EXTENSION OF CERTAIN BOUNDARY LINES OF THE CITY OF PLAINVIEW, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF $39.5$ ACRES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT LIMITS OF THE CITY OF PLAINVIEW, TEXAS AND WITHIN THE EXTRATERRITORIAL JURISDICTION OF SAID CITY. WHEREAS, two public hearings were conducted before the City Council of the City of Plainview, Texas, where all interested persons were provided. with an opportunity to be heard on the proposed annexation of the following described territory: BEGINNING at a paint in the West line of Section 32, Block JK-2 Hale County., Texas, which point is 50 feet South of the Northwest corner of said Section 32 and is 50 feet South of the Northeast corner of Section 29, Block JK-2, Hale County, Texas, and which point is the Southwest corner of a tract of land annexed to the City of Plainview March 11, 1975 by Ordinance No. 75-1739; THENCE N.88°56'E. 5,376.1 feet along a line 50 feet South from and parallel to the .North line of said .Section 32 and along the City Limit Line of the City of Plainview to a point which bears West 50 feet from the West line of a tract of land included in the Hale County Airport property; THENCE S.l°19'50"E. 3,330.7 feet along a line 50 feet West from and parallel to the West line of said Hale County Airport property which line has been described as the West line of Section 4l, Block JK-2, Hale County, Texas, in deeds for tracts conveyed to the City of Plainview and Hale Countlr, to a point in the Northwest line of a 3.220 acre tract of Land conveyed to the City of Plainview and Hale County, Texas, by deed recorded in Vol. 717, Page 375 of the Deed Records of Hale County, Texas; THENCE 5.50°43'05"W. 3,100.9 feet along the Northwest line of said 3.220 acre tract. to a point in the South line of said Section 32 which point. bears West 29.44 feet from the East line of Section 57, Block A-1, Hale County, Texas. WHEREAS, said hearings being held. at the City Council Chambers of the City of Plainview on the 24th day of June 1986 and the 8th day of July 1986, with said first hearing date being. not .more than forty (40) days nar less than twenty (20) days prior to the introduction and first reading of this Ordinance; and WHEREAS., the first and second notices of such Public Hearings were published- in a newspaper having general circulation in the City of Plainview, Texas, and in the above described territory on the 11th day of June 1986, and the 19th day of June 1986, which dates are not more than twenty (20) days nor less than ten (10) days prior to the public hearing on the .topic of annexation proceedings; and WHEREAS, the population of the City of Plainview, Texas is approximately 25,000 inhabitants; and WHEREAS, the above described territory lies within the extraterritorial jurisdiction of the City of Plainview, Texas; and 2 WHEREAS, the territory herein described lies adjacent to and adjoins the City of Plainview,'Texas; and WHEREAS, a copy of the "Service Plan" for the annexation area, as well as a map, is attached and made a permanent part of this Ordinance; and WHEREAS, this Ordinance was published in its entirety on July 25, 1986. NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Plainview, Texas: Section 1. The following described land and territory lying adjacent to and adjoining with the City of Plainview, Texas, is hereby added and annexed to the City of Plainview, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Plainview, Texas, and the present boundary limits of such City, and the various points contiguous to the area hereinafter described, are hereby altered and amended to as to include said area within the corporate limits of the City of Plainview, Texas, to-wit: BEGINNING at a point in the West line of Section 32, Block JK-2 Hale County, Texas, which point is 50 feet South of the Northwest corner of said Section 32 and is 50 feet South of the Northeast corner of Section 29, Block JK-2, Hale County, Texas, and which point is the Southwest corner of a tract of land annexed to the City of Plainview March 11, 1975 by Ordinance No. 75-1739; THENCE N.88°56'E. 5,376.1 feet along a line 50 feet South from and parallel to the North line of said Section 32 and along the City Limit Line of the City of Plainview to a point which bears West 50 feet from the West line of a tract of land included in the Hale County Airport property; THENCE S.l°19'50"E. 3,330.7 feet along a line 50 feet West from and parallel to the West line of said Hale County Airport property which line has been described as the West line of Section 41, Block JK-2, Hale County, Texas, in deeds for tracts conveyed to the City of Plainview and Hale County, to a point in the Northwest line of a 3.220 acre tract of land conveyed to the City of Plainview and Hale County, Texas, by deed recorded in Vol. 717, Page 375 of the Deed Records of Hale County, Texas; THENCE S.50°43'05"W. 3,100.9 feet along the Northwest line of said 3.220 acre tract to a point in the South line of said Section 32 which point bears West 29.44 feet from the East line of Section 57, Block A-l, Hale County, Texas. ~'~~ F THENCE 5.88°5.6'15"W. 5,938.7 feet along .the south lines of said Sections, 32 .and 29 where said. The above described territory and the area so annexed shall be apart of the City of Plainview, Texas, and the property so added shall bear its pro rata part of the taxes levied by the City of .Plainview, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all of the citizens and shall be bound by the acts, .ordinances, and regulations of the City of Plainview, Texas. RID E UBER, Mayor ATTEST: SI~ERY OWEN, Interim City Clerk ~5 CITY OF PLAIN~IEW ANNEXATION SERVICE PLAN TRACT 1 - 1.31 SQUARE MILES INTRODUCTION Pursuant to Section 10 Article 970a, V.A.C.S., the City of Plainview has prepared this proposed service plan for the. delivery of municipal services to this territory which is proposed to be annexed to ''the City. This tract of Land, a map of which is attached and labeled Exhibit "A," contains 