ORDINANCE NO. 85-2634
AN ORDINANCE AMENDING-SECTION 7-3 ENTITLED."FOWL AT LARGE,"
SECTION 7-12 .ENTITLED "GENERALLY RESTRICTED," AND ESTABLISHING
SECTION 7-14 OF Tl:-iE CODE OF THE .CITY OF PLAINVIEW, TEXAS AS IT
PERTAINS TO CHAPTER 7 ENTITLED "ANIMALS AND FOWL."
SECTION l: SECTION 7-3, entitled "FOWL AT LARGE," shall read as
follows:
It shall be unlawful for any person raising or keeping any type of
chickens, turkeys, ducks, or guineas, or any other type or kind of
fowl, excluding pigeons, to allow or permit the same to be at large
or to run at large within the City.
SECTION 2: SECTION 7-12, entitled "GENEI~.ALLY RESTRICTED," shall
read as follows:
It shall be unlawful for any person to keep, harbor, or maintain for
any length of time whatsoever any of the following animals or fowls
within the City upon any property zoned .other than M-1, M-2, or
Agricultural or where otherwise specifically. permitted, by the
City's Zoning Ordinance; and in addition, where such animals are
allowed to be kept, harbored, or maintained, enclosure, stables,
pen, coop, roost, or other places where in the same are so kept,
harbored, or maintained shall not be within .the respectively
indicated proximity to any residence or dwelling other than that of
the owner or keeper of such animals or fowl:
a Cows, horses, mules, sheep, goats, jacks, jennets, or other
livestock - 200 .feet.
b. Swine of any type or kind whatsoever - 500 feet.
c. Fowl of any type or kind whatsoever, except pigeon - 100'feet.
SECTION 3: SECTION 7-14, shall be entitled "KEEPING OF PIGEONS" and
shall read as follows:
a. Every person who owns, controls, keeps, maintains, or harbors
any pigeons in the City shall at all times keep them confined
in proper cages; provided, that pigeons bearing a seamless
leg band issued :by a recognized association of pigeon
fanciers, may be released for exercise or performance, upon
the condition that the. owner or person who has possessipn of
such pigeon shall not permit them to alight on building ,
or property of others; and that such seamless banded homing
pigeons shipped or transported to the City, may be releaased
within the City for the purpose of engaging in a pigeonlrace.
b. It shall_be the duty of every person raising or keeping'
pigeons to keep such fowl in a coop or enclosure, and such
coop or enclosure shall be kept at a distance of at lea''t
twenty (20) feet from every building or structure used ~or

sleeping, dining, or living; provided, that this section
shall not apply to the owner of the pigeons.
c. An individual who feels that the pigeons are a "nuisance" may
seek relief under Chapter 20 of the City of Plainview City
Code entitled"Nuisances."
d. Animal control personnel shall be allowed to enter the
premises, where pigeons are kept at all reasonable times
so that an inspection may be completed.
SECTION 4: Any and all Ordinances, Resolutions or Policies of the
City which are in conflict to this Ordinance are hereby repealed.
PASSED AND APPROVED by the City Council, of the City of Plainview,
Texas, on first reading this. the 14TH day of January, 1986.
PASSED ON SECOND AND FINAL READING this the 28TH day of January,
1986.
