Home My WebLink About17-3666 ord267 CERTIFICATE REGARDING ADOPTION OF AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE ELECTION ON THE ISSUANCE OF GENERAL OBLIGATION BONDS HELD NOVEMBER 7, 2017, AND CONTAINING PROVISIONS NECESSARY AND INCIDENTAL THERETO STATE OF TEXAS COUNTY OF HALE CITY OF PLAINVIEW, TEXAS WE, THE UNDERSIGNED, members of the City Council of the City of Plainview, Texas (the "City"), hereby certify as follows: 1. The City Council of the City convened in a regular meeting on November 14, 2017, beginning at 7:00 p.m. in the City Hall, 901 Broadway St., Plainview, Texas, a regularly designated meeting place, and the roll was called of the duly constituted members of the City Council, to wit: Wendell Dunlap, Mayor Mayor Pro Tem Charles Starnes Teressa King, Councilmember Larry A. Williams, Councilmember Norma Juarez, Councilmember Susan Blackerby, Councilmember Oliver Aldape, Councilmember John Gatica, Councilmember And all of the above persons were present, except the following: N. A , thus constituting a quorum. Whereupon, among other business, the following was transacted at the meeting, a written: ORDINANCE NO. 17-3666 AN ORDINANCE OF CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE ELECTION ON THE ISSUANCE OF GENERAL OBLIGATION BONDS HELD NOVEMBER 7, 2017, AND CONTAINING PROVISIONS NECESSARY AND INCIDENTAL THERETO was duly introduced for the consideration of the City Council. It was then duly moved and seconded that the Ordinance be passed; and after due discussion, the motion, carrying with it the passage of the Ordinance, prevailed and carried by the following vote: Ayes 8 Nos 0 Abstain 0 CERTIFICATE FOR ORDINANCE CANVASSING BOND ELECTION PAGE 1 IATUFVCSOD3KGP 268 2. That a true, full and correct copy of the aforesaid Ordinance passed at the Meeting described in the above and foregoing paragraph is attached to and follows this Certificate; that the Ordinance has been duly recorded in the Minutes of the Meeting; that the above and foregoing paragraph is a true, full and correct excerpt from the City Council's Minutes of the Meeting pertaining to the passage of the Ordinance; that the persons named in the above and foregoing paragraph are the duly chosen, qualified members of the City Council as indicated therein; and, that each of the members of the City Council was duly and sufficiently notified, officially and personally, in advance, of the time, place and purpose of the aforesaid meeting, and that the Ordinance would be introduced and considered for passage at the Meeting, and each of the members consented, in advance, to the holding of the Meeting for such purpose; that the meeting was open to the public and public notice of the time, place and purpose of the meeting was given, all as required by Chapter 551 of the Texas Government Code. ATTEST: By ALL Belinda Hinojosa, City c etary (CITY SEAL) Wendell Dunlap, Mayor CERTIFICATE FOR ORDINANCE CANVASSING BOND ELECTION PAGE 2 IATUFVCSOD3KGP 269 ORDINANCE NO. 17-3666 AN ORDINANCE OF CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE ELECTION ON THE ISSUANCE OF GENERAL OBLIGATION BONDS HELD NOVEMBER 7, 2017, AND CONTAINING PROVISIONS NECESSARY AND INCIDENTAL THERETO STATE OF TEXAS COUNTY OF HALE CITY OF PLAINVIEW, TEXAS § § § WHEREAS, an election duly authorized by the City Council of City of Plainview, Texas (the "City") was held in the City on November 7, 2017, for the purpose of submitting a certain proposition to authorize the issuance of Certificates of Obligation to the resident qualified electors (the "Election"); and WHEREAS, this Council has investigated all matters pertaining to said Election; and WHEREAS, it is hereby found and determined that notice of the Election was duly given in the form, manner and time required by law, that proper election officers were duly appointed before the Election, and said Election was in all respects legally held and conducted in accordance with applicable laws of the United States of America and of the State of Texas and the proceedings calling and governing the holding of such Election. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS: SECTION 1: That all of the recitals contained in the preamble of this Ordinance are officially found and determined to be true and correct, and are adopted as findings of fact by this City Council. SECTION 2: That it is officially found and determined that the returns of said Election have been duly and legally made by the election officers who held the Election and were submitted to this City Council, and this City Council has duly canvassed said returns, all in accordance with the law and the proceeding calling said Election. INCLUDING 24TH STREET, AND THE LEVY OF A TAX IN PAYMENT THEREOF. CITY OF PLAINVIEW PROPOSITION B THE ISSUANCE OF $6,000,000 OF GENERAL OBLIGATION BONDS OF THE CITY OF PLAINVIEW, TEXAS, FOR ACQUISITION, CONSTRUCTION, RENOVATION. IMPROVEMENT, RELOCATION AND EQUIPMENT OF MUNICIPAL BUILDINGS, INCLUDING A POLICE HEADQUARTERS AND A CITY HALL, AND THE LEVY OF A TAX IN PAYMENT THEREOF. SECTION 4: That it is officially found that a majority of the resident qualified electors voted in favor of each of the Propositions A -F noted above at said Election, and as a result of said Election, and in conformity with law, this Council is authorized to issue bonds on behalf of the City in the manner and to the extent set forth in the proceedings calling said Election, and to the extent authorized by said Election. SECTION 5: That it is hereby officially found that the meeting at which this Ordinance has been considered and adopted is open to the public as required by law, and that written notice of the time, place and subject matter of said meeting, and the proposed adoption of this Ordinance was given as required by Texas Government Code Chapter 551.001, et seq.
