AN ORDINANCE AMENDI~.VG SECTION 24 OF THE CODE OF THE CITY OF
PLAINVIEW, TEXAS AUTHORIZING THE CITY MANAGER TO ISSUE PERMITS FOR
THE USE OF ANY SIDEWALK, PUBLIC EASEMENTS, OR STREET IN THE CITY
QF PLAINVIEW, TEXAS; PROVIDING FOR APPEALS PROCEDURES; PROVIDING
FOR A PENALTY, AND FOR A SEVERABILITY CLAUSE.
WHEREAS, under the terms of the ordinance presently enforced and
in effect, a. permit for the use. of any sidewalk, public easement or
street in the City limits of the City of Plainview,. Texas must be
approved by the City Council; and
WHEREAS, the requirements that approval of such permits be made by
the 'City Council has in the past resulted in the necessity to call a
special meeting of the City Council or has resulted in the delaying
of the issuance of such permit until a regular meeting of the City
Council.; and
WHEREAS, it has been determined by the City Council that it would
be in the best interest of the citizens of Plainview, Texas to
authorize the City Manager. to issue a permit for the use of any
sidewalk, public easement, or street in the City of Plainview, Texas
where issuance of such permit is .deemed to be appropriate by the City
Manager.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, TEXAS:
Section 28-24 of the Code of the City of Plainview, Texas shall be
in the same is hereby amended as follows:
Section 1: It shall be unlawful for a person to, in any manner,
obstruct the views of a pedestrian. of any sidewalk,
public easement or street in the City by placing,
depositing, or suffering to remain thereon; or
permitting any of his servants, employees, or persons
under his control to .deposit, place. or suffer to remain
thereon; any goods, wears, merchandise, material,
vehicle, or other objects whatever,.: without first
obtaining a permit thereof from the City Manager of the
City of Plainview, Texas.
.Section 2: Any such application permit shall be filed with the
City Manager seventy two (72) hours prior to the date
.that said request for permit is to be issued in order
that the City Manager may have sufficient time to
investigate the feasibility of issuing said permit.
Section 3: Any permit issued under this section. shall expire
seventy two (72) hours after it has been issued.

Section 4: Any person who disagrees with the decision of the
City Manager may appeal such, in writing,. to the City
Council within ten (10) days after the permit was
denied or granted.
Section 5: Any person wha shall violate or fail to comply with
any provisions of this ordinance shall be deemed
guilty of a misdemeanor, and upon conviction shall be
punished by a fine in the amount not more than
$200.00.
Section 6: Should any section, paragraph, sentence, clause or
any wording of this ordinance be declared
unconstitutional or .invalid for any reason, the
remainder of this ordinance shall not be effected.
