ORDINANCE NO. 18-3676
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS: AMENDING THE PLAINVIEW MUNICIPAL CODE OF
ORDINANCES, CHAPTER 6, ARTICLE 6.05, DIVISION 2, SECTION
6.05.031 TO UPDATE EMERGENCY MEDICAL SERVICE FEE RATES;
PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER;
PROVIDING FOR CONTINUATION OF PRIOR LAW; PROVIDING
PENALTY; PROVIDING FOR PUBLICATION AND EFFECTIVE DATE.
WHEREAS, the City of Plainview assures the availability of emergency medical
services (EMS) personnel, equipment, and vehicles by tax funding of the Plainview Fire
Department; and
WHEREAS, the actual usage of the EMS is intended to be on a fee-for-service
basis by those who use this City service; and.
WHEREAS, it has been over a decade since the EMS billing rates were last
reviewed and adjusted to better assure cost of services rendered are realized for the
assessed fees;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PLAINVIEW, TEXAS:
SECTION 1. The Plainview Municipal Code, Chapter 6, Article 6.05, Division 2,
Section 6.05.031 be and hereby is amended to read as follows:
Sec. 6.05.031 Services to be provided by city; fees; standards for operation,
equipment and personnel
(a) The city fire department shall provide emergency medical services within the city. This
department shall provide "basic life support services" and "advanced support life services.
(b) Fees for such services shall be as follows:
(1) Basic life support (non -emergency): $0• $750.00
(2) Basic life support (emergency): $350.00. $825.00
(1) (3) Advanced life support -1 (emergency): $1,150.00.

() Lt_t) Advanced life support -2: $600:99. $1,250.00
(CO ( Specialty care transport (SCT): $700.00. $2,500.00
(74 n Mileage: $9,50/mile. $15.00/mile
(.&) L Waiting time: $50.00 per 1/2 hour.
(9) (� Extra attendant: $125.00 per attendant.
(40.) (9) Nonresident fee: $100.00.
(11) Medical attention only: $125.00.
(12) Fit -St fespeeselno transport: $125.00.
(14) Oxygen: $75.00.
(c) The city emergency medical services department and operations shall conform and
comply with any and all applicable federal and state law. Minimum equipment and
personnel standards shall be established by the department of state health services and
the area medical director.
SECTION 2. Severability. If any provision, section, subsection, sentence, clause
or the application of same to any person or set of circumstances for any reason is held to
be unconstitutional, void or invalid or for any reason unenforceable, the validity of the
remaining portions of this ordinance or the application thereby shall remain in effect, it
being the intent of the City Council of the City of Plainview, Texas in adopting this
ordinance, that no portion thereof or provision contained herein shall become inoperative
or fail by any reasons of unconstitutionality of any other portion or provision.
SECTION 3. Repealer. All ordinances, parts of ordinances resolutions and parts
of resolutions in conflict with this ordinance are hereby repealed to the extent of conflict
with this ordinance.
SECTION 4. Continuation. That nothing in this ordinance (or any code adopted
herein) shall be construed to affect any suit or proceeding pending in any court, or any
rights acquired, or liability incurred, or any cause of action acquired or existing, under any
act, rate, or ordinance hereby repealed by this ordinance and such prior law is continued
in effect for purposes of such pending matter.
SECTION 5. Publishing and Effective Date. This Ordinance shall be in full force
and effect upon its passage and publication as required by law.
