R21-507 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS ESTABLISHING LEGISLATIVE PRIORITIES AND ADOPTING A LEGISLATIVE AGENDA FOR THE 87T" TEXAS LEGISLATURE INCLUDING ANY SPECIAL CALLED SESSIONS AND THE INTERIM WHEREAS, the City of Plainview, as a home rule city that derives its power from the Texas Constitution, possesses the full power of self-government and is the most direct, responsive and frequent point of contact between an elected governmental body and the citizens it serves; and WHEREAS, the City Council of the City of Plainview ("City Council") highest priority is to preserve its ability to govern effectively and efficiently for its citizens, residents, businesses and visitors; and WHEREAS, many of the governmental services that the citizens of the City of Plainview rely upon on a daily basis are provided for by their municipal government including law enforcement, fire and emergency response and basic utility services; and WHEREAS, the City Council finds legislative involvement to be a legitimate exercise of its elected duties as the governing body serving those who live, work, visit, and own property in the municipal limits and extra -territorial jurisdiction of the City of Plainview; and WHEREAS, the City Council understands that members of the Texas Senate and the Texas House of Representatives benefit from learning of the positions of locally - elected public officials charged with representing its citizens and providing essential governmental services; and WHEREAS, in order to preserve its ability to govern effectively and efficiently for its citizens, the City Council finds it to be in the public interest to take positions on certain issues that may come before the 87th Texas Legislature in 2021; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, HEREBY RESOLVES: 1. THAT the attached "City of Plainview Legislative Agenda 202-2021" is hereby approved and adopted and is incorporated as if fully set forth herein. 2. THAT members of the City Council are authorized and encouraged to meet with area state representatives and senators to discuss the City's Legislative Agenda and provide any information, assistance or support to state legislators to accomplish the City's Legislative Agenda. THAT the City Manager is directed to provide a copy of this resolution to Senator Perry (Senate District 28) and Representative King (House District 88), as the state legislators representing Plainview in the Texas Legislature. 4. THAT members of the City Council and City staff may work with peer cities in the State, the Texas Municipal League and other appropriate entities to fulfill the City's Legislative Agenda. 5. THAT the City Manager shall take any necessary lawful action to accomplish the City's Legislative Agenda including, but not limited to, meeting with area state representatives and senators, peer cities in the State, the Texas Municipal League and other appropriate entities to accomplish the City's Legislative Agenda. 6. THAT the City Manager shall take any necessary action to promote and inform the citizens of Plainview of the City's Legislative Agenda. 7. THAT it is imperative that state legislators fully understand the implications of legislation they act upon and seek the input and advice from local governments on legislative issues that have a direct impact on the local government's ability to self -govern and serve their citizens efficiently and effectively. CITY OF PLAINVIEW, TEXAS ATTEST: Belinda Hinojosa, Ity ecretary Resolution R21-507 Page 2 of 4 166 Exhibit "A" City of Plainview Legislative Agenda 2021 The City of Plainview will monitor proposed legislation and take appropriate action to assure the City is able to meet its obligations under the City Charter, applicable law and to provide local services as approved by the City Council as well as promote sound economic development in the community and for the State of Texas. The Plainview City Council identifies the following legislative priorities for 2021 Legislative Session: The City of Plainview supports: • Efforts to designate Interstate-27 north and south from its current limits to support growth throughout the state, to enhance safety, to enhance passenger and freight mobility and to support international trade through Texas. • Rules proposed by the Texas Comptroller of Public Accounts to appropriately distribute online sales tax revenue to points of destination • Efforts to remove minimum sales thresholds through online marketplaces to establish equity between online and traditional retailers • Efforts to require marketplace providers or facilitators of short-term rentals to remit the local portion of the HOT tax directly to the appropriate municipality. • Efforts to ensure cities can appropriately manage all utility installations within City rights -of -way including the ability to charge market -based rates for access to City rights -of -ways to all users • Expansion of broadband availability throughout Texas and provision of necessary state and federal funding for such expansion • Full funding for the Texas Recreation & Parks Account local grant program • Efforts to add municipal parks as an eligible use for HOT funding, subject to local approval The City of Plainview will oppose: • Legislation that would erode the governing authority of the duly elected Plainview City Council (Limits on Municipal Home Rule Authority or local control. • Limits on effective municipal participation in the legislative process and the ability to hire representatives with public funds to represent the City in accordance with this duly adopted legislative agenda on matters that would impact the City or our residents • New limits on City authority including additional appraisal or revenue caps and lowered rollback requirements Resolution R21-507 Page 3 of 4 167 1 • New limits on the use or calculations involving issuance of certificates of obligation by municipalities • Limits on municipal authority commonly known as preemption or super preemption bills • Increased pass -through or regulatory fees on cities that are collected for or on - behalf of the state • Removal of city original jurisdiction in utility rate -making proceedings or removal of the ability to recover reasonable expenses involved in rate -making proceedings, including contested cases • Limits or diminution of the State or Regional Water Planning or Flood Planning process Resolution R21-507 Page 4 of 4