1.31 square miles of area, or 839.58 acres, .and is located to the. South of the present existing City limits. The area proposed to be annexed is more fully described by the attached field notes labeled Exhibit "B." As iindicated, the area proposed to be annexed contains 1.31 square miles and contains approximately eight single family residences, one mob~le home, one business establishment and one barn used for agr,cultural purposes. Based on household. population figures est blished by the 190 census, the approximately nine single family residences are estimated to contain approximately 30 inhabitants. They vast majority of the area- proposed to be annexed is .relatively and veloped and uninhabited. Based on the number of houses and inh,~bitants, the density for the entire area is calculated to be applroxmately 23 people. per square mile, or .36 people. per. acre. Usi~g the most recent assessed values, provided by the Hale County Appraisal District, the. land and improvements within ..the area pro~osed for annexation is valued at approximately $778,459. Planning a city's growth is no easy task as social, political, economic and physical issues must be considered. Care must be .taken th t the path of leash resistance, which may solve an immediate problem., does not result in a long term future problem.. For ex ple, in times of rapid growth, decision makers must be careful th t maintenance of existing infrastructure does nat suffer at the ex ense'of new development or, at least, that lack of maintenance fo existing infrastructure is not an unforeseen consequence of a decision to support growth. benefits that are derived from an annexation program are usually immediate. It is a myth that most annexations pay for mselves immediately. However, over the long term, it is thought be much more fiscally responsible to manage growth early on her than to try and correct it ten or .twenty years after the t. The fact is that uncontrolled growth outside the city limits 1 be tomorrow's problems if a city doesn't exert control early in development process. Therefore, annexation is usually fiscally efical in the long term; but not in the short term. Without d use controls, development may occur which is haphazard, ightly and below city standards.. Such developments can effect a y long into the future. Not only will it negatively effect -1- community residents perception of their community, but also visitors to the community. These developments, which are outside the city limits and below city standards, are difficult, if not impossible, to correct even after annexation. ANNE~~ATION SERVICES 7.'O BE PROVIDED In ',accordance with the annexation statute, the following municipal ser~ices will be provided immediately upon annexation by the City of Plabnview, and in no event later than sixty days after the effective date of the annexation ordinance. POLICE PROTECTION 1) pn.the effective date of annexation., the area will become part of thelexisting west patrol district. 2} Effective on the date of annexation, preventative patrol service on ',a level comparable to that provided for other areas of the City with equivalent population densities, degrees and nature of development, traffic patterns, and other factors influencing crime and,traffic accident rates will be provided. 3) iR.eview and adjustment of patrol district boundaries, in order to maintain the number of calls for .service in each district at approximately equal. levels, will be preformed at two to five year intervals,.. depending on the amount and patterns of development throughout the City. 4) 'Calls for .police service, will be answered by the District Off~.cer with responsibility for the area, and/or by another officer as required, unless the call. is determined to be unfounded, fictitious, or noncriminal in nature. Any decision not to respond to a particular. class or category of call will be made based on a pol~cy which will apply equally to all calls within the annexed area and~the existing City limits. 5} 'Criminal investigative services will be provided to the annexed area for each reported crime occurring on or after the effective date of annexation, based upon the same criteria as applied to crimes reported :elsewhere in the City. Each reported crime will be evaluated individually. FIR SERVICE 1} jPrimary response into the annexed area will be from the Quincy Str''et Fire Station located at 10th and Quincy. The' "Central Fire Sta~ion" located at 215 E. 6th, will act as backup to the Quincy Street Station. Emergency ambulance service .will. also be provided in ',the newly annexed area by the Fire Department as provided in other areas of the. City. Preliminary runs by units. of the Fire Department indicate response time into the annexed area will compare favorably with the rest of the City. -2- I _ _ ~ _. ~' ~w 2) The Fire Department does not anticipate need for additional personnel or fire stations to provide service to the newly annexed area at this time. A~ population density and fire flow requirements increase iri the area„ .fire station site selection may be made to provide coverages and response time similar to other more densely populated areas of the City. 3)'Regular fire prevention inspection and a building construction plan review will be provided to the area immediately upon annexation in aaccordance with existing City policy. SERVICES 1) 'Park services for those persons living in the annexed area will beprovided immediately. Services provided will be identical- to thole provided to persons living in other areas of the City. 2} pen park areas for picnicking will be available to all residence of the annexed area on the same bases as residence presently res'ding within the City limits. The closest park to the annexed area is the Running Water Draw Regional Park. SERVICES ibrary services identical to those provided. to persons already liv~ng in the City will be provided those persons living in the annexatian area immediately upon the effective date of annexation. Inf rmation and programming services offered by the Unger Memorial Lib ary, located at Austin and W. 9th., will be available to any per'on desiring to avail themselves. of such services based on the samlI procedures for persons already living in the City. SOLID WASTE COLLECTION 1) ~'he annexation area. will be provided immediate refuse collection ser ices upon request of individual residents and property owners. The collection of solid waste from the individual properties and containers shall be made in accordance with usual Sanitation Dep rtment scheduling and standard rates. 