections conducted by and for the City of Plainview, shall be conducted and all matters in regard thereto shall be in compliance with the provisions of the general election laws of the State of Texas and the Statutes and Laws of the State of Texas insofar as said general election laws, statutes, and laws apply to election held for and by the City of Plainview. In the event there is a conflict between the provisions of the general election laws of the State of Texas applicable to the City of Plainview and the .provisions of this Charter pertaining to the conduct of an election, or in the event there is a conflict between said applicable statutes or said applicable general election laws or laws of the State of Texas pertaining to the conduct or holding of'an election in the City of Plainview, and the provisions of this charter pertaining to the conduct of an election for or by the City of Plainview, then in such an event or events the provisions of said applicable general election laws, or said applicable laws or statutes of the State of Texas shall control. Special meetings of the Council may be called by the Mayor, and the same may be called by the Mayor upon written application of four or more of the Council Members. If, in any case the Mayor when requested to do so by four or more Council Members, shall fail or refuse to call a meeting of the Council, then such meeting may be called by a majority of the council Members who shall give such notice as the Mayor is required to give, and shall also notify the Mayor. The Mayor shall be president of and preside over the Council. The Council shall elect one of its members Mayor Pro Tem, who in case of refusal or inability of the Mayor to perform the duties of his office by reason of sickness, absence from the City or from -8- other cause, shall perform the duties of Mayor, and in case of death or resignation of the Mayor, the Mayor Pro Tem shall perform the duties of Mayor until his successor shall have been elected and qualified. If both the Mayor and Mayor Pro Tem, for any reason fail to attend any meeting of the Council, four Council-Members shall constitute a quorum for the transaction of business, coming regularly before the Council, except where herein otherwise provid- ed, and may elect one of their members as Mayor Pro Tem for the meeting only. The Council shall set with open doors, except when otherwise ordered by majority vote of all Council Members present and voting; and shall keep a journal of its proceedings which shall be opened to the public. The Council shall set only by ordinance, motions or resolutions, except ordinances making appropriations, shall be confined to one subject, which shall be taken upon the passage of .all ordinances or resolutions and entered upon' the jov.rnal of its proceedings. All ordinances, orders or resolutions may be passed at any one meeting of the Council except as otherwise provided. The Council or a Committee of the Council duly authorized by it may investigate any department of the City government, and the official acts and conduct of any City officer;. and for the purpose of ascertaining facts in connection with such investigation shall have full power to compel the attendance and testimony of witness- es, to administer oaths and to examine such person as it may deem necessary, and to compel the production of books and documents. The. City Council shall provide for the annual auditing of books and accounts of all departments and officers of the City. Notices of elections to fill vacancies caused by the failure or refusal to qualify, death, resignation or refusal for any ,cause, of any Council Member of said City may be given by posting a'notice of said election, containing the requisites above set out, for ten days, provided the manner of calling and holding such an election shall be the same as that governing annual City elections; provided the City Council may fill the vacancy caused by the failure or refusal to qualify, death, resignation or removal of any q'fficer made elective by the people, for the unexpired term, except ~'~hat of Mayor and Council Member of said City and may fill the vacancy caused by the failure or refusal to qualify, death, resignatlion or removal of said last named officers, if such vacancy shah. take place not longer than six months preceding the next regular election, provided, all vacancies in such elective officer sh'aIl be promptly filled, but only for the unexpired term. The first election of Council under single member districts shall be on April 5, 1986, and Precincts 1, 2, 3, 4 and the Mayor are to be elected. The second election of Council under single member districts shall be on April 2, 1988, and precincts 5, 6 and 7 are to be elected. Regular elections thereafter are to be conducted on even numbered years as the four year terms expire. -9- The boundaries for precincts shall be reviewed at Least once every ten years upon the completion of each Federal census. Precinct b®undaries and polling places shall be established by ordinance. Sections 6, S, 11, 12, 13, 87, 202 and 203 of the Plainview City Charter are hereby repealed. All provisions of the Charter of the City of Plainview, or parts of said Charter in conflict herewith are hereby repealed. Section 7: If the citizens of the City of Plainview, Texas shall~y majority vote elect to amend the City Charter as provided in this ordinance, the following shall constitute the boundary lines for each of the seven (7) Single Member Districts and the location of the polling place within each district: Voting Precinct No. 1 is described more fully as follows: BEGINNING at a point of intersection of U. S. Highway 70 at its point of intersection with the eastern boundary of the municipal city limits. of the City of Plainview; THENCE North. along said eastern boundary of the city limits to a point of intersection with the South line of Fisco Park and San Antonio Street; THENCE East along San Antonio Street to a point of intersection with the west line of Guadalupe Drive; THENCE North along Guadalupe Drive to the South line of East 14th Street; THENCE West .along East I4th Street to a point of intersection with the East line of E1 Camino Street; THENCE South along the East line of El Camino Street to a point of intersection with the Northern boundary of the municipal city limits, lying roughly south of a line extended from East 13th Street; THENCE West along said municipal limits boundary to a point roughly east of the eastern most line of Elm Street; THENCE North along the municipal limits boundary on a line extended north from the said eastern most line of Elm Street to a point of intersection with the South line of 24th StreetJState Farm to Market Road 400; THENCE West along the said south line of 24th Street to a point of intersection with the East line of Houston Street; THENCE South along the east line of Houston Street to a point of intersection with the north line of West 16th Street; THENCE East along said north line of West I6th Street to a point of intersection with the centerline of the Panhandle & Santa Fe Railroad right of way; THENCE South along said centerline of the Panhandle & Santa Fe Railroad right of way to its point of inter- section with the east line of North Austin Street; -10- THENCE South along the east line of North Austin Street to a point of intersection with the North line of West 12th Street; THENCE East_ along said north line of West I2th Street to a point of intersection with the east line of Broadway Street; THENCE South along said east line of Broadway Street to a point of intersection with the north line of West 7th Street; THENCE East along said north line of West 7th Street to a point of intersection with the East line of Date Street; THENCE South along said east line of Date Street to a point of intersection with the north line of East 4th Street.; THENCE East along said north line of East 4th Street to a point of intersection with the east line of Milwee Street; THENCE North along said east line of Milwee Street to a point of intersection with the South line of East 5th Street;.