2 } ~'he use. of the City' s Sanitary Landfill will be provided to all res~.dents of the newly annexed area on the same basis as those residents currently living within the City limits. 3) Commercial refuse collection services will be provided to any business located: in the annexed area at .the same price as presently pro~rided for any business customer within the City of Plainview. OF ROADS AND STREETS The approximately 1.05 miles of streets located in the area to be annexed will be maintained by City street forces effective with the date of annexation. Maintenance shall be on a level comparable to that provided far other ..areas of the City with similar roads, _3_ _ _ _ ~- _ ~ _. ~i4 A equivalent population .densities, degrees and nature of development, traffic patterns, and other factors influencing street maintenance. WATER AND WASTE WATER FACILITIES 1) 'iThe extension of water and sanitary sewer will be provided in accordance with current policy, established by the City Council and applicable to all property presently within the corporate limits of the City. This polic~r basically provides for the extension of mains from the existing systems by the. owners or developers of property desiring service. The owners of other properties served share in the cost of the project through the payment of pro rata charges established in the policy at such time as service connections are made to mains installed by others.. 2) The City has presently in service a one-million gallon reservoir and pump station located at 900 S.W. 3rd Street, which will provide an adequate water source to serve all the area proposed to be annexed. 3) The trunk sanitary sewer main presently existing .along Southwest Third will adequately serve the annexation area. Secondary mains ext nded from this trunk. main by developers in accordance. with current policy will serve the majority of the area proposed to be ann xed. Remaining areas will be served by the installation of lift stations. AND ZONING SERVICES 1) `Planning and zoning services will be provided immediately on ann xation. In addition to the protection of property. values thr ugh the enforcement of zoning and subdivision regulations, other ser ices including the processing of applications for zoning change, sub ivision and platting, and site plans, will be provided by the cur ent Planning and Public Works Divis-ion personnel. Until a spe ific land use plan is prepared for the annex, the guidelines pro tided in the Plainview master-plan will be utilized in evaluation of evelopment proposals in the area.. 2) 'All properties annexed into the City will be initially zoned "AO"- Agricultural Open Space District without regard to its present usel or potential use, as a "Transitional Zone." Changes in zoning for specific tracts will be processed in accordance with state law, inc uding public hearings before the Planning and Zoning Commission and the City Council prior to final action. Existing uses of property at the time of annexation will be allowed to continue as non conforming uses, though the zoning of the property will ini~ially be "A"-Agricultural. Expansion of a non-conforming use, how~ver, will require approval by the City's Board of Adjustment or a change in zoning to accommodate the existing or proposed use. -4- ~' ~, ENGINEERING SERVICF~S Engineering services, including the review of development plans, the issuance of permits as required in the development phase, and the inspection of the installation of water and sanitary sewer mains, storm sewers, and paving of public streets and alleys, will be'~provided immediately by current Engineering Division personnel. LDING INSPECTION SERVICES ?inspection services, including the review of building plans, the is~uance of permits in the inspection of all buildings, plumbing, mechanical, and electrical work to ensure compliance with City codes an~. ordinances, will be provided immediately by current Building Inspection Division personnel. TR~E~FIC SERVICES Installation of traffic signs, including street name, warning and regulatory signs, will be .installed and. maintained. by .current Traffic Division personnel according to established priorities. Traffic counts and other studies will be conducted as warranted, as is currently the practice within. the corporate limits of the City. Thils service will begin within sixty days following annexation. ENVIRONMENTAL HEALTH AND CODE ENFORCEMENT SERVICES 1)jEnforcement of the City's Environmental Health Ordinances will be provided within the annexed area on the effective date ', of the annexation ordinance. These health ordinances and other regulations will be enforced using existing environmental health personnel. 2)',Complaints of ordinance violations or other code violations within the area will be answered and investigated by existing personnel on the effective date of the annexation ordinance.'' 3)IlAnimal Control services. will be provided to those areas within th annexed area on the effective date of the annexation ordinance useing existing personnel and equipment. 4)',Vector Control services will be provided to those areas within the annexed area on the effective date of the annexation ordinance using existing personnel and equipment. IMPROVEMffi~iTS As 'provided by the annexation. statute, no money received for the sale of bonds or evidenced by other instruments. of indebtedness may be lallocated to the annexed area for a period of 180 days after ann,~xation.
